1. Xia is a businesswoman and a regular depositor of the P bank. She deposited a


postdated check with P bank in the amount of P101,000. The check was duly
entered in her bank record thereby making her balance in the amount of
P297,000 from her original deposit of P196,000. Allegedly, upon advice and
instruction of P bank that the P101,000 check was already cleared and backed
up by sufficient funds, Xia, on the same date, withdrew the sum of P240,000,
leaving a balance of P57,793. A day after, Xia deposited the amount the amount
of P50,000 making her existing balance in the amount of P107,793, because she
has issued several checks to her business partners.
However, her suppliers and business partners went back to him alleging that the
checks she issued bounced for insufficiency of funds. Thereafter, Xia, informed P
bank to take positive steps regarding the matter for she has adequate and
sufficient funds to pay the amount of the subjects checks. Nonetheless, P bank
did not bother nor offer any apology regarding the incident. Consequently, Xia
filed a complaint for damages against P bank.
Did P bank treat Xia’s account with the highest degree of care? Yes, or no then

Facts: Mr. S commissioned Ms. J, a talented artist, to create a custom painting


for his living room. They agreed on a specific theme, size, and delivery date. Ms.
J started the work promptly, investing time and materials into the project.
However, due to unforeseen circumstances, Mr. S decided to cancel the
commission before completion.

Did Mr. S have the right to cancel the commission, and if so, what are the legal
