Maintenance Contract and Services for Fisheries Harbors

1. TENDER DOCUMENTS INFORMATION AND REQUIREMENTS

1.1 To comply with this requirement the Bidder must examine and fully understand the entire tender documents and
requirements.

1.2 Additional to all provided information in this Tender documents. Bidder must before submit the Bid, need to make
independent inquiries if required to assess the work volume and local conditions.
1.3 Bidder will bear all the expenses to collect all information and investigations on all matters, which may affect in any way
the design, scope of work, prices, risks, or obligations of the Bidder. The Bidder must consider all other matters and
possible contingencies affecting the entire scope of work.
1.4 Any neglect, delay, or failure on the part of the Bidder to obtain reliable information upon the foregoing or any other matter
affecting the design, scope of work, prices, risks, or obligations of the Bidder shall not relieve the successful Bidder from
the responsibilities, risks or liabilities under this tender.

2. DISCREPANCY OF THE TENDER

2.1 In the event of a discrepancy appearing in these documents, the Bidder shall immediately inform Ministry of Agriculture,
Fisheries and Water Resources Authorities in writing.

3. CONFIDENTIALITY OF THE TENDER

3.1 All documents issued and information given to the Bidder shall be treated strictly private and confidential, whether or not
the Bidder submits the Bid. Failing to do so, MAFWR Authorities will reserve the right to take legal action as per the
Sultanate of Oman Law.
3.2 If any requirement of any publication or disclosure of this Tender, the same shall be referred to the decision of MAFWR
Authorities only.

4. CANCELATION OF THE TENDER

4.1 MAFWR reserves the right to cancel the Tendering process at any time before the award of the tender, without incurring
any liability whatsoever to any Bidder. MAFWR has not any obligation to inform any Bidder of the reasons behind the
canceling decisions.

5. TENDER CLARIFICATIONS

5.1 Bidder must write to MAFWR Authorities if they face any doubt or obscurity of the meaning of the Tender Documents.
The last clarification must be sent based on schedule given on the E-tendering portal.

5.2 MAFWR will reply to all clarifications and distribute all the clarifications replies to all participating Bidder on E-Tendering
Portal.

6. ADDENDUM OF TENDER DOCUMENTS

6.1 Addendum/Circular Letter to the Tender Documents may be issued before the Bid submission date for clarifying any
stipulations if required or to reflect any modifications.
6.2 Any interpretation and/or modification of the Tender Documents will be made by formally issued by MAFWR Authorities
only.

7. ALTERATIONS OF TENDER DOCUMENTS

7.1 The Bidder is not allowed to delete, modify, or amend any of the tender documents.
7.2 No alterations in the text of the tender documents shall be made except for the filling in the blanks intended to be filled in.
Failure to fully comply with this instruction may result in the rejection of the Bid.
7.3 Any alterations made by the Bidder to a unit rate or amount to correct clerical errors or legibility must be initialed by the
person authorized to sign the Bid.

8. MEASUREMENT UNITS OF THE BID


The Bidder shall use the metric system only.

9. CURRENCY OF THE BID


The currency of the Bid shall be the Omani Rials “OMR” only.

10. VALIDITY OF THE BID


The Bid shall be valid for ninety days (90 Days) from the date of the submission.
MAFWR Authorities will inform the Bidder in writing if Bid validity required further extension.

11. SUBCONTRACT
All Bidder shall inform MAFWR Authorities whether a sub-contract will be utilized to supply any goods or services under
the contract.

If the main Bidder is willing to appoint a sub-contract for some or all of the works, then the main Bidder has to provide all
listed document mentioned in point 16 of this document “14. DOCUMENTS TO BE SUBMITTED”.

12. PREPARATION AND SUBMISSION EXPENSES OF THE BID


All expenses incurred for the preparation and submission of the Bid shall be borne by the Bidder.

MAFWR Authorities or any of its employees shall not bear any responsibility whatsoever, nor pay for any expense or loss
which may be incurred by the Bidder in the preparation and submission of the Bid.

13. DOCUMENTS TO BE SUBMITTED


The Bidder shall submit the documentation listed in the table below. Failing to comply with document submission will
result in the bid's rejection.

14. TENDER EVALUATION

14.1 Minimum score to be obtained in technical evaluation is 50 points out of 100 points in the technical proposal and shall be
considered as technically qualified.

15. ARITHMETICAL ERRORS RECTIFICATIONS OF THE BID

15.1 The Bidder must ensure the schedule of the rate is entered correctly.
15.2 If there is a discrepancy between the unit rate and the total price obtained by multiplying the unit rate and quantity, the unit
rate shall prevail and the total price shall be corrected. Unless in the opinion of MAFWR Authorities there is an obvious
misplacement of the decimal point in the unit rate, in which case the total price as quoted will govern and the unit price will
be corrected.
15.3 If any error is considered by MAFWR as per the above procedure, the Bidder should be notified as soon as an alteration
takes place. The Bidding.

16. QHSE REGULATIONS

16.1 The Contractor shall comply at all times with the Sultanate of Oman legislation and rules in regards to Health, Safety &
Environment.
16.2 The Contractor shall be responsible for making all necessary arrangements to ensure Contractor employees comply with all
relevant quality and health regulations.

17. ADDITIONAL SITE

17.1 Any additional sites will be charged based on similar sites and regions already listed in the contract and would be agreed
mutually between Ministry of Agriculture, Fisheries and Water Resources and Contractor.

18. ADDITIONAL WORK

18.1 Any additional work will be charged based on similar work already listed in the contract and would be agreed mutually
between Ministry of Agriculture, Fisheries and Water Resources and Contractor.

19. WORK QUALITY AND WARRANTY

19.1 The contractor is responsible for the quality, technical accuracy, timely completion, and delivery of all deliverables and
other services as per the scope of work.
19.2 The Contractor agrees to perform in a good, skillful, and timely all services as per terms and conditions.
19.3 The work warranty must be at least 12 months
19.4 The Contractor shall, without additional compensation, correct or revise any errors, omissions, or other deficiencies in the
services and deliverables under this contract.
19.5 Approval of any payment, service report or deliverer note for any of the services performed by the Contractor under this
Contract shall not a release or waiver of any Ministry of Agriculture, Fisheries and Water Resources claim, has or may have
for latent defects or errors or other breaches of warranty or negligence.

20. EQUIPMENT AND SPARES WARRANTY

20.1 The Contractor is responsible for maintaining a list of items that are under warranty and responsible for coordination with
the supplier for warranty replacement items.
20.2 All replacement spares must be new parts. Sample to be approved by Ministry of Agriculture, Fisheries and Water
Resources Authorities before work commencement.
20.3 Spare parts shall be free of defects and must be warranted when applicable.
20.4 All spare parts warranty should be at least 12 months from the date of installation/use.
20.5 Replacement, repairs, and troubleshooting shall be carried out as per the manufacturer's specified method and procedure.
20.6 All necessary tools shall be procured and used as per the manufacture’s recommendation.

20.7 Ministry of Agriculture, Fisheries and Water Resources will reserve the right to reject any spare or tools not meet the
standards.

21. MEETINGS

21.1 Meetings shall be conducted in the English language.


21.2 Ministry of Agriculture, Fisheries and Water Resources contract holder or nominated representative shall chair all
meetings.
21.3 Ministry of Agriculture, Fisheries and Water Resources contract holder shall prepare the agenda and review the material
required for each meeting.
21.4 Contract Performance meeting will be conducted quarterly.
21.5 Ministry of Agriculture, Fisheries and Water Resources or Contractor may call separate specific meetings as may be
necessary during the performance of the work. Such meeting requests shall be advised a minimum of two (2) days in
advance unless it’s an emergency meeting.
21.6 Minutes of meetings shall be dated and numbered consecutively to record all action items discussed, and/or agreed upon
during the meeting and shall indicate the party to take the required action by the due date.
21.7 A discussion of minutes of the previous meeting shall be the first agenda point of the subsequent meeting, and previous
minutes shall be approved or amended accordingly.
21.8 Minutes of each meeting shall be prepared and forwarded to endorsement within two (2) Days following the Day of the
meeting.
21.9 The Contractor shall acknowledge within two (2) days from receiving the minutes of the meeting, or revert for any further
change/revision.
21.10 If no response is received from the Contractor within two (2) days from the date of the minutes of the meeting sent,
Ministry of Agriculture, Fisheries and Water Resources will consider acknowledgment from the Contractor and proceed
with all agreed points and action points.

22. PERFORMANCE BOND


The successful Contractor shall provide a Performance Bond/Bank guarantee equal to a maximum of 5% of the estimated
total contract value and valid up to the end of the contract/service period plus one month.

23. INCLUSION OF SERVICE COST


The rate of the service cost shall include without limitation the following:

23.1 The total cost of materials & equipment delivered to the site and required for any works, as per the scope of work described
in the Tender.
23.2 The total cost of labor, workmanship is required for any works, as per the scope of work described in the Tender.
23.3 The total cost of vehicle maintenance.
23.4 The total cost of maintaining the equipment required for any work as per the scope described in this Tender.
23.5 Cost of transportation to/from the Site.
23.6 Cost of mobilization, demobilization, and site clearing.
23.7 Cost of surveys.
23.8 Cost of the passes/permits and getting approvals of the works from authorities.
23.9 Cost of coordination with the site manager

24. MOBILIZATION PERIOD


The successful Contractor will have a maximum of 30 days mobilization period from signing the contract, any possible
delay should be communicated officially with justification to Ministry of Agriculture, Fisheries and Water Resources for
review and approval.

25. SITE PREPARATION AND ACCESSIBILITY

25.1 All work carried out at the site is to be undertaken safely and efficiently with the minimum of interference with the
operation of the Ministry of Agriculture, Fisheries and Water Resources.
25.2 All work at the Site shall be carried out in such manner not to obstruct the operation of any other Contractor on the Site or
the operations of the site, especially sales.
25.3 The Site must be kept clean and free from obstruction, rubbish, and general spoil as the work proceeds and to be maintained
to the satisfaction of the Supreme Judicial Council.
25.4 The public ways from which access to the site must be kept clear and free from soil, muck, rubbish, and disturbance.

26. EXISTING SERVICES

26.1 Before starting any excavation, or work the Contractor shall ensure by all appropriate methods the location of all above and
below ground/wall services such as water mains pipes, telephone and electricity cables, etc., in the vicinity of the Works.
The Contractor shall protect all such services and keep them in sound working order during the whole period of the work. If
the damage is caused, the Contractor shall repair the same with the approval of Ministry of Agriculture, Fisheries and
Water Resources and relevant authority.

26.2 The Contractor shall bear the cost to rectify any damage to surrounding property, which may be caused during the progress
of work.
26.3 The Contractor shall observe all necessary safety precautions required in the site area.

27. CLEANLINESS OF THE SITE

27.1 Contractor shall throughout the term of the Contract maintain the Site in a clean and tidy manner and shall remove any
excess rubbish or materials at the Site as may be required during the performance of the Work or as reasonably directed by
Ministry of Agriculture, Fisheries and Water Resources.
27.2 Upon completion of the Work Contractor shall leave the Site in a clean and orderly condition with nothing left buried or
hidden. The Contractor’s representative or Contractor’s Site representative shall remain at the Site until all restoration and
cleaning work has been carried out to the Ministry of Agriculture, Fisheries and Water Resources satisfaction.

28. CONTRACTOR VEHICLES

28.1 All motor vehicles are to be maintained in a roadworthy condition and shall comply with the necessary traffic regulations in
Oman.

29. CONTRACTOR MANPOWER

29.1 The Contractor shall include for the provision of all necessary supervisory, skilled and unskilled labor for erecting, testing,
commissioning, and maintaining the works together with all necessary transport, accommodation including obtaining
permission from local authorities for setting up labor camps where required, and other services necessary to support his
supervisory and labor force as per the Conditions of Tender.
29.2 The Contractor should arrange training for a technician for different model and type of the equipment as per the tender
scope of the work.
29.3 Trained technicians shall only be employed for repairing any intricate works.
29.4 Personnel employed or hired directly by the main Contractor shall be responsible for their behavior at the Ministry of
Agriculture, Fisheries and Water Resources sites.
29.5 Ministry of Agriculture, Fisheries and Water Resources reserve the right to reject any workforce not complying with the
Sultanate of Oman regulations, and/or Ministry of Agriculture, Fisheries and Water Resources QHSE regulations, or not
competent enough to perform the required work as per the tender scope of the work.

30. CONTRACTOR TEAM STRUCTURE MODIFICATION


In case, the Contractor wishes to change in the approved Organization, team, or Sub-Contractor structure, official writing
must be sent to Ministry of Agriculture, Fisheries and Water Resources notifying the change. The change must be inline as
per the tender terms and conditions. Ministry of Agriculture, Fisheries and Water Resources will review the new staff CV
and competency, and the acceptance letter/email will be sent to the Contractor.

31. CONTRACTOR STAFF LEAVE.

31.1 During the leave of any approved team, the notification must send to Ministry of Agriculture, Fisheries and Water
Resources about the leave and expecting leave duration and to whom handover the responsibility.
31.2 The annual leave and emergency leave must not affect work performance.

32. CONTRACTOR ADDRESSES

32.1 The Contractor shall maintain an address in Oman at which notices are sent/delivered to it.
32.2 A minimum of 30 days prior notice shall be given to Ministry of Agriculture, Fisheries and Water Resources if the
Contractor changes the address.

33. CONTRACT OPERATION PERIOD


The operational period of the contract shall be for One (1) year.

34. CONTRACT TERMINATION:


If contact default applies more than two (2) times within four (6) months.

35. FORCE MAJEURE


Force Majeure means unforeseen and unavoidable events beyond the control and without the fault or negligence of the
parties. Should an event of Force Majeure arise after the commencement of the work, the Contractor shall raise a claim
within (14 days) from the date of the event. This will not relieve the Contractor from the obligation in the tender however,
it will be counted as a document for the Contractor in the case of a claim for only a time extension. Ministry of Agriculture,
Fisheries and Water Resources has the right to accept or reject the claim if it is not justified.

36. SCOPE OF WORK


Maintenance Support and replacement of old CCTV devices which are replaceable and outdated (CCTV system)
undertakes to provide maintenance services related to existing hardware in the Ministry of Agriculture, Fisheries and Water
Resources sites. The number of sites can increase or decrease over time. The scope of work will be:

36.1 Preliminaries and General Requirements

36.2 Routine Maintenance for the CCTV System.

The Routine Maintenance at Ministry of Agriculture, Fisheries, and Water Resources sites entails scheduled operations and
practices aimed at maintaining the surveillance infrastructure's optimal performance and reliability. It involves periodic
checks, including camera calibration, software updates, and hardware diagnostics, ensuring continuous surveillance
effectiveness at Ministry’ s sites, safeguarding personnel, assets, and resources.

36.3 Emergency Call Works.

Implementing and assigning agreement for Emergency Calls Response for any major technical issues that required to be
attended and repaired. Both minor and major raised technical issues must be attended by online and on-site technical
support providing fluent reports and updates to Ministry of Agriculture, Fisheries and Water Resources.

36.4 Cost of Estimated Materials & Services.

Within this section, a thorough breakdown outlines the anticipated costs associated with procuring materials such as
cameras, recording equipment, and cables, as well as services including installation, configuration, training, and ongoing

37. WORK RECEIVING AND REPORTING

37.1 The Contractor shall receive all types of tasks order through E-mail only.
37.2 Each task will have a unique Tracker ticket. The tracker ticket should mention in all related documents in that task order.
37.3 During assigning any task, the Contractor will receive notification through email.
37.4 Contractor has to visit the site troubleshoot the issue and get the BOQ approval from Ministry of Agriculture, Fisheries and
Water Resources Focal Point before fixing the issue.
37.5 Ministry of Agriculture, Fisheries and Water Resources will consider the Email conversation as a reference for any update.
37.6 Once the work is completed/attended, the Contractor needs to update the task order status within 48 working hours.
37.7 The Contractor needs to attach a copy of the work order with each report.
37.8 The Contractor needs to add/update equipment model number and serial number whenever it used.
37.9 The Contractor needs to add/update spare parts serial number whenever it used.
37.10 After work completed successfully, the Contractor needs to scan all the document related to the task order and send it to the
same email which he received the Task Order.
37.11 The Contractor shall comply 100% with approved and agreed delivery time.
37.12 The Contractor shall comply with All Pre-approved requests. Approved schedule compliance should be 100%.
37.13 The Contractor has less than 48 hours to respond for any emergency
37.14 The Contractor has less than 48 hours to respond for any communications/clarification send by Supreme Judicial Council.
