Mode of Procurement: Competitive Bidding

PROCUREMENT OF ON-GRID SOLAR POWER INSTALLATION AT DJVE BLDG.,

MANDALUYONG CITY
TWENTY FIVE MILLION PESOS ONLY (PHP 25,000,000.00)

WHEREAS, the RESEARCH AND DEVELOPMENT CENTER requested for

PROCUREMENT OF ON-GRID SOLAR POWER INSTALLATION AT DJVE BLDG.,
MANDALUYONG CITY, to the Bids and Awards Committee on Goods and Services for appropriate
action with the approved budget TWENTY FIVE MILLION PESOS ONLY (PHP 25,000,000.00), for
university use;

WHEREAS, on OCTOBER 9, 2023, the Bids and Awards Committee on Goods and Services
upon evaluation that the subject Purchase Request and other pertinent documents may fall under the
provisions of Competitive Bidding under Section 10 of the 2016 Revised Implementing Rules and
Regulations of the R.A. 9184;

WHEREAS, the consulting services to be procured must undergo posting and advertising to
invite bidders pursuant to Rule III Section 8 - Procurement by Electronic Means and the Philippine
Government Electronic Procurement System (PhilGEPS) and must be posted on conspicuous places
on the premises of the University, the Procuring Entity;

WHEREAS, the above-mentioned project has been posted on PHILGEPS on NOVEMBER 15,
2023, with a closing date on DECEMBER 5, 2023;

WHEREAS, after the pre-bidding conference last November 23, 2023, and after of series of
clarifications raised by interested bidders, it was determined by the members of the Bids and Awards
Committee that it is rightful to consider the procurement under ‘Infrastructure’ due to its scope as
identified by Section 5, Item (k) of RA 9184 which states that Infrastructure Projects-Include the
construction, improvement, rehabilitation, demolition, repair, restoration or maintenance of roads and
bridges, railways, airports, seaports, communication facilities, civil works components of information
technology projects, irrigation, flood control and drainage, water supply, sanitation, sewerage and
solid waste management systems, shore protection, energy/power and electrification facilities,
national buildings, school buildings, hospital buildings, and other related construction projects of
the government. For purposes of and throughout this IRR, the term “infrastructure projects” shall
have the same meaning as, and shall be used interchangeably with, “civil works” or “works.”;
WHEREAS, the project is also considered 'design and build', which is defined by Section 4 item
D) ANNEX “G” GUIDELINES FOR THE PROCUREMENT AND IMPLEMENTATION OF
CONTRACTS FOR DESIGN AND BUILD INFRASTRUCTURE PROJECTS of the 2016
Revised IRR supplementing RA9184, which refers to ‘INFRASTRACTURE PROJECTS’ as clarified and
confirmed by the institution’s legal counsel;

WHEREAS, the Bids and Awards Committee discussed the scope of the project with the
technical working group and confirming that the ‘term of reference’ requires revisit due to several
important considerations, such as the roofing area that shall carry the volume of the panels to be installed
as well as long-term post-sales warranty requirements and maintenance, ensuring that the winning bidder
will be accountable for continuous and long-term post-sales services;

WHEREAS, the technical experts also recommended that the winning bidder deliver not just the
solar PV system itself but also its installation, commissioning, and future maintenance to ensure that the
technology will work as intended;

WHEREAS, the bidder GREEN HEAT, who secured their bidding documents of Php 25,000.00
shall be entitled for refund as stated in Section17.5 of IRR of RA 9184 since the reason of failure is due to
failure of BAC to determine the appropriate procurement mode/prescribed bidding procedures;

NOW THEREFORE, be it resolved, as it is hereby resolved that the Bids and Awards
Committee on Goods and Services recommends the FAILURE of the PROCUREMENT OF ON-GRID
SOLAR POWER INSTALLATION AT DJVE BLDG., MANDALUYONG CITY, in the amount
TWENTY FIVE MILLION PESOS ONLY (PHP 25,000,000.00). NBAC-SEC-2023-444.
