DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT TO SELL, made and executed by and between:

I, EDIGULACION ATIS, of legal age, Filipino citizen, and with residence and address at
Sta. Cruz, Lilo-an, hereinafter referred to as the "SELLER/VENDOR";

-AND-

CHARLITA PEPITO, of legal age, Filipino citizen, and with residence and postal
address at Sta. Cruz, Lilo-an, Cebu, hereinafter referred to as the "BUYER/VENDEE".

WITNESSETH;

WHEREAS, the SELLER/VENDOR is the absolute and registered owner of a parcel of


land consisting of ONE HUNDRED (100) square meters, more or less, located at Brgy. Sta. Cruz,
Municipality of Lilo-an, Province of Cebu, particularly described as follows:

Transfer Certificate of Title No 102-2012005311

“A portion of Lot 4191-F, containing an area of ONE HUNDRED (100) square


meters; the said Lot 4191-F pertains to the share of the Vendor and the portion subject of sale is
taken from his said share of Lot 4191-Part, which is declared in the name of Antonio Atis under
Tax Declaration No. 24-0009-25143, situated at Santa Cruz, Lilo-an, Cebu and which portion is
bounded as per attached plan;”

WHEREAS, the BUYER/VENDEE has offered to buy and the SELLER /VENDOR has
agreed to sell the above mentioned property under the terms and conditions herein below set
forth;

NOW THEREFORE, for and in consideration of the total sum of FIFTY THOUSAND
PESOS (Php: 50,000.00), and of the covenants herein after set forth
the SELLER/VENDOR agrees to sell and the BUYER/VENDEE agrees to buy the aforesaid
property subject to the following terms and conditions:

1. The total consideration shall be payable as follows:


a) The amount of FIFTY THOUSAND PESOS (Php: 50,000.00) receipt of which the
SELLER/VENDOR acknowledges.
2. That the area covered by this sale is only ONE HUNDRED SQUARE METERS (100
sq.m.).
3. Possession to the subject property shall be delivered by the SELLER/VENDOR to
the BUYER/VENDEE upon full payment of the total consideration;
3. The SELLER/VENDOR shall likewise deliver any and all documents, including but not
limited to the original owner’s copy of Transfer Certificate of Title, Tax Declaration and all other
documents necessary for the transfer of ownership from SELLER/VENDOR to
the BUYER/VENDEE.
4. That the VENDOR does hereby covenant and agree with VENDEE that the above-described
property is free from all liens and encumbrances, that he has a perfect right to convey the same,
and that she will warrant and forever defend the same unto the said VENDEE, his heirs and
assigns, against the lawful claims of all persons whomsoever.
5. That the VENDEE agrees to shoulder the expenses for the transfer of the registration,
documentary stamps tax, transfer fees, notarial fees, and all other fees or expenses incidental to
the transfer of the title of the above-described property.

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures, this ___ day of
