AFFIDAVIT OF UNDERTAKING

I, JAYRO M. SABAY, JR., of legal age, Filipino, married, and a

resident of New Buswang, Kalibo, Aklan, after having been duly sworn to in
accordance with law hereby depose and state that:

1. I am the Operations Manager of KJAD Travel and Tours with its

branch office at Poblacion, Kalibo, Aklan;
2. That I am supervising the operation of transport vehicles used to
transport different passengers to different parts of Panay Island;
3. That one of our vehicle particulary TOYOTA HI ACE GRANDIA
VAN with Engine No. 2KD5751873, Chassis No.
JTFRS13P200024694, Certificate of Reg. No. 176196672 dated
7/11/2014 leased to HILBERT SABAY of MAKATI NCR and driven
by our driver, ZOILO SARROZA JR y PACLIBAR a resident of
Magpag-ong, Batan, Aklan, and is a holder of LTO Professional
Driver’s License bearing number F07-07-000909 ;
4. That the above described motor vehicle driven by was involved in
an accident that occurred sometime last October 20, 2022
approximately at about 9:20 o’clock in the evening with a HONDA
TMX TRICYCLE registered under the name of MARIA VENUS
SERFINO and was driven by NORBERTO ZAPICO y ZAULDA, a
resident of Purok 1, C Laserna Street, Kalibo, Aklan. The said
accident caused damage to both vehicles and the driver of the
Tricycle sustained physical injuries. Such fact is embodied in the
police blotter hereto attached as Annex “A”;
5. Because of such incident, our vehicle was impounded by the
authorities specifically the Kalibo Police Station;
6. I hereby undertake to produce said vehicle upon request of the
authorities if such will be needed for further proceedings or
investigation;
7. This affidavit is being executed to support my request for the
release of the impounded vehicle;
8. Further, I am executing this undertaking to attest the truth of the
foregoing.
