RULE I - MEMBERSHIP
Section 1: Composition - The Panlungsod na Pederasyon ng mga Sangguniang
Kabataan of Calbayog City, Samar shall be composed of the SK Chairperson of
barangays in the city.
8. Board of Director
a. Provide financial oversight for the Sanguniang Kabataan Federation
b. Assist in raising money to ensure the Sanguniang Kabataan Pederasyon
has adequate resources.
c. Assist in enhancing the Organization’s Public Standing, advocate for the
services of the Sanguniang Kabataan Pederasyon.
d. Provide an annual performance evaluation.
e. Perform such other functions and duties assigned by the President.
RULE III - RIGHTS, PRIVILEGES AND DUTIES OF
PEDERASYON MEMBERS
Section 1. Rights and Privileges - The members of the Pederasyon who are in
good standing shall have the following rights and privileges:
1. The right to participate in the Pederasyon activities;
2. The right to avail oneself of the services of the Pederasyon;
3. The right to vote, and if qualified for a position, to be voted upon;
4. The right to use the facilities, if available, of the Pederasyon; and
5. The right to avail such rights and privileges as may be prescribed by law,
this Joint Memorandum Circular, and their respective IRPs.
RULE IV – MEETINGS
Section 1: The Pederasyon Officers and members shall convene at least once in
every quarter, or as often as necessary, at the date, time, and place will be
announced ahead of the scheduled day.
Section 3: Motion to Adjourn vacates call - At any time after the roll call has
been completed, a motion to adjourn shall be in order, and if approved by a
majority of those present, all proceedings shall be vacated.
RULE VI - QUORUM
Section 1. Definition - A quorum is the number of members required to be able
to transact official business. To determine quorum, the following shall be
observed:
1. A majority of all the Officers of the Pederasyon shall constitute quorum to
transact official business and to validly act on every decision that the
Pederasyon shall make;
2. No business shall be transacted by the Pederasyon if there is no quorum;
3. No resolution shall be passed unless approved by a majority of the members
present;
4. Should a question of quorum be raised during meeting, the Pederasyon
President concerned shall immediately proceed to call the roll of the officers
and thereafter announce the results; and
5. The President of the Pederasyon, upon proper motion duly approved by the
officers present, shall declare the session or meeting adjourned for lack of
quorum.
3. In the absence of any of the designated chair or members of the BEC at any
level, his/her duly authorized representative shall sit in the Board, for and in
his/her behalf. The Authorization must be in writing.
3. The Board shall be the final arbiter in all election controversies within its
level. Its decision on the matter shall be final and executory.
4. The Chair and member of the BEC shall have one vote each. A majority vote
is required in all election controversies; and
6. Nominations for the vacant positions shall be filed to the BEC Chairman one
(1) day before the actual day of the Special Election.
7. The nominee shall be given the right to identify and select his/her preferred
registered name during the nominations process. Only one name shall be
registered by the candidate and only his/her registered name shall be written
in the ballot and be counted in his/her favor.
8. The name of each nominee shall be properly written on the specified board
from which the nominees, upon proper motion may correct the spelling of
his/her name together with his/her nickname.
9. Once the nomination has been accepted, the nominee shall no longer be
eligible to be nominated to other positions.
10. Each nominee shall allotted equal time to speak, which shall not exceed
five(5) minutes, before the Pederasyon Officers strictly on his qualifications,
platforms and programs only.
11. As soon as the last nominee for the last position shall have delivered
his/her speech, the Pederasyon Officers shall then proceed to cast their votes.
13. Casting of Votes – the concerned SK Pederasyon Officer shall cast their
votes in an orderly manner.
14. Each Pederasyon officer is entitled to one vote for each vacant position
through secret ballot.
16. Counting of Votes – As soon as all the Pederasyon officers have casted their
votes, the Election Committee shall officially declare the voting closed, then
proceed with the counting of votes.
17. Counting of votes must be done in public using tally sheets and boards,
and the like.
19. Voters shall be declared invalid in any ballot found to have been (a) unduly
marked and/or inscribed other than those properly made for the selections of
the filling-up of names of candidates, as the case may be; and (b) Mutilated or
defaced, rendering said ballot incomplete and not legible.
20. the Election Committee shall declare invalid vote in any of the position
based on the above.
21. The decision of the Committee on the invalidity of ballots shall be final.
22. The BEC shall not postpone or delay the counting except for extreme
necessity which should be approved by the majority of the BEC.
24.In the event that there is an unopposed candidate or ther is only one (1)
nominee/candidate for a position. He/she needs to have at least one (1) vote
sufficient to be declared him/her a winner.
27. Election results shall be certified and attested by the Election Committee
and shall be submitted to the DILG Provincial and Regional Office, through the
National Barangay Operations (NBOO), copy furnished the National Youth
Commission (NYC), for reference and records purposes.
28. Minutes of the Special Election shall be certified and attested by the BEC
and transmitted to the Sanguniang Secretary for safekeeping, reference and
records purposes.
29. Prohibited Acts - Within three (3) days prior to and three (3) days after the
conduct of the Special Election, it is considered unlawful for any elective and
appointive official, including the SK Pederasyon Officer, to engage in the
following activities:
For the purpose of this IRP, “to interefere” shall refer to any act,
through threat or intimidation or any offer of money or material
consideration which could directly or indirectly influence a Pederasyon
Officer to vote for or against a particular candidate, not to participate in
the Special Election or cause him to be disenfranchised, or would disturb
the said Special Election proceedings.
The foregoing nowithstanding, any elective and appointive official, including the
SK Pederasyon Officer who violates any provision of this IRP may be
administratively charged for abuse of authority before the concerned
Sangunian.
30. Election Protests – An Election protest contesting the results of the election
shall be filled by any concerned SK Pederasyon Officer, in accordance with the
following:
a. Election protests shall be filed with the BEC immediately after the
proclamation.
b. The protest shall be decided within three (3) working days after its filing.
c. Decision of the BEC shall be final and executory.
d. The officers of the SK Pederasyon, whose election is/are contested shall
assume the function of the office wo which he/they was/were elected. In
the event that the BEC decides in favor of the protestant, the incumbent
shall relinquish the position.
RULE IX – SK DUES
SECTION 1. All SK Chairpersons or members of the Pederasyon shall pay 1% of
their SK Fund for SK Dues annually which will be collected by the Pederasyon
Treasurer that will become the fund of the Pederasyon. Every first month of the
year will be the payment time of SK Dues.
SECTION 2. If the members of Pederasyon are not able to pay the SK Dues
from previous years, he/she must pay all of them.
RULE X – AMENDMENTS
These rules of procedure shall not be amended except upon approval of two-
thirds (⅔) votes of all the members of the Sangguniang barangay provided the
said amendments shall not be contrary to law, public order or public policy.
RULE XII – EFFECTIVITY
These rules shall take effect immediately upon approval and adoption.
