AFFIDAVIT OF UNDERTAKING

I, VIVIAN C. FAJADA, of legal age, Filipino, single/married, and a resident of

Baybay, Roxas City, Capiz, Philippines, after having been duly sworn to in accordance
with the law, hereby depose and state that:

1. I am the operator and registered owner of the Aluminum Wing Van Truck
bearing plate number CBP 2740, driven by one JOEY MARAVILLA y DELFIN
together with one helper in named ANDREW BIAO y BALDOMERO;

2. On 15 February 2023, the above-said vehicle was traversing from Kalibo,

Aklan going to Roxas City, Capiz, and upon reaching Sitio Perara, Brgy.
Dapdapan, Sapian, Capiz, the said Wing Van Truck was waylaid by 4
suspects riding on two single motorcycles who asked for money and when
refused to give in, the latter fired two shots on the left side door windshield of
the truck, and hitting the driver JOEY MARAVILLA y DELFIN;

3. That JOEY MARAVILLA y DELFIN and ANDREW BIAO y BALDOMERO

immediately proceeded to Ivisan MPS, Ivisan, Capiz to report the incident and
the Police Officers of Sapian MPS immediately responded to provide
assistance;

4. That the said truck Wing Van Truck is currently impounded at Sapian MPS,
where the incident actually took place;

5. Since I need the impounded Wing Van Truck for transportation in relation to
my business, I am requesting Sapian MPS, Sapian, Capiz to release my
vehicle and I undertake to produce vehicle upon request of the proper
authorities if such will be needed for further proceedings or investigation;

6. I am executing this affidavit to support my request for the release of the

impounded vehicle, to attest to the truth of the foregoing statements, and for
whatever legal intents and purposes the same may serve best.
