AFFIDAVIT

EXPLANATORY STATEMENT

1. This explanatory statement will remain a necessary supplement to Affiant’s foregoing

Notice of Status to the Secretary of the Treasury of the United States concerning Pre-
March 9, 1933, Private Citizen of the United States/Private American
National/Non-“U.S. Citizen”/Constitutionally-protected, California National Eric Jon:
Phelps, a Californian, as fully explained by the attached documents:

a. Certified Copy of the “Declaration of Status of Eric Jon: Phelps” on file with the
Prothonotary, Lebanon County Courthouse, Lebanon, Pennsylvania, which said
“Declaration of Status” includes in its Exhibit 7:
b. W-8BEN—“Certificate of Foreign Status of Beneficial Owner for United States
Tax Withholding (Individuals);”
c. Form 56—“Notice Concerning Fiduciary Relationship;” and
d. Forms 8822-B—“Change of Address or Responsible Party—Business” relating
“ERIC JON PHELPS,” a registered California organization, now a Private
Business Trust.

2. Regarding nationality, it is defined that a man is a national of the nation/country

where he was born:

NATIONS. Nations or states are independent bodies politic; societies of men united
together for the purpose of promoting their mutual safety and advantage by the joint
efforts of their combined strength. Bouvier 6 Ed. 1856

NATIONAL GOVERNMENT. The government of a whole nation as distinguished

from that of a local or territorial division of the nation, and also as distinguished from
that of a league or confederation.

“A national government is a government of the people of a single state or nation,

united as a community by what is termed the “social compact”, and possessing
complete and perfect supremacy over persons and things, so far as they can be made
the lawful objects of civil government. A federal government is distinguished from a
national government, by its being the government of a community of independent and
sovereign states, united by compact.”

“NATIONALITY. That quality or character which arises from the fact of a

person's belonging to a nation or state. Nationality determines the political status of the
individual, especially with reference to allegiance; while domicile determines his civil
status. Nationality arises either by birth or by naturalization. According to Savigny,
“nationality” is also used as opposed to “territoriality,” for the purpose of
distinguishing the case of a nation having no national territory.” Black’s 1 Ed. 1891

“NATIONALITY. The state of a person in relation to the nation in which he was

born. 2. A man retains his nationality of origin during his minority, but, as in the case
of his domicile of origin, he may change his nationality upon attaining full age; he
cannot, however, renounce his allegiance without permission of the government.”

3. California is a country/nation-state, see Exhibit 1. The United States

Government
acknowledges “nationalities,” that is, “natives of the states,” see Exhibit 2. As such,
having been born on California, I am a “national” of California, a “Californian.” In the
sections of Form W-8BEN regarding “nationality,” “Californian” or “California” must be
inserted. In the sections of Form 8822-B regarding “New Responsible Party,” I am that
new responsible party and agent of record, being a Pre-March 9, 1933, Private Citizen of
the United States/Private American National/Non-“U.S. citizen,” privately residing on the
land at Common Law within the geographic “United States” under military occupation
since March 9, 1933.

4. Regarding taxpayer “ERIC JON PHELPS,” so named on the enclosed double-

authenticated “Certificate of Live Birth” with its associated “Social Insurance Policy/
SSN,” its fiduciary has been changed to the Secretary of the Treasury of the United
States. Upon the execution of the enclosed Form W-8BEN and Form 56 evidencing the
intended Declaration of Trust having been created by Exhibit 7 within said “Declaration
of Status of Eric Jon Phelps” as a matter of public record, I am no longer a “fiduciary”
but am now the “grantor-settlor/sole beneficiary” of Private Business Trust “ERIC JON
PHELPS.” Pursuant to the attached Form 8822-B, I am the “new responsible party” for
California registered organization now Private Business Trust “ERIC JON PHELPS.”
Further, I am the Heir, Sole Beneficiary and Equitable title holder by nature to said
instruments and/or entities, including all trust property and accounts connected thereto. I
am the true owner of the Name and Estate of “ERIC JON PHELPS.”

I, Eric Jon: Phelps, declare all of the following:

1: I am a native born “national” of California, being a Californian and have never been
naturalized to become a citizen of any other jurisdiction;
2: The statements made on the enclosed forms are true and correct to the best of my
knowledge and experience;
3: I have not knowingly and willfully made false statements or included false documents
in support of this Notice.

With explicit Reservation of All Rights, Without Prejudice, Without Recourse, Non-
Assumpsit, without the United States (its lands presently under military government and
occupation since March 9, 1933);
