Authorities and Officers related to Narcotics & Psychotropic

substances Act
According to the provisions of this Act, the Central Government shall take
all such measures necessary for the purpose of preventing abuse of
narcotic drugs and psychotropic substances.
The Central Government may take measures like coordination of actions by
various officers, State Governments and other authorities under this act or
under any other law connected with the enforcement of the provisions of
this Act.
Officers of Central Government
The Central Government shall appoint a Narcotics Commissioner and may
also appoint such other officers with such designations as it thinks fit for the
purposes of this Act.
The Narcotics Commissioner shall exercise all powers and perform all
functions relating to the superintendence of the cultivation of narcotic and
psychotropic substances and shall also exercise and perform such other
powers and functions either by himself or through officer’s inferior to him as
may be entrusted to him by the Central Government.
Constitution of the Narcotic and Psychotropic consultative
committee: -
 The committee is constituted by the Central Government.
 The committee should contain members not exceeding 20.
 The committee will contain a chairman and other such members as
possibly appointed by the Central Government.
 No member shall be appointed to the Committee unless he or she is
willing to serve on it.
 Casual vacancies in the Committee caused due to resignation or
otherwise of non-official members shall be filled from amongst
persons of eminence possessing expertise and background in the
field of drug abuse prevention; but shall, as far as possible, be
sponsored by the Ministries concerned of the Government of India.
 If the Chairman is, for any reason unable to act, the Committee shall
choose any other member to act as Chairman.
Features of the committee: -
 The committee is formed under the Narcotic and Psychotropic
substances act and prohibits the usage, production, cultivation,
possession or trafficking of any type of narcotic drugs and
psychotropic substances. This committee advices the Central
Government on the above matters relating to the administration of the
act.
Functions of the committee: -
Prohibition
To check that no person is involved in: -
 Cultivation of any coca plant or gathering of any portion of the coca
plant.
 Cultivation of opium or any cannabis plant.
 Production, possession, sell and purchase, transportation, usage and
consumption of any Narcotic and Psychotropic substances except for
medical or scientific purpose to the extent permitted by the concerned
authority.
Control and Regulation
The committee monitors the following activities and if found suspicious
informs the concerned authority: the State and Central Governments.
Operations controlled and regulated by the central government: -
(In central level: control and regulate in all the states)
• Cultivation, gathering, possession, sale and purchase, transport,
usage and consumption of coca plant, opium poppy and cannabis
plant.
• Production and manufacture of opium and poppy straw.
• Manufacture of manufactured drugs.
• Manufacture, possession, transport, sale and purchase, import and
export, usage and consumption of narcotic drugs and psychotropic
substances.
Operations controlled and regulated by the state government: -
(In state level: each state govt. monitors them for each state)
 Cultivation, gathering, possession, sale and purchase, transport,
usage and consumption of coca plant, opium poppy and cannabis
plant.
 Production and manufacture of opium and poppy straw.
 Manufacture of manufactured drugs and substances.
 Manufacture, possession, transport, sale and purchase, import and
export, usage and consumption of narcotic drugs and psychotropic
substances.
 Medicinal opium manufacturing.
