02. 1. Heard the learned counsel for the Petitioners and the State.

2. By means of this application, the Petitioners seek grant of bail


under Section 438, Cr.P.C. in anticipation of arrest for their
alleged involvement in the offence under Sections 498-
A/294/323/506/354-B/34 of IPC read with Section 4 of DP Act in
connection with Chhatrapur PS Case No.251 of 2023
corresponding to GR Case No.430 of 2023 pending before the
learned SDJM, Chhatrapur.

3. It is alleged that the in-law member of the Informant tortured


the Informant for demanding dowry physically and mentally. The
accused person threatened the Informant not to tell her husband
whether she would tell, they would kill her. After knowing the
same, the husband of the Informant left the Informant in her
parent’s home and left for his service place at Chhatisgarh.

4. The allegation appearing in the FIR against the Petitioners are


not only inhumane but also becoming a unhealthy family.
Admittedly the husband of the Informant met an untimely death in
the state of Chhatisgarh. Neither the family of the husband did not
inform the death to the Informant nor the Informant had any scope
to know the same. With the curiosity, the Informant proceeded to
Chhatisgarh to ascertain the cause of the death of her husband.

5. Keeping in view the nature of allegations as emerged from the


materials on record, the circumstances appearing, the seriousness
and gravity of the offences, this court is not inclined to grant
anticipatory bail. Accordingly the prayer for bail stands rejected
and the ABLAPL is dismissed.
