Analysis of Donations Received above Rs 20,000 by National Political Parties,

This report, prepared by Association for Democratic Reforms (ADR), focuses on donations above Rs 20,000, received
by the National political parties during the financial year 2021-22, as per details submitted by the parties to the Election
Commission of India (ECI). The National parties include Bharatiya Janata Party (BJP), Indian National Congress (INC),
Bahujan Samaj Party (BSP), Nationalist Congress Party (NCP), Communist Party of India (CPI), Communist Party of India
(Marxist) (CPI(M)), All India Trinamool Congress (AITC) and National People’s Party (NPEP).
Executive Summary
The executive summary below lists the key observations drawn from the report:
1. Status of Submission of Contribution Reports of National Parties, FY 2021-22

a) The due date for submission of contribution reports for the parties was 30 September 2022.
b) Only BSP, NCP and NPEP submitted their contribution reports on time while INC, AITC, CPI(M), BJP and
CPI submitted after a delay of 30 days, 33 days, 34 days, 37 days and 52 days respectively.

2. Donations above Rs 20,000 to National Parties from all over India, FY 2021-22
a) The total donations (above Rs 20, 000) declared by the National parties for FY 2021-22 was Rs 780.774 cr
from 7141 donations.
b) A total of Rs 614.626 cr from 4957 donations was declared by BJP followed by Rs 95.459 cr from 1255
donations declared by INC. The donations declared by BJP are more than three times the aggregate
declared by INC, NCP, CPI, CPI(M), NPEP and AITC for the same period.
c) BSP declared that the party did not receive any donations above Rs 20,000 during FY 2021-22, as it has
been declaring for the past 16 years.

3. Comparison of donations received by National parties during FY 2020-21 and FY 2021-22
a) The total donations of the National parties during FY 2021-22 increased by Rs 187.026 cr, an increase of
31.50% from the previous financial year 2020-21.
b) Donations to BJP increased from Rs 477.545 cr during FY 2020-21 to Rs 614.626 cr during FY 2021-22
(28.71% increase). While the party’s donations decreased by 41.49% during FY 2020-21 in comparison to
FY 2019-20.
c) INC’s donations increased from Rs 74.524 cr during FY 2020-21 to Rs 95.459 cr during FY 2021-22 (28.09%
increase). While INC’s donations decreased by 46.39% between FY 2019-20 and FY 2020-21.

d) In comparison to the previous financial year, decrease in donations declared by CPI(M) was 22.06% (Rs
2.846 cr), and by NPEP was 40.50% (Rs 24.10 lakhs).
4. State-wise donations to National Parties, FY 2021-22

a) Segregation of donations according to state was made by ADR based on the addresses provided by the
parties in their donations report to the ECI.
b) A total of Rs 395.849 cr was donated to the National Parties from Delhi, followed by Rs 105.3523 cr from
Maharashtra and Rs 44.9584 cr from Gujarat.
c) A total of Rs 12.2638 cr (1.571% of total donations received by the National parties, FY 2021-22) could not
be attributed to any State/ Union Territory due to incomplete/undeclared information provided by the
parties.
5. Donors from corporates/business sectors Vs. individual donors

a) 2551 donations to the National parties were made by corporate/business sectors amounting to Rs
625.883 cr (80.1619% of total donations) while 4506 individual donors donated Rs 153.328 cr (19.6379%
of total donations) to the parties during FY 2021-22.
b) 2068 donations from corporate/business sectors were made to BJP (Rs 548.808 cr) while 2876 individual
donors donated Rs 65.774 cr to the party during FY 2021-22.
c) INC received a total of Rs 54.567 cr via 170 donations from corporate/business sectors and Rs 40.892 cr
via 1085 individual donors during FY 2021-22.
d) BJP (Rs 548.808 cr) received more than seven times the total amount (Rs 77.075 cr) of corporate
donations declared by all other National parties for the FY 2021-22.

6. Top donors to National Parties, FY 2021-22
a) Prudent Electoral Trust donated a total of Rs 353 cr to BJP and INC together and is the top donor to parties
that received the maximum donations. The Trust donated Rs 336.50 cr to BJP (54.75% of total funds
received by the party) and Rs 16.50 cr to INC (17.28% of total funds received by the party).
b) Mrs. Ranjana Sachdev Santosh donated Rs 16.00 cr from 1 donation to NCP and Nuvoco Vistas
Corporation Limited donated Rs 15.00 cr from 1 donation to INC.
c) Pacific Exports donated Rs 10.50 cr from 7 donations, Ab General Electoral Trust donated Rs 10.00 cr from
2 donations, Shreeji Shipping donated Rs 10.00 cr from 1 donation and Yashoda Super Speciality Hospital
donated Rs 10.00 cr from 10 donations to BJP in the FY 2021-22.

Observations and Recommendations of ADR
Observations
1. INC, AITC, CPI(M), BJP and CPI submitted contribution reports after a delay of 30 days, 33 days, 34 days, 37 days
and 52 days, respectively.
2. It is to be noticed that BJP has declared Rs 614.526 cr but the actual calculated amount is Rs 614.626 cr in its
donation statement for FY 2021-22.
3. 3 National parties, BJP, INC and CPI(M) had not declared PAN details of 452 donations through which the parties
collected a total of Rs 10.843 cr (1.389% of the total donations declared by National parties).
4. 6 National Parties (INC- Rs 69.40 lakhs, BJP-Rs 46.80 lakhs, NCP- Rs 17.00 lakhs, CPI(M)- Rs 2.00 lakhs, NPEP- Rs
1.00 lakh and CPI- Rs 30,000) have declared Rs 1.365 cr from 62 donations having missing/incorrect PAN details.
5. BJP declared 1140 donations of Rs 12.673 cr, CPI(M) collected 372 donations worth Rs 6.339 cr, AITC collected 7
donations of Rs 43.00 lakhs, INC collected 17 donations of Rs 41.00 lakhs and NPEP collected 7 donations of Rs
17.70 lakhs having incomplete cheque/DD details where cheque number, bank details on which it was drawn and
the date on which the cheque was received/ encashed is not provided. Thus, without the complete cheque/DD
details, it would be a time-consuming process to link the donors against their donations and hence, trace the
money trail.
6. As done for the last 16 years, BSP has remarkably declared again that the party did not receive any donations
above Rs 20,000.
Recommendations
1. The Supreme Court gave a judgment on September 13, 2013 declaring that no part of a candidate’s affidavit
should be left blank. Similarly, no part of the Form 24A submitted by political parties providing details of
donations above Rs 20,000 should be blank.
2. All donors who have donated a minimum of Rs 20,000 as a single or multiple donations should provide their
PAN details.
3. Full details of all donors should be made available for public scrutiny under the RTI. Some countries where
this is done include Bhutan, Nepal, Germany, France, Italy, Brazil, Bulgaria, the US and Japan. In none of these
countries is it possible for nearly 50% of the source of funds to be unknown, but at present it is so in India.
4. The National parties should, ideally, led by example by filing complete and correct statements of donations
to the ECI well in time for public scrutiny so as to encourage financial transparency.
5. It is suggested that the ECI publicize on its website details of the action taken (if any) against political parties
that fail to provide required details (such as name, address, PAN and mode of payment) of individuals,
companies or entities making donations in cash.
6. Incomplete contributions reports having missing or incorrect PAN/mode of payment details must be
returned to the parties by the ECI, to deter them from providing incomplete information.
7. The National and Regional political parties must provide all information of their finances under the Right
to Information Act. This will go a long way in strengthening political parties, elections and democracy.

8. Annual scrutiny of donations reports of National, Regional and unrecognized parties should be initiated by
a dedicated department of the CBDT, to discourage donations from shell companies or illegal entities.
Detailed Report
Political parties rely heavily on donations for contesting elections and running their daily affairs. They receive huge
sums of money in the form of donations/ contributions from corporates or business houses, trusts and individuals.
Section 29C of the Representation of People Act, 1951 mandates that political parties submit their contribution
details in excess of Rs 20,000 received from any person or a company to the ECI annually, in order to enjoy 100%
tax exemption.
This report, prepared by Association for Democratic Reforms (ADR), focuses on donations above Rs 20,000,
received by the National political parties during the financial year 2021-22, as per details submitted by the parties
to the Election Commission of India (ECI). The National parties include Bharatiya Janata Party (BJP), Indian National
Congress (INC), Bahujan Samaj Party (BSP), Nationalist Congress Party (NCP), Communist Party of India (CPI),
Communist Party of India (Marxist) (CPI(M)), All India Trinamool Congress (AITC) and National People’s Party
(NPEP).
I. Donations above Rs 20,000 to National Parties from all over India (FY 2021-22)
a) The total amount of donations received above Rs 20,000 by National political parties during FY 2021-22
is calculated from the donations report submitted to the Election Commission annually.
b) The total amount of donations above Rs 20,000 declared by the National Parties was Rs 780.774 cr, from
7141 donations, which amounts to an average of Rs 10.93 lakhs per donation.
c) With regard to the total number of donations, BJP leads with 4957 donations from individuals and
corporates while INC declared a total of 1255 donations followed by CPI(M) with 535 donations, NCP
with 247 donations, CPI with 124 donations and NPEP with 16 donations. The least number of donations
was declared by AITC (7 donations).
d) A total of Rs 614.626 cr was declared by BJP during FY 2021-22 while INC declared receiving Rs 95.459 cr
during the same period.
e) The donations declared by BJP are more than 3 times the aggregate declared by the INC, NCP, CPI,
CPI(M), NPEP and AITC for the same period (Rs 614.626 cr against Rs 166.148 cr declared by the remaining
parties).
f) NCP received an average of Rs 23.44 lakhs per donation; BJP– Rs 12.39 lakhs per donation, INC – Rs 7.60
lakhs per donation, AITC – Rs 6.14 lakhs per donation NPEP – Rs 2.21 lakhs per donation, CPI(M) – Rs
1.87 lakhs per donation and CPI – Rs 1.56 lakhs per donation.
g) BSP declared that the party did not receive any donations above Rs 20,000 during FY 2021-22, as it has
been declaring for the past 16 years.

II. Comparison of donations received by National Parties between FY 2020-21 and FY 2021-22
a) The total donations of the National Parties during FY 2021-22 increased by Rs 187.026 cr, an increase of
31.50%, from the previous financial year, 2020-21.
b) Donations to BJP increased from Rs 477.545 cr during FY 2020-21 to Rs 614.626 cr during FY 2021-22
(28.71% increase) while donations to INC increased from Rs 74.524 cr during FY 2020-21 to Rs 95.459 cr
during FY 2021-22 (28.09% increase).
c) NPEP declared the highest decrease of 40.50%, from Rs 59.50 lakhs in FY 2020-21 to Rs 35.40 lakhs in FY
2021-22 while CPI(M) has declared decrease of 22.06%, from Rs 12.901 cr in FY 2020-21 to Rs 10.055 cr
in FY 2021-22.

III. Mode of Contribution to National Parties, FY 2021-22
a) National Parties declared receiving a total of Rs 543.714 cr by cheque/DD from 4815 donations and
formed 69.638% of the total donations received.
b) It is to be noted that 1543 donations of a total of Rs 20.029 cr or 2.565% of all donations contained
incomplete cheque/DD details while 9 donations, amounting to Rs 14.50 lakhs contained undeclared
information of the mode of contribution and formed 0.0185 % of the total donations declared by the
parties.
c) Rs 236.909 cr comprising of 2311 donations declared as received by the National Parties through Bank
Transfer for FY 2021-22.
d) Only 0.0008% of the total donations received from 6 donations or Rs 65,000 were by cash.

a) Corporates/business sectors have been segregated from individual donations by ADR as this segregation
is not a part of the form submitted by the political parties to the ECI.
b) 2551 donations from corporate/business sectors amounting to Rs 625.883 cr were made to the National
parties while 4506 individual donors donated Rs 153.328 cr to the parties during FY 2021-22.
c) With the maximum number of donations during FY 2021-22, BJP has declared 2068 donations from
corporate/business sectors amounting to Rs 548.808 cr while 2876 individual donors donated Rs 65.774
cr to the party.
d) Donations from corporates formed 89.29% of total donations declared by BJP.

VI. Incomplete disclosure of information in the donations report
a) Of the 8 National parties, 3 parties namely BJP, INC and CPI(M) had not declared PAN details of 452
donations through which the parties collected a total of Rs 10.843 cr.
b) INC collected Rs 7.352 cr from 161 donations but failed to provide PAN details of donors. CPI(M) collected
Rs 1.966 cr from 250 donations and BJP collected Rs 1.525 cr from 41 donations without PAN.
c) Four National parties (BJP, INC, NCP CPI(M), CPI and NPEP) have declared 62 donations of Rs 1.365 cr
having missing/incorrect PAN details for FY 2021-22.
d) INC declared Rs 69.40 lakhs from 21 donations with missing/incorrect PAN details of donors. BJP collected
Rs 46.80 lakhs from 35 donations without complete PAN, 2 donations of NCP (Rs 17 lakhs), 2 donations
of CPI(M) (Rs 2 lakhs), 1 donation of NPEP (Rs 1 lakh) and 1 donation of CPI (Rs 30,000) do not have
complete PAN details.

VII. Top donors to National Parties
a) Of the total donations of Rs 780.774 cr, the top 2 donors of every National party combined, donated a
sum of Rs 404.47 cr which forms 51.80% of the parties’ overall donations above Rs 20,000 during FY 2021-
22.
b) Prudent Electoral Trust donated a total of Rs 353.00 cr to BJP and INC combined and it is among top two
donors of BJP and INC. The Trust donated Rs 336.50 cr to BJP (54.75 % of total funds received by the party)
and Rs 16.50 cr to INC (17.28% of total funds received by the party).
c) INC received Rs 15.00 cr donations from Nuvoco Vistas Corporation Limited and BJP has received Rs
10.50 cr donation from Pacific Exports.
d) NCP received Rs 16 cr or 27.63% of its total donations from Mrs. Ranjana Sachdev Santosh.
e) CPI(M) received Rs 1.20 cr from Prosper Jewel Arcade Llp and CPI has received Rs 51.62 lakhs donations
from Kerala State Council.

VIII. Month wise donations received by National Political Parties
a) BJP collected maximum donations in March 2022, a total of Rs 29.483 cr from 531 donations and party
has declared Rs 23.782 cr from 708 donations in February 2022.
b) INC collected a total of Rs 14.2473 cr from 15 donations in September, 2022 and declared receiving Rs
7.005 cr from 7 donations in April 2021.

segregated these donations into different ranges by amount.
b) National Political Parties received 67 contributions between Rs one cr one to 50 cr amounting
to Rs 433.069 cr and formed 55.47% of the total share of contributions received.
c) Only one contribution worth Rs 50 cr was received with a total share of 7.04%.
