passed by court of District & Sessions Judge, West District, TIS HAZARI in
Appeal No. 89/2017.

Facts – Pet. & R1 married on 10.08.1976. R1 has filed an application u/s 23
DV Act which was dismissed and held against the Pet. directing him to pay
Rs. 5k per month
By vide order dated 08.05.2018 – The matter was referred to Mediation by
order dated 08.05.2018 but it was not settled.
Grounds – Poor financial condition due to heart problem.
R1 is not entitled as she has sufficient source of income.
Nothing on record to prove monthly income.

allowed whereby the interim maintenance was modified from Rs. 5k to 4k per

2017.On 24.12.2020 the Ld. MM passed an order to pay interim Rs. 30k to
Resp. Appeal field by Pet. on 03.02.2021.
Grounds – Total salry was Rs. 75k but after deductions Pet. receives Rs.
67.50K. Pet. is under obligation to secure saving for future marriage of
daughter from ex-wife.
Has liability of 2 sisters. Suppression of material fact by Resp.
Order – The Appeal filed by the Petitioner herein was partially allowed
whereby Ld. ASJ reduced the interim maintenance amount payable to the
Respondent (Wife) to Rs. 25k from Rs. 30k per month.

Facts – FIR No. 125/2009 u/s 279/304A/471 IPC.
Pet. was found driving a truck with forged DL and in rash & negligent manner
and pedestrian Yashpal (deceased.Pet. filed the Appeal on 03.10.2019 and the
same was dismissed on 22.09.2022. Pet. is in jail since 22.09.2022
The Ld. Trial Court vide order dated 25.7.2019 and order on sentence
dated 7.9.2019 has convicted and sentenced the petitioner
Grounds – No legal evidenc.Prosecution has miserably failed to prove the
ingredients of alleged section. No Eye witness.
Order - Ld. Trial Court has sentenced the Pet. herein to simple imprisonment
for 3 months u/s 279 IPC, simple imprisonment for 6 months u/s 304A/ 471
IPC and Pet. directed to pay Rs. 40 K to the wife of the deceased. Impugned
Judgment dated 25.07.2019 and order on sentence dated 07.09.2019 was
upheld.

accused was discharged from prosecution.

Facts: The accused / respondent defrauded the bank by


dishonestly diverting the loan money on the basis of
forged invoices.

there was no question of reconsideration of sanction for
prosecution.
