AFFIDAVIT OF NON-TENANCY [seller/transferee]and


AGGREGATE LANDHOLDING and NOTICE TO ADJOINING LANDOWNERS

I, ALEJANDRO MOJANA, Filipino, of legal age, married to Rosario Mojana and a resident of
Sicayab, Dipolog City, as represented by said ROSARIO MOJANA, per document of Special Power of
Attorney, notarized before the faith of Notary Public Gregory I. Yarra, and entered into his notarial
register as Doc. No. 40, Page No. 12, Book No. 13, Series of 2013, under oath, hereby deposeth and
sayeth:

That I am the absolute and lawful owner and possessor of a parcel of land described as follows:

“A parcel of land (Lot 2457-B-3 of the subdivision plan (LRC) Psd-199843,


being a portion of Lot 2457-B, described on Plan (LRC) PSD-140169, LRC Cad. Record
No. 756), situated in Sicayab, Dipolog City, containing an area of TWO THOUSAND
FIVE HUNDRED SEVENTY-NINE (2,579) square meters, more or less, and covered by
Transfer Certificate of Title No. T-6849.”

That the above-described parcel of land is neither tenanted nor covered by a contract of lease;

That the area covered by the sale herein-mentioned is within the area which I reserve under the
agrarian reform law as my five (5) hectare limit;

That I have the free and absolute disposal of the said property considering that the same is
covered within my retention area, and that I have sold, ceded, transferred and conveyed, all my rights,
shares and interests, a portion equivalent to FIVE HUNDRED (500) square meters of the above-
described parcel of land, (known as Lot 2457-B-3-E on the subdivision survey executed by Jonathan J.
Basong, Geodetic Engineer, on November 15, 2010), to FAITH D. BALANAY, Filipino, of legal age,
married to Brendo B. Balanay and a resident of Dipolog City, per document of Deed of Sale of
Absolute Sale of a Portion of a Real Property, dated March 26, 2014, notarized before the faith of Notary
Public Claver A. Pajaren and entered in his notarial register as Doc. No. 1937, Page No. 46, Book No.
LXVIII, Series of 2014;

That we have already notified the adjoining owners of the land of the disposition in favor of
FAITH D. BALANAY and they have not objected to it;

That I am executing this affidavit in good faith in order to attest to the facts above-mentioned, in
compliance with DAR Administrative Order No. 1, Series of 1989.
