AFFIDAVIT OF UNDERTAKING
I, PEDRO PENDUKO, of legal age, Filipino, and a resident of
Guwapoguwapo, Ilocos Sur, after having been sworn to in accordance with
law hereby depose and state:
1) That I am the actual, registered, and the exclusive owner of a
motor vehicle particularly described as follows:
MAKE: TOYOTNA SERIES/MODEL: VOSO 2006
PLATE NO.: XXX 1212 ENGINE NO.: 2NZ-12345
BODY TYPE: SEDAN 4-DOOR MV FILE: 1234-0000001111

2) That I hereby request for the release of the MOTOR VEHICLE

above-described which is presently in the custody of the Colas Colas, Ilocos
Police Station, by virtue of the filing of cases with I.S. Nos. I-00-INQ-00A-
00001 and I-00-INQ-00A-00002, both for Viol. Of R.A. 10591 against the
respondents in said case;
3) That the said property is not an instrument or tool for the
commission of any offense although it appears that it was where the seized
items (firearm) were recovered. That as per records, said property was
already photographed and certified by the police custodians accurately
representing the same;
4) That should the said vehicle be needed in the course of the
hearing/trial of this case, I undertake to deliver and surrender it to
the custody of the proper government agency or court;
5) That this affidavit is executed in order to attest to the veracity of
the averments stated herein and for whatever legal purpose this may serve.
