2. Heard learned counsel for the petitioner and
learned counsel for the State.
3. The petitioner is apprehending arrest in connection
with Bhubaneswar Airport P.S. Case No. 270 of 2023
corresponding to C.T. Case No. 1026 of 2023 pending
in the court of learned J.M.F.C.(V), Bhubaneswar.
4. Learned State Counsel has produced the statement
of the victim recorded under Section 164 of Cr.P.C.. It
is submitted that the petitioner and the victim had a
consensual relationship and the FIR was lodged only
because the petitioner refused to marry her.
5. Learned counsel for the informant has opposed the
prayer for bail by submitting that after maintaining
relationship for about five years, the petitioner ditched
the victim without any justified reason and therefore,

no leniency should be shown to him.
6. Having regard to the nature of accusations, the
materials on record and the statement of the victim
recorded under Section 164 of Cr.P.C., while not being
inclined to grant anticipatory bail to the petitioner, the
ABLAPL is disposed of granting liberty to the petitioner
to surrender before the court below within a week from
the date of receipt of certified copy of this order and to
move for bail. In such event, he shall be released on
bail on such terms and condition as the court below
may deem fit and proper to impose.
7. The ABLAPL is disposed of.
8. Urgent certified copy of this order be granted on
proper application.
