NOTIFICATION
FBISE EMPLOYEES (SERVICE) REGULATIONS, 2005

In exercise of the powers conferred by Section 17 of the Federal Board of Intermediate


and Secondary Education Act, 1975, the Federal Board of Intermediate and Secondary
Education, with the approval of the Federal Government, is pleased to make the
following regulations, namely:-

FEDERAL BOARD OF INTERMEDIATE AND SECONDARY EDUCATION


EMPLOYEES (SERVICE) REGULATIONS, 2005

CHAPTER-I

SHORT TITLE, COMMENCEMENT AND APPLICATION

1. Short Title and Commencement:-


(i) These regulations shall be called the Federal Board of Intermediate and
Secondary Education Employees (Service) Regulations, 2005.
(ii) They shall come into force at once.

2. Application:-

These regulations shall apply to all employees in the whole time employment of
the Board, other than:
(i) The Chairman and the Secretary,
(ii) The employees appointed on deputation or contract unless their terms of
appointment or contract make these Regulations applicable to them; and
(iii) The employees paid from contingencies.

CHAPTER-II

3. Definitions: (I) In these Regulations, unless there is anything repugnant in


the subject or context:-
(a) "Government" means the Federal Government of Pakistan.
(b) "Act" means the Federal Board of Intermediate and Secondary Education
Act-1975 as amended from time to time.
(c) "Controlling Authority" means the Ministry of Education.

(d) "Board" means the Federal Board of Intermediate and Secondary Education,
Islamabad.
(e) "Chairman" means the Chairman of the Federal Board of Intermediate and
Secondary Education, Islamabad.
(f) "Secretary" means the Secretary of the Federal Board of Intermediate and
Secondary Education, Islamabad.
(g) "Controller" means the Controller of Examinations, Federal Board of
Intermediate and Secondary Education, Islamabad.
(h) "Audit Officer" means an officer appointed by the Board for auditing the
bills to be paid from the funds of the Board.
(i) "Auditor" means the auditor appointed by the Government.
(j) "Bank" means a Bank dealing with the accounts of the Board.
(k) "Employee" means an employee in the whole time employment of the
Board.
(l) "Post" means the post specified in schedule to these Regulations.
(m) "Selection Board" means the Board constituted for the purpose of Selection
for initial recruitment or promotion to posts in BPS-19 and equivalent.
(n) "Departmental Selection Committee" means a Committee constituted to
make Selection for initial appointment to posts in BPS-16 to BPS-18.
(o) "Departmental Promotion Committee" means a Committee constituted for
promotion to posts in BPS-16 to BPS-18.
(p) "Selection Committee" means a Committee constituted for the purpose of
making selection for initial appointment or promotion to posts in BPS-15
and below.
(q) "Service" means the whole period of continuous service including the period
spent on leave.
(r) "Emoluments" means the amount of monthly pay and allowances granted by
the Board to any employee.

(II) All other words and expressions used but not defined shall have the same
meanings as in the rules applicable to civil servants of the Federal Government.

CHAPTER-III

Appointment, Promotion, Transfer, Probation, Confirmation and Seniority

Part-I

4. Appointing Authority specified in column (3) of the table below shall be


competent to make appointment to various posts in basic pay scales specified in column
(2) of that table:

5. Method of appointment, qualification etc:-
(1) Appointment to posts shall be made by any of the following methods in
general, keeping in view the number of posts, namely:-
(a) by promotion in accordance with Part-II of this Chapter.
(b) by initial appointment in accordance with Part-III of this Chapter.
(c) by transfer in accordance with Part-IV of this Chapter.

(2) The method of appointment, qualifications and experience and other


conditions for various posts shall be as laid down in Schedules II, III and IV to
these Regulations.

Part-II

PROMOTION

6. Appointments by promotion to various posts shall be made by the Competent


Authority as specified in Regulation 4 on the recommendations of the Selection
Board/Departmental Promotion Committee as specified in Schedule I to these
Regulations.

7. Eligibility for promotion:


(1) An employee possessing such minimum qualifications as may be prescribed
shall be eligible for consideration for promotion to a higher post, for the time
being, reserved under the rules for departmental promotion.
(2) A post referred to in sub-regulation (1) may either be a selection post or a
non-selection post to which promotions shall be made as may be prescribed:
(a) in case of a selection post, on the basis of selection on merit and
(b) in the case of a non-selection post, on the basis of seniority-cum-
fitness.

Explanation

Posts in BPS-19 or equivalent are selection posts and posts in BPS-18 and below
are non-selection posts.

8. Procedure of Promotion:
(1) Promotion to posts in BPS-19 shall be made by the appointing authority on
the recommendations of the Selection Board.
(2) Promotion to posts in BPS-2 to 18 shall be made by the appointing authority
on the recommendations of the respective Departmental Promotion Committee.
(3) The Selection Board or the Departmental Promotion Committee as the case
may be, shall consider the case of eligible employees in the order of their
seniority and either;
(a) recommend an employee for promotion, or

(b) recommend an employee for supersession on the ground of his for the
time being unfit for promotion, or
(c) defer consideration of promotion of an employee provided that this
step will be taken only if:
(i) the CR dossier is incomplete or another document or information
required by the Departmental Promotion Committee/Selection Board
for determining employee's fitness for promotion is not available, or
(ii) disciplinary or departmental proceedings are pending against the
employee whose promotion case comes up for consideration before the
Departmental Promotion Committee/Selection Board, or
(iii) the employee is on deputation abroad to a foreign government,
private organization or an international agency, or
(iv) the employee does not possess the required length of service, or
(v) the employee has not undergone the prescribed training or passed
the departmental examination for reasons beyond his control, or
(vi) the employee's seniority is subjudice provided that in the case of
deferment a vacancy shall be reserved for the employee or if it is
filled, it shall be subject to the condition that when the employee is
subsequently promoted without having been superseded, the
arrangement will be reversed and the junior most person reverted to
his lower post.

(4) If an employee is superseded he will not be considered for promotion again


unless he has earned PERs for two full years. If he is again superseded, he shall
lose eligibility for further consideration.

(5) An employee who is deferred will be considered for promotion as soon as


the reason for which he was deferred ceases to exist.

Part-III

APPOINTMENT

9. Appointment by initial recruitment to posts in BPS-17 to BPS-19 or equivalent


shall be made by appointing authority on the recommendations of Selection Board as
specified in Serial No.1 of Schedule-I to these Regulations. The Board shall, as far as
practicable, consider and recommend a panel of at least three names for each vacancy.
Initial recruitment to posts in BPS-16 or equivalent shall be made by the appointing
authority on the recommendations of the Departmental Selection Committee specified in
Serial No.2 of the said Schedule. Initial recruitment to posts in BPS-15 and below shall
be made by the appointing authority on the recommendations of the Selection Committee
specified in Serial No.3 of the said Schedule.

Citizen of Pakistan only eligible for appointment:

10. No person who is not a citizen of Pakistan shall be eligible for appointment to a
post in the Board.

Vacancies to be advertised:

11. All vacancies to be filled in by initial recruitment shall be advertised in prominent


newspapers.

12. Where an appointing authority does not accept the recommendations of the
Selection Board or Departmental Selection/Promotion Committee, it shall record reasons
therefor and, obtain orders of the next higher authority.

Conditions of initial recruitment:

13. A candidate for initial recruitment must possess the educational qualifications and
experience and must be within the age limit for the purpose as laid down in the Schedule-
IV to these regulations.

14. A candidate for recruitment must be in good mental/bodily health and free from
any physical defect likely to interfere in the discharge of his duties. A candidate, who
after such medical examination as prescribed is found not to satisfy these requirements,
shall not be appointed.

15. No person who is less than 18 years of age shall be appointed to a post by initial
recruitment.

16. Character and antecedents of a candidate other than the one who is already in the
service of the Board or holding a post in the Federal or Provincial Government, shall be
verified and the appointment shall be made only if, in the opinion of the appointing
authority, the character and antecedents are satisfactory.

17. No person shall be substantively appointed to a permanent post without a medical


certificate of health from an authority prescribed by the Board.

Part-IV

APPOINTMENT BY TRANSFER

18. Appointment by transfer shall be made on the recommendations of the


Departmental Selection/Promotion Committee as specified in Schedule-I to these rules.

19. Appointment by transfer shall be made from amongst the persons holding
appointment on regular basis in a post in the same basic pay scale or equivalent to or
identical with the post to be filled.

20. Only such persons as possess the qualifications and meet the conditions laid down
for the purpose of transfer to the post shall be considered by the Departmental
Selection/Promotion Committee for appointment by transfer.

Part-V

PROBATION

21. Persons appointed by initial recruitment, promotion or transfer shall be on


probation for a period of one year.

22. The period of probation may be extended for a period not exceeding one year as
may be specified at the time of appointment.

23. On successful completion of probation period the appointing authority may, by a


specific order, terminate the probation.

24. Unless specific orders are issued under regulation (23) on expiry of the first year
of probation period, the period of probation shall be deemed to have been extended for
one year under regulation (22).

25. Provided that, in the absence of an order under regulation (23), the period of
probation shall, on the expiry of the extended period under regulation (22), be deemed to
have successfully been completed.

26. Provided further that, in the case of initial recruitment to a post, an employee shall
not be deemed to have completed his period of probation satisfactorily until his character
and antecedents have been verified as satisfactory in the opinion of the appointing
authority.

Part-VI

CONFIRMATION

27. Confirmation of the employees of the Board shall be made in accordance with the
rules/instructions issued by the Federal Government from time to time.

Part-VII

SENIORITY

28. Seniority of the employees of the Board shall be determined in accordance with
the rules/instructions issued by the Federal Government from time to time.

Part-VIII

TERMINATION OF SERVICE

29. The service of an employee may be terminated without notice:


(1) (i) During the initial/extended period of probation:
* Provided that, where such employee is appointed by promotion on
probation or, as the case may be is transferred from one cadre or post
to another cadre or post, his/her services shall not be so terminated so
long as he/she holds a lien against his/her post in such cadre or post,
as the case may be;
(ii) On the expiry of initial or extended period of his/her employment; and
(iii) If the appointment is made on contract basis, terminable on the
appointment of the person on the recommendation of the Selection
Board/Committee, on the appointment of such person.

(2) Where, on the abolition of a post or reduction in the number of posts in a
cadre, the services of an employee are required to be terminated, the person
whose services are terminated shall ordinarily be the one who is the most junior in
such cadre.

(3) Notwithstanding the provisions of sub-regulation (1) but subject to the


provisions of sub-regulation (2) the services of an employee in temporary
employment or appointed on contract basis or daily wages shall be liable to
termination on fourteen days notice or pay in lieu thereof.

Part-IX

RESIGNATION

30. An employee wishing to terminate his appointment will submit his resignation in
writing. He will continue to be in the service of the Board until his resignation is formally
accepted by the appointing authority.

31. No resignation shall be deemed effective during the pendency of any disciplinary
proceedings against the resigning employee.

Part-X

RETIREMENT FROM SERVICE

32. An employee shall retire from service:


(i) On such date after he has completed 20 years of service qualifying for
pension or other retirement benefits as the Board may in the public interest direct;
(ii) Where no direction is given under sub-regulation (32)(i), on the completion
of 60th year of his age.
(iii) According to rules/policy decisions of Federal Government.

33. No order under sub-regulation (32)(i) shall be made in respect of an employee


unless the appointing authority has informed him in writing of the grounds on which it is
proposed to make the order and has given him an opportunity of showing cause against it.

Part-XI

RE-EMPLOYMENT/CONTRACT APPOINTMENT AFTER RETIREMENT

34. In the case of tenure posts, appointment to which is regulated by specific


provisions of a law, rule and policy instructions, contract appointments may be made in
the manner prescribed in the applicable law, rules and policy guidelines/directions issued
by the Federal Government.

35. For projects which have a limited life, appointments may be made on contract
basis by the prescribed appointing authority after open advertisement of the vacancies.
The advertisement should indicate prescribed academic and professional qualifications,
experience, age, provincial/regional quotas, etc., where applicable as per rules/
Government policy.

36. For posts other than those mentioned at regulations (34) and (35) above, contract
appointments should be made only subject to fulfilment and observance of the following
conditions:-
(a) Where the nature of a particular job/vacant position requires contract
appointment for a specific period, standing instructions should be issued by the
administrative Ministry/Division concerned, after consultation with the Chairman
of the Board of Governors, specifying such posts and the parameters governing
appointment on contract basis against such posts.
(b) Vacancies should be advertised in the leading national and regional
newspapers.
(c) Selection should be made through regularly constituted Selection Board/
Committees.

37. The Contract appointment, where justified, may be made for a period of two years
initially, on standard terms including termination clause of one month's notice or one
month's pay in lieu thereof. Extension may be made on two yearly basis.

Part-XII

EFFICIENCY AND DISCIPLINE

38. An employee shall be liable to disciplinary action and penalties in accordance


with the procedure prescribed in the Removal from Service (Special Powers) Ordinance,
2000.

Conduct of an employee:

39. For the purposes of conduct, the Government Servants (Conduct) Rules, 1964
shall apply mutatis mutandis to the employees of the Board.

Part-XIII

INCREMENT

40. The annual increment will accrue only on the 1st day of the month of December
following the completion of at least six months of service at the relevant stage in the scale
and will be allowed as a matter of course unless withheld under a specific order.

Part-XIV

PAY AND ALLOWANCES

41. National pay scales and allowances shall be admissible to the employees of the
Board as revised by Government from time to time. The House Rent Allowance @ 65%
and Medical Allowance @ 35% of the Basic pay shall, however, be admissible to the
employees as on 30-6-2005. The employees who entered in the service of the Board on or
after 1-7-2005 will be entitled to House Rent Allowance @ 65% and Medical Allowance
@ 35% of the minimum of their respective pay scales.

Part-XV

MISCELLANEOUS

42. In all matters not specifically provided for in these Regulations, the rules and
procedures applicable to Federal Civil Servants shall, as far as possible, apply to the
employees of the Board provided that no financial benefits shall thereby become
admissible automatically unless specifically sanctioned by the Federal Government
(Finance Division).
