SUPERSEDEAS BOND TO STAY

EXECUTION PENDENTE LITE

WHEREAS, the defendants in the above-entitled case has prayed for the issuance of a
Supersedeas Bond to Stay Execution Pendente Lite, pending final determination of the merits of
the case;

WHEREAS, the court rendered the decision hereunder-quoted:

“WHEREFORE, above premises considered, in finding the

allegation of plaintiff to be true, judgment is hereby rendered in
her favor as follows:

1. Defendants are ordered to vacate Lot No. 7159-J, the lot in

question presently occupied by them within thirty (30) days
reckoned from the time that this judgment should have become
final and executory;

2. Defendants are further ordered, jointly and severally, to pay

reasonable rental at 3,000 pesos per month reckoned from the
last demand (June 2, 2006), until they shall have vacated the
premises occupied by them;

3. Defendants are ordered jointly and severally to pay attorney’s

fees of 10,000 pesos and

4. To pay the cost of this suit.

SO ORDERED.

WHEREAS, the defendants are willing to put up a bond in the sum of FIFTEEN
THOUSAND (P15,000.00) PESOS, Philippine Currency, in real property, to answer for whatever
damages the plaintiff may suffer by virtue of the injunction of the Court should finally decide that
defendants were not entitled thereto;

WHEREFORE, in view of the premises, and by virtue of these presents, WE,

BALDOMERA G. PACARO, SPOUSES RODRIGO GANOB, SR. & BENEDICTA PACARO,
SPOUSES WILLIAM & ANITA PACARO, and SPOUSES ROGELYN & VILMA PACARO,
of legal age, married, and a resident of Lower Irasan, Roxas, Zamboanga del Norte, Philippines,
hereby constitute this SUPERSEDEAS BOND TO STAY EXECUTION PENDENTE LITE, in
favor of the said defendants, in the amount of FIFTEEN THOUSAND (P15,000.00) PESOS, in
real property, to answer whatever damages the plaintiffs may suffer by reason of the grant of the
injunction pendente lite, if it should finally be decided that defendants were not entitled thereto,
which supersedeas bond is deposited before the Clerk of Court, Municipal Trial Court, Ninth
Judicial Region, Roxas, Zamboanga del Norte.
