1 The Sub-Committee will be invited to consider and adopt its provisional agenda
(PPR 11/1). The following ad-hoc working and drafting groups are envisaged to be established
during the session:

Agenda item 3 Safety and pollution hazards of chemicals and preparation of


consequential amendments to the IBC Code

Technical Group on the Evaluation of
Safety and Pollution Hazards of Chemicals

4 The Sub-Committee will be invited to consider the report of the twenty-ninth session
of the Technical Group on the Evaluation of Safety and Pollution Hazards of Chemicals
(PPR 11/3) and take action as appropriate.

5 Since the ESPH Technical Group is not expected to be established during the
session, should any matters require further consideration they will be referred to ESPH 30
(due to meet from 14 to 18 October 2024). Accordingly, no new cleaning additives will be
evaluated at this session. However, any changes to trade names of products or cleaning
additives or name changes of manufacturers should be communicated by the relevant
reporting country to the Secretariat, electronically by email to esph@imo.org,
by 9 February 2024, to be noted in the Sub-Committee's report.

Agenda item 4 Amendments to MARPOL Annex II in order to improve the

6 MEPC 79 agreed to include in the Committee's post-biennial agenda an output on


"Amendments to MARPOL Annex II in order to improve the effectiveness of cargo tank
stripping, tank washing operations and prewash procedures for products with a high melting
point and/or high viscosity", assigning the PPR Sub-Committee as the associated organ, with
two sessions needed to complete the output and with the understanding that the comments
and concerns expressed at MEPC 79 (MEPC 79/15, paragraph 12.2) would be taken into
account by the Sub-Committee. PPR 10 agreed to include the output in the proposed
provisional agenda for PPR 11, which was subsequently approved by MEPC 80.

8 The Sub-Committee will be invited to recall that:

.1 MEPC 80 adopted resolution MEPC.378(80) on the 2023 Guidelines for the


control and management of ships' biofouling to minimize the transfer of
invasive aquatic species (2023 Biofouling Guidelines), as prepared by
PPR 10; and

.2 following a request by PPR 10, MEPC 80 agreed to change the title of


output 1.21 from "Review of the 2011 Guidelines for the control and
management of ships' biofouling to minimize the transfer of invasive aquatic
species (resolution MEPC.207(62))" to "Development of guidance on matters
relating to in-water cleaning" and set the target completion year of the
renamed output to 2025.

9 The Sub-Committee will consider the documents submitted to this session under this
agenda item. A drafting group is expected to be established to prepare draft terms of reference
for a correspondence group, with a view to finalization of this output at PPR 12.

10 The Sub-Committee will be invited to consider the report of the Correspondence


Group on Prevention of Air Pollution from Ships (PPR 11/6) and all other documents submitted
under this agenda item. A working group on prevention of air pollution from ships is expected
to be established to make progress on this output in accordance with the terms of reference
for the output endorsed by MEPC 77 (MEPC 77/16, paragraph 9.9; and PPR 8/13,
paragraph 5.23), including, inter alia, the finalization of the draft guidelines for reducing the
impact on the Arctic of Black Carbon emissions from international shipping and the draft
guidelines on recommendatory Black Carbon emission data collection, monitoring and
reporting.

11 The Sub-Committee will be invited to consider all documents submitted to this session
under this agenda item, together with documents it had forwarded to this session and
documents that had been forwarded by MEPC, with a view to making progress in accordance
with the scope of work for the output (PPR 7/22/Add.1, annex 11) and advising the Committee
as requested (MEPC 80/17, paragraph 5.12).

12 The Sub-Committee will be invited to note that:

.1 MEPC 79 had invited the Secretariat to consider providing a legal opinion as


appropriate to a future session of the Committee with regard to the legal
issues raised in document MEPC 79/5/3 (FOEI et al.), taking into account the
existing study on Implications of the United Nations Convention on the Law
of the Sea for the International Maritime Organization (LEG/MISC.8); and

.2 MEPC 80, in the context of discussions on document MEPC 80/5/5 and


MEPC 80/5/7, was informed that the Secretariat had been preparing a legal
opinion on the matter, which would be submitted to MEPC 81; and

.3 MEPC 80 agreed to refer documents MEPC 80/5/5, MEPC 80/5/6 and


MEPC 80/5/7 to PPR 11 to be considered in conjunction with documents
MEPC 78/9/3, MEPC 79/5/1, MEPC 79/5/4 and MEPC 79/INF.4, with a view
to advising the Committee accordingly.

13 The Sub-Committee will also be invited to note that:

.1 the legal advice on the use of exhaust gas cleaning systems as an alternative
compliance mechanism under MARPOL Annex VI and its relationship with
the legal framework established under the UN Convention on the Law of the
Sea has been submitted to MEPC 81 as document MEPC 81/9 (Secretariat);
and

.2 the Chair of MEPC and the Chair of the PPR Sub-Committee, taking into
account the upcoming discussions at PPR 11 in relation to part 3 (regulatory
matters) of the scope of work of this output, have agreed that prior
consideration of the above-mentioned legal advice may be given by PPR 11
in conjunction with the relevant documents submitted or forwarded to this
session.

14 Depending on the outcome of Sub-Committee's deliberation on the matters under this


agenda item, the working group on prevention of air pollution from ships, expected to be
established under agenda item 6, may be instructed to further consider matters referred to it
by the Sub-Committee.

Plastic pellets

20 With regard to the reduction the environmental risk associated with the maritime
transport of plastic pellets, the Sub-Committee will be invited consider all documents that relate
to the approach agreed by the Sub-Committee at its previous session. In particular, it is
envisaged that a working group on marine plastic litter from ships will be established to finalize
the draft circular on recommendations for the carriage of plastic pellets by sea in freight
containers (PPR 10/18/Add.1, annex 11), taking into account the relevant outcome of CCC 9.

21 The Sub-Committee will also be invited to consider the report of the Correspondence
Group on Pollution Response (PPR 11/13/5 and PPR 11/INF.16), which prepared draft
guidelines on clean-up of plastic pellets from ship-source spills. It is envisaged that the drafting
group on pollution response, expected to be established under agenda item 9, will be tasked
with finalizing the draft guidelines.

Reporting of fishing gear loss

22 With regard to fishing gear reporting, the Sub-Committee will consider the report of
the Correspondence Group, together with all other relevant documents submitted to this
session. The working group expected to be established under this agenda item may be tasked
with considering this matter further.

Proposed additional active measures to reduce fishing gear losses

23 In the context of proposals concerning fishing gear, the Sub-Committee will be invited
to consider document MEPC 80/8 (Norway), providing information on reasons for loss of
fishing gear and proposing additional active measures to reduce such losses and facilitate
discussions on developing new guidance for the management of fishing gear on board fishing
vessels. Document MEPC 80/8 was forwarded to PPR 11 by the Committee, with the
instruction that the proposals therein be further considered with a view to advising the
Committee on the best way forward. The working group expected to be established under this
agenda item may be tasked with considering this matter further.

Marking of fishing gear

24 In the absence of specific proposals on how to amend MARPOL Annex V to


incorporate requirements for marking of fishing gear, proposals in this regard could be invited
to PPR 12.

Agenda item 14 Unified interpretation of provisions of IMO


environment-related conventions

26 The Sub-Committee will be invited to review its biennial status report for
the 2024-2025 biennium, taking into account the progress made at the session, and prepare
the draft provisional agenda for PPR 12, in accordance with the Organization and method of
work of the Maritime Safety Committee and the Marine Environment Committee and their
subsidiary bodies (MSC-MEPC.1/Circ.5/Rev.5), for approval by MEPC 82.
