Republic of the Philippines Province of Kalinga City of Tabuk OFFICE OF THE SANGGUNIANG PANLUNGSOD Ordinance No, 002 Series of 2020 AN ORDINANCE ENHANCING AND REGULATING THE SCHOLARSHIP PROGRAM OF ‘TABUK CITY AND ESTABLISHING THE EDUCATIONAL SCHOLARSHIP SUPPORT DIVISION UNDER THE CITY MAYOR'S OFFICE, Authored by: Councilor Eduardo A. DUYAN Explanatory Note WHEREAS, Article XIV, Section 1 of the Philippine Constitution provides that the state shall protect and promote the right of all citizens to quality education in all levels and shall take appropriate steps to make such education accessible to all; WHEREAS, Article II, Section 17 of the Philippine Constitution provides that the state shall tive priority to education, science and technology, arts culture, and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development; WHEREAS, Likewise, Section 458 (a) (5) (xi) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that the Sangguniang Panlungsod, as the legislative body of the city, shall establish a scholarship fund for the poor but deserving students in schools located within its jurisdiction or for students residing within the city; WHEREAS, the students referred to necessarily include College, Senior High and Technical Vocational students. The constitutional and legal mandate is equally addressed to Local Government Units, such as Tabuk City; WHEREAS, investing more in human resourees is imperative in order to free the city’s poor constituents from the cycle of poverty. Ensuring the completion of a college education of one (1) family member in each family in the city will not only improve the poor’s social and economic standing but will likewise boost the development of the city, maintaining a skilled and educated workforce being vital for economic growth. To realize this, there is a need to increase the fimnd allocation for the city’s scholarship program and to devise a system that will ensure greater number of grantees and participation thereto as well as maintain its sustainability; WHEREAS, in view of the foregoing, this Body establishes a Scholarship Program for the poor but deserving students for them to finish a higher degree of education; NOW THEREFORE: BE IT ORDAINEDby the Sangguniang Panlungsod of Tabuk City, Kalinga in session assembled, that: Section! TITLE. The title of this ordinance shall be “AN ORDINANCE ENHANCING AND REGULATING THE SCHOLARSHIP PROGRAM OF TABUK CITY AND ESTABLISHING THE EDUCATIONAL SCHOLARSHIP SUPPORT DIVISION UNDER THE CITY MAYOR'S OFFICE”. Oxinance No. 002 Series of 020 Page 02 Section 2. THE CITY'S POLICY. It is the City’s declared policy to protect and promote the right of its constituents to quality education at all levels. Recognizing education as a priority program, the City is thus establishing an access mechanism to tertiary education for its poor but deserving students thereby guaranteeing the completion of the College, Senior High and Technical Vocational education of at least one (1) family member in each family in the city and ensuring their productive and meaningful participation in the society. Section 3, DEFINITION OF TERMS. For purposes of this ordinance, the following terms shall mean’ a, Scholar or grantee ~ refers to a poor but deserving college or technical vocational student who qualified as beneficiary and given the financial assistance herein provided; b. Program ~ refers to the City of Tabuk Scholarship Program herein established for poor but deserving College, Senior High or Technical Vocational students, ¢. Office ~ refers to the Educational Scholarship Support Division herein created and mandated to administer and implement the Tabuk City Scholarship Program; d. Board ~ refers to the Scholarship Board herein created as a governing, policy- making, advisory and recommendatory body in the implementation of the ‘Tabuk City’s Scholarship Program; €. Poor ~ refers to an individual whose gross monthly income and that of his immediate family living with him or with whom he is living with do not exceed Php130,000.00 per Annum; £ Deserving — refers to a student who has a potential and willingness to pursue and finish a higher degree or education but is financially incapable Orphan — isa child or someone who has lost both parents due to death Section 4. QUALIFICATIONS: a. The applicant must be natural born Filipino citizen, of good moral character, and a resident of Tabuk City; b. The applicant must not have any grade lower than (75%) percent in all subjects during the preceding semester or school year at the time of application; ¢. The applicant must belong to a family whose gross family income does not exceed One Hundred Thirty Thousand Pesos (P130,000.00) per annum: 4d. The applicant, as well as his/her parents must be a registered voter of Tabuk City. Moreover, an orphan must be represented by his/her guardian who must be a registered voter of Tabuk City; €. The applicant must be enrolled in a CHED and DEP-ED accredited government or private institution (government tertiary institution, government and private tertiary and secondary institution) or TESDA accredited vocational school within the City of Tabuk; £ No two (2) or more members of the same family shall be allowed to enjoy the educational assistance at the same time, except orphans; g. The applicant must not be enjoying other scholarship award(s)/ educational grant(s), except those academic scholarship grants such as dean’s lister given by their respective schools; h. Priority consideration shall be given to students with difficult circumstances, e.g. orphans, students with disabilities, those who have single parents, and those who are victims of armed conflicts, victims of natural/manmade calamities Ordinance No. 002 Series of 2020 Page os SSeS must be supported by a Barangay Certification duly signed by the Punong Barangay concerned. Section 5. DOCUMENTARY REQUIREMENTS. The qualified applicants shall submit the requirements hereunder enumerated to the Office of the City Mayor through the City Scholarship Program Coordinator for approval ‘Two (2) copies of application letter addressed to the City Mayor; Bio Data with two (2) pieces ID pictures Photocopy of report card/grades; Photocopy of any valid ID; Photocopy of certification of livebirth; Certification from the Commission on Election that the applicant, as well as his/her parents are registered voter of Tabuk City, In addition, in case of an orphan, the applicant's guardian shall be registered voter of Tabuk City; 8. Certification from the office of the Barangay Captain stating that the applicant is a bonafide resident of the Barangay and belongs to an indigent family; h. Certification of good moral character from the School Principal, College Dean/President i. Certification of Drug Test (Negative Result) from any Accredited Clinic Section 6. COURSE AND EDUCATIONAL INSTITUTION. A qualified scholarship beneficiary shall have the option to enroll and take any course of his/her choice in any educational institution within Tabuk City, Kalinga, duly recognized by the Commission on Higher Education, Department of Education or in any Technical/Vocational School accredited by the Technical Education and Skills Development Authority (TESDA). Section 7. ENJOYMENT OF THE SCHOLARSHIP GRANT. For the continuous enjoyment of the scholarship grant, the grantees must have no grades lower than seventy-five (75%) or its equivalent in any of the academic courses and should not have dropped any subject within the covered semester. parece {In case of failing grade(s) because of hospitalization of the grantee, consideration shall be given provided that the medical certificate is presented subject for evaluation/recommendation of the scholarship board. In case of incomplete grade(s), the grantee is given a chance to complete his/her grades on the following semester Section &. AMOUNT OF GRANTS. Every grantee in college (degree, non-degree or senior high school) shall receive Five Thousand (5,000.00) pesos per semester to cover tuition and matriculation fees or subsistence allowance. Those that are enrolled in Technical Vocational courses shall receive Five Thousand Pesos (P5,000.00) for the whole course. Section 9. MODE OF FINANCIAL ASSISTANCE. The assistance to qualified scholars shall be directly paid to the concerned parents of the scholars/students thru ATM Account for those enrolled in public schools and directly to those enrolled in private schools. In case where there is ‘an excess from the amount paid to the school per scholar/grantee, such excess shall be reimbursed immediately directly to the concerned scholars. Section 10, CONDITIONS OF SCHOLARSHIP GRANT. Financial assistance to the grantees shall cover one (1) academic year. Scholars shall renew their applications for the availment of assistance every semester until they shall have completed their college degrees, Crdinanee No, 002 Series of 2020| Page Of vocational courses or senior high school in public or private schools subject to the following conditions: a. The grantee shall enroll immediately in the school year or semester following the approval of his/her application of scholarship assistance; b, The grantee shall carry the full academic year/semester load prescribed by the school for the particular year level or course. For a grantee who attended summer class(es), all the remaining subjects for the semester must be enrolled: c. The grantee may be allowed to change course or transfer to another school (Private or Public) provided (80%) of his/ her finished subjects are credited. In cases where the percentage is not met and/or should any problem arises regarding this matter, prior approval by the scholarship screening committee (SSC) is needed; d. A scholar shall be accommodated only once; however, students taking up vocational courses or ladderized courses can be accommodated when they will pursue degree courses; e. Every grantee should plant at least 15 (fifteen) seedlings per semester (mandatory) and donate blood to the CHO (optional). £ The grantee should participate in community services and activities of the City Scholars. Section 11. GROUNDS FOR TERMINATION: a, Failure to comply with the scholarship requirements, and policies of the office after due notice; b. Positive result of drug test; c. Academic deficiencies, 4. Forging or falsification of official grades or record; €. Abandonment of scholarship and/or non-communication with the scholarship program office for one semester despite the efforts exerted by the latter to communicate; and £ Conviction of an offense in the Revised Penal Code or Special Penal Law. Section 12. ADMINISTRATION a. There shall be an Educational Scholarship Support Division under the Office of the City Mayor as provided with section 16 of this ordinance; b, A memorandum of Agreement shall be executed as the legal instrument for the implementation of this program to be signed by the City Government of Tabuk represented by the City Mayor as the first party and the Bank, represented by their manager, as the case may be, as the second party as well as the School Heads concerned Section 13. SCHOLARSHIP BOARD. The City Mayor shall create a City Scholarship Board (SB) which is composed of the following: a. The Chairman of the Committee on Education of the Sangguniang Panlungsod as Chairman; b. The City Educational Scholarship Support Division Program Officer as Co- Chairman; ©. All the Members of the Committee on Education of the Sangguniang Pantungsod as Members; Oinance No. 002 Series of 2020, Page 05 ‘The Chairman of the Board shall serve as the Presiding Chairman and the Vice-Chairman of the Board shall automatically take over in the former's absence. Section 14. POWERS AND FUNCTIONS OF THE CITY SCHOLARSHIP BOARD. The Scholarship Board shall have the following powers and functions, to wit: a. With the approval of the City Mayor, issue rules and regulations necessary for the proper implementation of this ordinance: b. Supervise the screening and evaluation of applicants; ¢. Establish and develop such programs and activities that shall be required of the scholars and/or their parents to participate in to ensure the scholars’ active cooperation and full development as responsible members of the society; __ In collaboration with the Educational Support Scholarship Division under the City Mayor's Office, conduct review every three (3) years of the program’s performance in terms, among others, of total number of beneficiaries, their field of study, the grantees’ academic performance and their family income classification, ©. Given the prevailing condition in the fields of education, the nation’s interest and the global work demands, provide list of courses excluded from the coverage of this program; £ Reserve fund for courses of special interest to the City of Tabuk; and Exercise such other functions and duties as will promote and expand relevant educational opportunities for needy and deserving Tabukefto students. © Section 15. MEETINGS OF THE SCHOLARSHIP BOARD. For purposes of exercising the powers and functions given it and without prejudice to a special meeting that may be called, the Board shall hold a regular semestral meeting including one every May of any given year. Section 16. SCHOLARSHIP UNIT. There shall be created the City Educational Scholarship Support Division under the City Mayor's Office, It shall be headed by a Program Officer with a plantilla position herein equivalent to an LGU Division Chief. The City Mayor shall determine other position needed to provide for the qualifications and compensation of other employees therein subject to Civil Service rules and regulations. Its powers and functions shall be as follows: a. Serve as secretariat of the Scholarship Board; b. Administer and promote participation to the program; ©. Provide all public high schools information regarding the various Scholarship and Financial Assistance programs or grants available; d. Receive Scholarship applicants, screen and interview applicants subject for evaluation of the Scholarship Board; ©. Monitor performance of the scholars and keep track of them, especially after their availment of the benefits of the program; £ Submit a yearly Status Report of the program to the Board for the latter's consideration and submission to the Sangguniang Panlungsod and the City Mayor; Responsible in the conduct of meeting and orientation of scholarship grantees; In charge of all the correspondence of the office such as preparation of financial obligation of the office, maintain the record system of the office; =e Ontinance No. 062 Series of 2020 Page 05 a Coordinate with the City Social Welfare and Development Office as well as the Department of Social Welfare and Development and, with the guidance of the School Board, undertake necessary acts to ensure compliance with the prioritization provision embodied in Section 4 hereof: i, Conduct relevant training needed by the City Scholarship Grantees such as Personality Development, Leadership and Gender sensitivity; Responsible in proper counseling to grantees with difficulties; k. Responsible in the conduct of Information and Education Campaign of the scholarship program; 1. Responsible in tracking of all the graduates of the city scholarship office to assess the impact of the program; m. Responsible in the conduct of research on school scholarship-related programs of the LGUs, Section 17. INCENTIVES OF GRADUATING STUDENTS WITH HONORS: a. SUMMA CUM LAUDE 20,000.00 b. MAGNA CUM LAUDE P15,000.00 ¢. CUM LAUDE 10,000.00 Section 18. APPROPRIATION: The Minimum Amount of Twenty Million Pesos (P20,000,000,00) shall be included yearly in the City Annual Budget as Scholarship/Financial Assistance Program Fund. Section 19. SEPARABILITY CLAUSE. Should any portion or provisions of this ordinance be declared unconstitutional or invalid, the other parts or provisions thereof which are not affected thereby shall continue to be in full force and effect. Section 20. REPEALING CLAUSE. Any provisions, rules and regulations and/or parts thereof inconsistent with the provisions of this ordinance are hereby repealed and/or modified accordingly. Section 21. EFFECTIVITY CLAUSE. This Ordinance shall take effect immediately upon its approval and posting.
