Human rights and their role in Tajikistan

The rights and freedoms of a person and a citizen are an


important element of the rule-of-law state, the primary
institution of civil society, a sign of the rise of human
society, legal culture and civilization in general. The
theory and practice of the rights and freedoms of a
person and a citizen has a centuries-old history and is
reflected in various documents and acts of human
history, such as the Declaration of Independence of the
United States (p. 1776) (Russian: Declaration of the
Independence of the United States, the Declaration of the
Rights of Man and Citizen of France (p. 1789)). Russian:

The Constitution of the Republic of
Tajikistan (1994) strengthened human
rights in Article 5. The second chapter
of the Constitution is fully devoted to
the rights and freedoms of man and
citizen. Natural human rights refer to
the rights of citizens of Tajikistan,
foreigners and stateless persons, which
naturally (regardless of the state and
place of residence) belong to each
individual.

Citizen's rights - refers to the rights of citizens


of Tajikistan. Freedom is the area of
individual autonomy guaranteed by law,
within which a person acts independently,
according to his wishes. Rights and freedoms
of a person and a citizen - the legal status of a
person is determined by the set of rights and
freedoms and basic duties of a person and a
citizen, which are reflected in the norms of all
areas of the applicable law. The basis of the
legal status of a person and a citizen includes
the rights, freedoms and duties established by
the constitution.
For a person and a citizen, rights and freedoms are a means of self-
expression and revealing the ability to form and develop in society,
ensuring the dignity that is characteristic of a free personality, a means of
realizing his undeniable rights to participate in the management of the
society of which he is a member, providing the necessary economic and
social conditions. social and cultural to satisfy vital material and spiritual
needs. The basic rights and freedoms of a person and a citizen are
characterized by being established and strengthened by a special legal
form. They are strengthened in the highest legal act of the state - the
Constitution, which has the highest legal force.[1]
