APTEL Order dated 20.02.2024 in APL No 337 OF 2023 & IA No 531 OF 2023

M/S Tata Steel Ltd argued for exemption from RPO obligations for their captive co-generation plant,
but OERC ruled in Case 71/2022 in Order dated 01.02.2023 that they must comply with RPOs under
the 2021 Regulations, emphasizing the importance of promoting renewable energy and statutory
compliance. APTEL upheld OERC judgement.

APTEL Order dated 20.02.2024 in APL No 403 OF 2022

Bharat Feeds and Extractions Limited (engaged in manufacturing cattle feed and poultry feed )
challenged the Madhya Pradesh Electricity Regulatory Commission's order, seeking reinstatement of
its tariff category , quashing of demand notice from MP Discom, and bill revision, with the Tribunal
later invalidating the bills and demand notice, setting aside the Commission's order, and allowing the
discom to take fresh action following principles of natural justice as the agreement between Bharat
Feeds and Extractions Limited and MP Discom needs to be amended to change the Tariff Category of
Bharat Feeds and Extractions Limited.

OERC Order dated 13.02.2024 in 114/2023 & 133/2023

133/2023

- The OERC scrutinized the truing-up proposal of SLDC component-wise with audited books of
accounts maintained by OPTCL.

- The Commission approved the actual human resource expenses of Rs.986.743 Lakhs for FY 2021-22,
which was higher than the approved amount of Rs.793.630 Lakhs.

- Actual depreciation expenses were Rs.81.957 Lakhs for FY 2021-22, exceeding the approved
amount of Rs.71.298 Lakhs.

- SLDC claimed rebates of Rs.9.342 Lakhs for FY 2021-22 and Rs.10.426 Lakhs for FY 2022-23, which
were approved based on audited accounts.

- The Commission passed through truing-up deficits of Rs.205.457 Lakhs for FY 2021-22 and
Rs.80.255 Lakhs for FY 2022-23 in the ARR & Tariff Order for FY 2024-25

- The OERC approved the Annual Charges of Rs. 1596.078 Lakhs for SLDC operations in FY 2024-25, to
be collected from users of the Intra-State Transmission Network.

- SLDC's working capital requirement of Rs. 355.746 Lakhs for FY 2024-25 did not incur interest as the
SLDC Development Fund had adequate funds.

- A one-time Registration Fee of Rs. 1.00 Lakhs was proposed by SLDC for all users coordinating with
SLDC for Scheduling, Metering & Energy Accounting, which was endorsed by the Commission.

- The Application Fee and Scheduling Charges for Open Access Customers in FY 2024-25 were
approved by the Commission in alignment with OERC Regulations.

- The Commission sanctioned the details of ARR and Annual & Monthly Charges for SLDC in FY 2024-
25, outlining the collection process from various stakeholders.
