A RESOLUTION APPROVING THE INTERNAL RULES OF PROCEDURE OF THE


SANGGUNIANG KABATAAN MUNICIPAL FEDERATION (SKMF)- MUNICIPALITY OF
MIAGAO

RULE I
COMPOSITION
Section 1. The Sangguniang Kabataan Municipal Federation (SKMF)- Municipality of Miagao shall
be composed of elected Chairpersons from 119 barangays.

RULE II
POWERS, DUTIES AND FUNCTION
Section 1. The powers, duties, and functions of this Pederasyon shall be as provided for under Section
23 of Republic Act 10742 also known as the SK Reform Act of 2015, other pertinent laws, executive
orders, and implementing rules and regulations.

RULE III
RIGHTS AND DUTIES OF THE SKMF MEMBERS
Section 1. The rights and duties of the SKMF members shall be as follows:
a. The right to vote;
b. The right to be informed on any matter that pertains to the membership of the SKMF;
c. The right to access documents subject to existing rules and regulations on the release of public
documents;
d. Every member present in the session shall vote in every question raised unless he/she inhibits
himself/herself; and
e. Perform any other duties and fuctions mandated by the SKMF as provided by relevant and pertinent
laws, executive orders, rules and regulations.

RULE IV
THE DUTIES AND FUNCTIONS OF THE SKMF PRESIDENT AS PRESIDING OFFICER
Section 1. The President of the SKMF as the Presiding Officer shall have the following duties and
functions:
a. To call the session to order;
b. To recognize properly the member obtaining the floor or seeking recognition;
c. To make rulings particularly on points of order, parliamentary inquiry, requests and other
procedural matters;
d. To maintain order and decorum;
e. To put the pending question to vote and announce the result thereof;
f. To sign resolutions upon the approval of the majority of the members;
g. To exercise discretion to vote in case of a tie; and
h. To perform such other duties mandated by the President as maybe provided by these rules or the
SK Reform Law

Section 2. When the President is indisposed in the meantime or absent from a session where the
majority of all Members are already present, the Vice President shall preside the meeting. In case that

the Vice President is also absent, a Temporary Presiding Officer shall be elected by the majority of
such Members present.

RULE V
THE DUTIES AND FUNCTIONS OF THE SECRETARY AND THE ASSISTANT
SECRETARY
Section 1. The Secretary shall:
a. Record the proceedings of the SKMF in the form of a “journal” or “minutes”;
b. Call the roll of the members;
c. Lead in the preparation of the SKMF’s meeting agenda in coordination with the President;
d. Prepare and certify all required documents of the SKMF;
e. Act as a custodian of all the required documents of the SKMF; and
f. Perform such other duties mandated by the President as maybe provided by these rules, the SK
Reform Law and other relevant laws.

Section 2. The Assistant Secretary shall:


a. Stand in as the secretary in the event that the secretary is unable to fulfill their duties and
obligations;
b. Assist the secretary in their functions;
c. Perform such other duties mandated by the President as maybe provided by these rules, the
SK Reform Law and other relevant laws.

RULE VI
MEETING AND QUORUM
Section 1. The SKMF shall hold its meeting on a 4 th Sunday at 9:00 o’clock in the morning, once a
month, and on such date, time and place as may be agreed upon by two-thirds (2/3) of all Members.

Section 2. Special Meeting shall be called by the President or two-thirds (2/3) of the members when
the need arises.

Section 3. If any member is not present, the Presiding Officer shall call the session to order and
proceed to dispose of the other items on the agenda including the roll call. Members absent during the
roll call shall be marked either “O.B.” if they are on official business or “LATE” if they arrive 15
MINUTES after the roll has been called or “ABSENT” if they arrive 30 MINUTES after the roll call.

Section 4. A majority of the members of the SKMF shall constitute a quorum. Majority means having
fifty percent plus one of the total qualified members.

Section 5. Once there is a quorum, the Presiding Officer cannot suspend or adjourn a session without
the motion that is approved by a majority vote of the members present.

Section 6. If there is no quorum at the start of the Session, the Presiding Officer shall compel the
attendance of absent members. The Presiding Officer may suspend the session until the quorum is
reached.

Section 7. Prescribed polo uniform by the SKMF must be used during official meetings. No wearing
of ripped jeans, shorts, and slippers.

RULE VII
ORDER OF BUSINESS
Section 1. The Order of Business for each session shall follow the sequence hereunder:
a. Call to Order
b. Prayer
c. Roll Call
d. Reading and Consideration of the Minutes of the Previous Meeting
e. Calendar of Business
i. Business for the Day
ii. Unfinished Business
iii. Unassigned Business/Other Matters
f. Announcements
g. Adjournment

Section 2. Matters that may be taken up during the meeting of the SKMF shall be only those items
listed in the agenda, excepted when the majority approved it to be tackled under the Unassigned
Business.

Section 3. The agenda for the meeting shall be included in the communication sent by the President
and/or Secretary not less than seven (7) days preceding the meeting. This provision shall not be
applicable for special meetings.

Section 4. Whenever mentioned in the Calendar of Business, the following shall mean:
a. Unfinished Business- refers to proposal or measures that have been left unacted upon, postponed or
left unfinished during the previous meeting;
b. Business of the Day- refers to the list of items that are ready for deliberation and approval;
c. Other Matters or Unassigned Business- refers to pending matters or measures including new ones
that arise out during the deliberation for appropriate action.

RULE VIII
GENERAL RULES ON PROPOSED RESOLUTIONS, MOTIONS, VOTING, AND OTHER
RELATED MATTERS

Section 1. Proposed resolutions and other related matters shall whenever practicable, be signed by the
proponent and shall be filed with the Secretary and likewise be marked in the order which they are
approved.

The SKMF may pass a resolution commending natural and juridical persons, institutions, and other
entities provided there is sufficient basis to merit its commendation and recognition.

Section 2. When an oral motion is presented, the Presiding Officer shall restate the same to the
SKMF. Comments and general debate on the motion shall be in order.

Section 3. A member may speak before the assembly only when the Presiding Officer has recognized
him/her.

Section 4. A member must address all remarks and questions to the Presiding Officer, and not to
fellow member. Even while the statement of member A is in response to the point raised by member
B, member A must still address his/her statement to the Presiding Officer.

Section 5. When a member has the floor and is speaking, no member may interrupt the speaker by
requesting to be recognized by the Presiding Officer except by a member raising a point of order.
He/she must wait for the speaker to end his/her speech and then request for recognition by the
Presiding Officer.

Section 6. All business must be introduced before the assembly by a motion of a member. A member
can make only one motion at a time. All motions must be approved by a simple majority vote. As a
rule, a motion must be seconded before the assembly can consider it.

Adoption of the Agenda and Schedule


Any member may vote to adopt the proposed agenda or schedule.

Approval of a Resolution
Any member may move for the approval of a resolution presented to the SKMF.

Suspension of Rules
A member may move to suspend the rules to be approved by the majority.

Section 7. Before any subject is opened to deliberation, there must be: 1) a motion; 2) a second to the
motion; and 3) a statement of the question by the presiding officer. The Presiding Officer shall
ascertain if there is an objection to the motion. If there is none, the motion shall be declared adopted
unanimously. If there is an objection, the issue shall be subjected to deliberation; with speakers in
favor and against taking the floor alternately as far as practicable.

Amendment
If a member wants to insert or strike out words or paragraphs or substitute whole paragraphs or
resolutions on documents being deliberated upon, s/he must rise and after being recognized, state a
motion for amendment. The member proposing for an amendment must not speak for more than one
(1) minute. The Presiding Officer shall ask the sponsor if s/he accepts the amendment or not. If s/he
doesn’t accept it, the amendment shall be put to vote.

Lay on the Table


If after the deliberation has started, a member does not wish to further consider the topic, s/he must
rise and after being recognized move to lay the topic on the table. The motion shall interrupt the
deliberation, If the motion is approved, the deliberation on the topic shall not be continued. The topic
can be reopened at any time upon a motion to take the question from the table.

Previous Question
If, after a prolonged deliberation on a topic, a member wants to end the deliberation and put the
question to a vote, s/he must rise and, after being recognized call for the previous question. The
presiding officer shall then ask the assembly if it agrees with the motion. If it is carried by a simple
majority vote, the deliberation shall stop, and the assembly shall decide the main issue or question.

Section 8. A question of privilege and a point of order shall take a precedence and shall be considered
over any other motion. The President/Presiding Officer shall recognize the member raising a point of
order or a question of privilege over any other member seeking the floor. The presiding officer shall
then decide or resolve the point of order or question of privilege.

Point of Order
When a member wants to point out a violation of the rules or a diversion from the order or business,
s/he must rise, and without waiting to be recognized, address the presiding officer and invoke a

question of privilege (or point of order). The presiding officer shall recognize the member raising a
point of order or question of privilege immediately.

Section 9. A motion for reconsideration of a vote can be made only after the rest of the agenda has
been taken up and closed. Only the members who voted for the measure can raise a motion for
reconsideration.

If a member wishes to make a motion for reconsideration, s/he shall move for the reconsideration of
the vote taken the topic.

If the motion is seconded and approved, the question shall again be considered.

If the motion for reconsideration is made at an improper time, i.e., before the rest of the agenda has
been taken up, any delegate may rise to a point of order and say that the motion violates the rule.

RULE IX
DISCIPLINARY ACTIONS
Section 1. The SKMF may sanction/punish its members for disorderly behavior, absences for three
(3) times, with the concurrence of the majority of the members constituting the quorum suspend or
expel members.

Section 2. The Presiding Officer may order his/her Sergeant-at-Arms to exclude any member from the
session due to above salient provisions.

Section 3. A sanction fee of 150 pesos shall be instituted to those members who are considered absent
in meetings, handled by the SKMF Federated Treasurer

Section 4. A sanction fee of 50 pesos shall be instituted to those members who are late (which is 15
minutes after the meeting has officially started) except when they have signified that they will be late
in the said meeting.

RULE X
SPONSORSHIP SPEECH
Section 1. The Presiding Officer shall announce that a speech in sponsorship of a resolution is now in
order. The sponsor of the measure must give an introductory speech laying out the main points of it.

Section 2. Once the floor is awarded to the speaker, a maximum of five (5) minutes speech shall be
given after.

RULE XI
PERIOD OF INTERPELLATION
Section 1. In the Period of Interpellation, there shall only be a maximum of twenty-five minutes for
the entire interpellation. The President shall recognize the interpellator who rises to speak.

Section 2. There shall be a two (2) minute response from the sponsor for each question of the
interpellator.

RULE XII
PERIOD OF AMENDMENTS
Section 1. Any member of the Pederasyon may move for amendment of any segment of the proposed
measure.

Section 2. In considering amendments containing several segments, each segment should be


considered one by one.

Section 3. When an amendment is rejected by the proponent of the original motion, the proponent of
the amendment may appeal to the body. The proponent of the original motion and the proponent of
the amendment may explain their positions, on appeal, subject to the two (2) minute rule.

Section 4. Any amendment may be withdrawn at any time before a vote is taken thereon.

RULE XIII
ADOPTION OF THE MEASURE
Section 1. After the amendments are acted upon and the period of amendment is closed, the members
shall vote on the adoption of the measure. No vote should be taken on the adoption of the segments.
Only one vote shall be taken finally on the adoption of the whole document.

Section 2. The sponsor may move for the adoption of a resolution after the sponsorship. Adoption
shall proceed unless there will be an objection.

Section 3. A resolution must receive a plurality in favor to be adopted.

RULE XIV
VOTES AND VOTING
Section 1. Voting shall be viva voce, raise of hand or by standing.

Section 2. A vote by viva voce is the regular method of voting on any question that does not
require more than a majority vote for its adoption. When the question has been put by the Presiding
Officer in a clear, precise and simple language, the votes shall be taken by voices of “Ayes” and
“Nays”.

Section 3. If the President/Presiding Officer, doubts the result of the voting by voice, to require a
more precise method of counting, voting should be by raise of hand or by standing.

Section 4. In voting, the affirmative votes shall be counted first, and then the negative votes.

Section 5. If there is any question as to the result, any member on his own upon motion of any
member with the concurrence of the majority shall proceed to the recounting of affirmative and the
negative votes.

Section 6. Results of voting shall be announced to the members of the SKMF immediately after
tabulation.

Section 7. A member who was not at the session hall when the voting took place may cast his/her
vote not later than the start of the counting provided the final result has not yet been announced.

Section 8. No member shall be permitted to vote on any measure after the Presiding Officer, has
announced the result of the voting.
RULE XV
AMENDMENTS
Section 1. Any provision of these Rules may be amended by a two-thirds vote of all members of the
Parliament.

RULE XV
REPEALING CLAUSE
Section 1. All existing rules contrary or inconsistent to the provisions hereof are considered amended,
repealed or modified accordingly.

RULE XVI
EFFECTIVITY
Section 1. These Rules shall take effect on January 28, 2024, on the date of their adoption.

RESOLVED FURTHER, to furnish copies of this Resolution to the DILG Municipal Local
Government Operations Office and the Local Youth Development Office of Miagao, Iloilo,
for their information and guidance.
