The Madras Medical Registration Act, 1914 was enacted to provide the
registration of medical practitioners in the Presidency of Madras. As per Sec 5(1) of
the Act, a Medical Council was established and functioning for thé State of Madras,
consisting of the members listed therein. The President and Vice President of the
Council shall be elected by the members of the Council from amongst themselves in
the prescribed manner. The member of the Council other than a nominated
president who is member ex-officio shall hold office for a term of five years from the
date of his election or nomination and shall be eligible for re-election or
Te-nomination. The council shall appoint a Registrar who shall act as Secretary to
the Council and who shall also act as Treasurer unless the Council shall appoint
another person as, Treasurer. In the rules, framed under the Act, the Registrar of the
Council also functions as the Returning Officer. The Registrar cum Returning Officer,
Tamil Nadu Medical Council in accordance with the rule 2 in regard to the Elections
to the Tamil Nadu Medical Council, Chennai under Clause({) of the sub-section(1) of
Section § of the Madras Medical Registration (Amendment) Act CVI of 1938 issued
notice for the conduct of election of seven members of the council in the month of
January / February 2023 and all Registered Medical Practitioners registered upto
30.6.2022 as published in the Gazette of Government of Tamil Nadu were declaredto vote. Notification had also been published in Tamil Nadu Government Gazette
dated 21.09.2022 to conduct the election for 7 members to the council to be held in
the month of January /February 2023.
2. In the reference third read above, the Advocate General of Tamil Nadu was
requested to offer his learned legal opinion
3. In the reference fourth read above, the Advocate General of Tamil Nadu,
High Court of Madras in his specific opinion among others has stated that the term of
the Tamil Nadu Medical Council is also coming to an end in February 2023.
Therefore, an ad hoc Committee shall be appointed at the earliest to continue the
‘Administration of the Tamil Nadu Medical Council and for revamping the enactment
and advised the authorities to act in this regard.
4. As of now the following seven members elected in the last casual election
of the council:-

5, Dr.T. Sadagopan
6. Dr.M.K. Ponnuraj
7. Dr.RV.Surendran
6. In the reference first and second read above, the Government have
nominated the following persons as members in Tamil Nadu Medical Council for a
term of five years from the date of their nomination in the existing vacancies:-

2. Dr.A.Murugananthan,
Ex.Emeritus Professor,

Respiratory Medicines,
Government Rajaji Hospital,
Madurai Medical College, Madurai.
6. The present team of office bearers of Tamil Nadu Medical Council came to
end by 16" February 2023. As the terms of the elected office bearers of the Tamil
Nadu Medical Council has already expired and, taking info account the learned
opinion of the Advocate General of Tamil Nadu, the Government after carefulconsideration has decided to constitute an Ad hoc Committee to continue the
-administration of Tamil Nadu Medical Council with the following composition:-
(i) Principal Secretary, Health and Family Welfare
(i) Thiru.S. George Alexander, Additional Secretary to Government,
Law Department.
(iii) Dr.G.Srinivas, Professor and Head of Department, Department of
Epidemiology, The Tamil Nadu D.MGR Medical University.
(iv) Three existing Government nominated members viz.,
1. Dr.S.Sivaram Kannan
2. Dr.AMurugananthan
3. Dr-R.Prabhakaran
7. The Government direct the Committee to send the report within one month.
