DEVELOPER’S MANAGEMENT PERIOD

[Section 7, 9, 10, 11 & 18 Strata Management Act 2013]

From the date of delivery of vacant possession of a parcel to a purchaser until one month AFTER
the establishment of the JMB.

JOINT MANAGEMENT BODY (“JMB”)

[Section 15, 17, 19 & 30 of Strata Management Act 2013]

A JMB shall be established upon the convening of the first annual general meeting of that joint
management body-
• not later than twelve months from the date of delivery of vacant possession of a
parcel to a purchaser.
(this would mean that the Developer’s Management Period only lasts for 13 months, and
upon the establishment of the JMB, the developer no longer solely manages the development)

A JMB may be sued or sue in its own name and shall consists of the developer and purchasers.
(the developer is a compulsory member, with the intention to guide or assists purchasers to manage
the building pending the incorporation of the MC)

(s. 15 SMA 2013) (Handing over to JMB during the one month period (13th month) where the
Developer and JMB co-exist at the same time)

MANAGEMENT CORPORATION (“MC”)

"INITIAL PERIOD", in relation to a management corporation, means the period commencing on


the day on which the management corporation comes into existence and ending on the day on
which there are proprietors, excluding the original proprietor of the lot of land or the developer
who is registered as the proprietor of a parcel or parcels or a provisional block or blocks, the sum
of whose share units is at least one-quarter of the aggregate share units.

(meaning that when the strata register is opened in the land office, the Initial Period
commences, and such period will end when the purchasers collectively hold a minimum of
25% aggregate share units in the strata scheme)

It is the developer’s duty to convene the first annual general meeting of the management
corporation within one month after the expiration of the initial period
The developer shall give written notice of the first annual general meeting of the management
corporation to all proprietors not less than fourteen days before the meeting, and a copy of such
written notice shall be displayed at a conspicuous part of the development area.
