SYNOPSIS
Since ancient times, one of the primary duties of the state has been to
maintain law and order and ensure the administration of justice. This
responsibility has remained constant, even as the state transitioned from a
police state to a welfare state. Citizens contribute through their tax payments
to support the smooth functioning of all three branches of the state. Prolonged
pre-trial procedures and a backlog of cases leading to undue delays in
delivering justice can undermine the credibility and reliability of the judicial
system, which serves as the foundation of the legal framework. In order to
address the issue of case backlog in Indian courts and alleviate the hardships
faced by undertrial prisoners, the legislature introduced sections 265 A-265 L
to the Code of Criminal Procedure in 1973 through the Criminal Law
(Amendment) Act of 2005. This legislative amendment officially introduced the
concept of plea bargaining into the Indian legal system.
This Project report aims to cover and provide a comprehensive overview of plea
bargaining, its history, statutory provisions, highlighting its benefits and
drawbacks with landmark judgements.

GOALS
This internship will provide me with valuable insights into the
operational dynamics of an office, allowing me to gain a
comprehensive understanding of how a corporate law firm functions.
By immersing myself in the corporate world of law, I will enhance my
communication and teamwork skills, as well as deepen my
comprehension of the different kinds of law, as the firm has different
departments for each kind of law. The objective of this report is to
provide a comprehensive analysis of the practice of plea bargaining
within the criminal justice system. By conducting thorough research
and presenting factual information, this report aims to enhance the
reader's understanding of plea bargaining and its implications.
Furthermore, the report seeks to shed light on the ethical
considerations, legal implications, and potential reforms associated
with plea bargaining.

Consequently, this internship will significantly expand my knowledge

in all areas, especially corporate law.

PROPOSED METHODOLOGY
 RESEARCH
Research is a careful investigation or inquiry especially through
search for new facts in any branch of knowledge. The project is a
systematic presentation consisting of the enunciated problem,
formulated hypothesis, collected facts or data, analysed facts and
proposed conclusions in form of recommendations.
Throughout this project, I have extensively utilized a variety of
online resources, including reputable platforms such as
Manupatra, iPleaders, SCC Online, and Legal Services India.
These resources have been instrumental in gathering valuable
information and expanding my knowledge on the topic of plea
bargaining.
Additionally, I have actively engaged with associates within the
law firm, leveraging their expertise and insights to deepen my
understanding. Moreover, my project guide has played a crucial
role in providing guidance and clarification, further enhancing
my comprehension of the subject matter.
By combining these diverse sources of information and learning
from experienced professionals, I have been able to develop a
well-rounded perspective on plea bargaining.
