I, M.Mahesh, s/o_____________, aged about ___ years, occ: Assistant

General Manager __________, do solemnly affirm and state on oath as
follows:

1. I am the deponent herein and the Assistant General Manager cum

authorized signatory of the petitioner company and as such am well
acquinted with the facts of the case. I am competent to swear to the
contents of the affidavit.

2. I respectfully submit that the above C.C. was filed by the respondent /
complainant seeking refund of all the amounts paid towards steel
and turbo vents and compensation for alleged negligence and
efficiency of service herein and seeking such other incidental reliefs
mentioned therein.

3. I submit that the petitioner / opposite party 1 has changed the name
from Kirby Building Systems India Pvt Ltd to Kirby Building Systems
& Structures India Pvt Ltd. In support of the same, the certificate of
incorporation is filed herewith. It is just and neccessary to amend the
name of the plaintiff. No prejudice would be caused to the
respondent as the amendment sought is formal in nature. Unless, the
petitoner is permitted to amend the name of the plaintiff, the
petitioner would suffer irrepecable loss and injury.

Therefore it is prayed that the Hon'ble court may be

pleased to permit the petitioner to amend its name as KIRBY BUILDING
SYSTEMS & STRUCTURES INDIA PVT LTD, in the plaint and pass such other
order or orders as deemed to be fit and proper in the circumstances of the
case.
