PENDING CASE

I, ARMANDO LOSARETO, of legal age, Filipino and a resident

c/o BJMP, Canocotan, Tagum City after having been duly sworn to in
accordance with law hereby depose and say:

1. That I am the same Armando Losareto who applied for

parole with the Parole and Probation Administration Office, DOJ
Agencies Bldg., NIA Road corner East Avenue, Quezon City;

2. That except for Criminal Case No. ___________for Violation

of R.A. 6425 before Regional Trial Court Branch 30, Tagum City in
which I was convicted and presently detained at Tagum City Jail,
Canocotan, Tagum City and I hereby manifest and declare that there
are no other pending criminal, civil or administrative cases filed
against me in any court throughout the Philippines.

3. That I am executing this affidavit to attest to the truth of the

foregoing facts and for whatever legal purpose this may serve.

AFFIDAVIT OF UNDERTAKING

I, NELSON L. GUNABE, of legal age, Filipino and a resident Prk. 7,

Nabunturan, Comval Province, after having been duly sworn to in accordance
with law hereby depose and say:

1. That I am the registered owner of a motor vehicle particularly described,

to wit:

2. That sometime on September 1, 2004 the said motor vehicle was

apprehended by Kapalong Police for allegedly loading or carrying parts of heavy
equipment (crane) worth Two Hundred Thousand (P200,000.00) Pesos
belonging to NIA without its permission and to the damage and prejudice of said
owner;

3. That the above-mentioned motor vehicle is presently under Custodia

Legis due to the reason mentioned in the preceding paragraph;

4. That I am requesting the Honorable Court for the release of my said

motor vehicle for humanitarian reason since I need it for me to continue earning a
living;

5. That I hereby undertake and assure this Honorable Court that when the
above-described motor vehicle is needed in Court for exhibit it shall be readily
presented;

6. That I am executing this affidavit to attest to the truth of the foregoing

facts and for whatever legal purpose this may serve.
