EXTRA-JUDICIAL SETTLEMENT OF THE

ESTATE OF THE LATE SANTOS NACIONAL

WITH DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Extra-Judicial Settlement is made and entered into by and between:

JUSTINA B. VDA. DE NACIONAL, Filipino, of legal age, widow and a

resident of Maitum, Cotabato;

MANUEL NACIONAL, Filipino, of legal age, married and a resident of

Koronadal, South Cotabato;

LEO NACIONAL, Filipino, of legal age, married and a resident of

Kiamba, Cotabato;

ELVIRA NACIONAL, Filipino, of legal age, married and a resident of

Maitum, Cotabato;

JEREMIAS NACIONAL, Filipino, of legal age, married and a resident of

Koronadal, South Cotabato;

CESAR NACIONAL, Filipino, of legal age, married and a resident of

Koronadal, South Cotabato;

BENNY NACIONAL, Filipino, of legal age, married and a resident of

Koronadal, South Cotabato, and;

ANGELINO NACIONAL, Filipino, of legal age, married and a resident of

Koronadal, South Cotabato;

DECLARE AND MAKE MANIFEST

That we are the surviving heirs of the late SANTOS NACIONAL, who
died intestate on September 18, 1959 at _____________________________________
________________________________________, we being his legitimate wife and
children, respectively;

That at the time of his death, the said SANTOS NACIONAL, left real
property which is more particularly described as follows, to wit:

“A parcel of an agricultural land, Lot No. 705, (709),

Gss-119-D, situated in Barrio 5 (Mabini), Koronadal,
Cotabato, containing an area of ELEVEN (11)
Hectares, 67 ares, and 38 centares. Bounded on the
NE., by Road; on the SE., by Lot No. 710, Gss-119-D;
on the SW., by Lot Nos. 722, 723 and 724, Gss-119-D;
and on the NW., by Road, which parcel of land is
declared for taxation purposes under Tax Declaration
No. 9708 and covered by ORIGINAL CERTIFICATE
OF TITLE NO. V-6323.”

 That no personal properties are involved in this Extra-Judicial Settlement;

That to the best of our knowledge and information, the late SANTOS
NACIONAL left no debts;

That the parties hereto being all of legal age and with full civil capacity to
contract, hereby by these presents agree to divide and adjudicate, as they hereby
divide and adjudicate among themselves the above-described real estate in the
following manner:

That we, JUSTINA B. VDA. DE NACIONAL, LEO NACIONAL,

ELVIRA NACIONAL, JEREMIAS NACIONAL, CESAR NACIONAL, BENNY
NACIONAL and ANGELINO NACIONAL, hereby agree that Lot 705 (709), Gss
—119-D will be divided among ourselves EQUALLY.

NOW THEREFORE, in consideration of the foregoing premises and

invoking the provisions of Sec. 1, Rule 74 of the rules of court, we, JUSTINA B.
VDA. DE NACIONAL, LEO NACIONAL, ELVIRA NACIONAL, JEREMIAS
NACIONAL, CESAR NACIONAL, BENNY NACIONAL and ANGELINO
NACIONAL , adjudicate unto ourselves the above-mentioned real estate of the
late SANTOS NACIONAL subject however to the liabilities imposed by Section
4, Rule 74 of the Rules of Court in favor of other possible heirs, persons or
creditors who might have been deprived of their lawful participation over the
estate of the said decreased person for a period of two (2) years;

That, we, JUSTINA B. VDA. DE NACIONAL, LEO NACIONAL,

ELVIRA NACIONAL, JEREMIAS NACIONAL, CESAR NACIONAL, BENNY
NACIONAL and ANGELINO NACIONAL, for and in consideration of the of
the sum of TWO HUNDRED THOUSAND PESOS (P200,000.00), Philippine
Currency, receipt of which is hereby acknowledged in full and to our entire
satisfaction from CIRILO BIROG, Filipino, of legal age, married to Agripina
Ariola and a resident of Brgy. Mabini, Koronadal, South Cotabato, HEREBY
CEDE, TRANSFER AND CONVEY by way of sale of the above-described parcel
of land, in a manner which is absolute and irrevocable in favor of CIRILO
BIROG.

That we, Vendors, warrant the peaceful and lawful possession and use of
the above-described property as well as the valid title of the same and shall
defend the Vendee, CIRILO BIROG, from all claims arising from third parties
whomsoever.
