WHEREAS, Information was filed on January 29, 2010 in REGIONAL

TRIAL COURT 11th Judicial Region Branch 39 Polomolok, South Cotabato
charging the accused GELIO P. SALING with the offense of FRUSTRATAED
MURDER for which a bail of TWENTY FOUR THOUSAND PESOS
(P24,000.00) for the accused for his provisional liberty has been fixed by
the Honorable Court.

NOW, THEREFORE, I, CAPT. PONY DAWANG, authorized

representative of deceased CAPITAN DAWANG with residence and
postal address at Kablon, Tupi, South Cotabato , undertake to be the
bondsman of Accused GELIO SALING y PANANSANG and further
undertake that the said Accused will appear and answer the charge
above-mentioned in whatever Court it may be tried and will, at all times,
hold himself amenable to the orders and processes of the Court, and if
convicted will appear for execution thereof, or if he fails to perform any of
these conditions, I will pay the Republic of the Philippines, the total sum of
TWENTY FOUR THOUSAND PESOS (P24,000.00) which for the
payment thereof, I encumber and constitute a first lien in favor of the
Republic of the Philippines, the real estate owned by CAPITAN DAWANG
hereunder described as follows, to wit:

Assessor’s Lot No. 021 situated at in the Brgy. Kablon Tupi,
South Cotabato, containing an area of SEVEN hectares

NUMBER K-0700410”

I, FURTHER declare under oath that the property above-described

have not heretofore been encumbered, mortgaged, or pledged as security
for the provisional release of any accused person or the performance of
any obligation of any kind except as above-indicated;

I, FURTHER bind myself by these presents to give the Court at

least ten (10) days notice of any transfer or other disposition to be made
of any of the property above-described in order that the Court may take
such action as may be necessary to protect the interest of the Republic of
the Philippines and for me to avoid liability under Art 316 (6) of the
Revised Penal Code;

It is further stipulated that pursuant to Section 19 Art. IV of the

Constitution and Letter of Instruction No. 40 of the President of the
Philippines, I, the undersigned surety with express conformity of the
accused hereby agree that in case said accused jump bail or fail to appear
for trial without any justification despite due notice to me, as surety he
will be deemed an express waiver of his rights to be present which will
warrant the Court to proceed with the case as if the accused were
present.

 AFFIDAVIT OF JUSTIFICATION

I, PONY DAWANG, Filipino, of legal age, married and a resident of

Kablon, Tupi, South Cotabato, Philippines, after having been duly sworn to
in accordance with law, hereby depose and say:

That I am the surviving son and authorized representative of

deceased Capitan Dawang and now the free holder of a parcel of land
bearing Cadastral Lot no. 3289 and Assessor’s Lot No. 021 situated at in
the Brgy. Kablon Tupi, South Cotabato, containing an area of SEVEN
hectares (7.7962) more or less and covered by TAX DECLARATION
NUMBER K-0700410, that I am worth the amount specified in the
foregoing bail bond over and above-all just debts and that the entire sum
justified by each of us is equivalent the whole amount of bail demanded.

SALING y PANANSANG for FRUSTRATED HOICIDE;

3. That I execute this Affidavit to attest to the truth of the above

facts and circumstances and for whatever legal purpose it may serve

in accordance with law, hereby depose and say:
 1. That I am the surviving son and now the authorized
representative of deceased Capitan Dawang over the real property
described as follows, to wit:

2. That the above-described property is not tenanted nor worked by

an agricultural lessee as of October 21, 1972 up to the present and
therefore not covered by P.D. No. 27 together with its implementing rules
and regulations;

facts and circumstances and for whatever legal purpose it may serve
best.
