The City of Grants Pass, Oregon, is requesting quotes to furnish a fully
assembled package surface water treatment plant (treatment plant).
Treatment plant is to be in compliance with attached specification section
11206.
Quotes are to be submitted on attached cost proposal form. Quotes are to
be submitted in a sealed envelope clearly labeled:

PART | GENERAL
LL Scope
A. The supplier shall furnish a mobile package surface water treatment plant
capable of treating surface water to produce potable water at a minimum rate of
21 gpm and capable of flows up to 40 gallons per minute. Package surface water
‘treatment plant shall be housed within a mobile cargo trailer. ‘The mobile
package surface water treatment plant shall be furnished and delivered to the site
asa fully functioning unit.
B. The package surface water treatment plant shall include, but shall not be limited
to: an enclosed cargo trailer, a multi-stage filtration system, disinfectant
injection, raw and finished water pumps, a generator, piping and hoses, isolation
valves, a pressure relief valve, instrumentation, water quality monitoring devices,
finished water storage pillow tanks, a discharge manifold, and all necessary
appurtenances to connect the equipment together and to securely attach both the
equipment permanently housed within the trailer and the equipment transported
within the trailer but located outside the trailer during normal operation.
C. All equipment specified in this Section shall be furnished by the package surface
‘water treatment plant Supplier.
D. This section specifies the material and equipment deemed most suitable for the
service anticipated. Suppliers shall prepare their bids on the basis of the
equipment and materials specified. Afier execution of the contract,
substitution of manufacturers or models for those named in the contract shall
be considered, but only if the equipment proposed for substitution meets the
specifications stated herein and is equal to, or superior in, construction,
materials and performance to that named in the contract. Alternative
equipment offered for substitution shall have a documented record of
satisfactory service for use in surface water treatment applications.
Alternative equipment shall have been produced and used in water treatment
applications for a minimum of 10 years.
1.2 Definition of Terms and Responsibility
A. SUPPLIER: A manufacturer who supplies the factory assembled mobile
package surface water treatment plant system. ‘The surface water treatment

required to securely attach the equipment within the mobile trailer.
SUPPLIER shall deliver the package surface water treatment plant t0
OWNER’s Water Treatment Plant located at $21 SE M Street, Grants Pass,
OR.
SUPPLIER shall provide training services to the OWNER’s personnel and
participate in testing and start-up with the OWNER.
1.3 Experience Requirements

‘The package surface water treatment plant shall be the product of the
SUPPLIER. SUPPLIER shall:
1. Have the financial resources, technical qualifications, experience,
organization and facilities adequate to design and manufacture the
package water treatment plant.
2. Be engaged regularly in the fabrication of package systems for pumping
and/or treatment of water for potable use or for remediation of
contaminated waters,
3. Have successfully fabricated, tested and commissioned at least three (3)
package water treatment plants for public works applications similar in
size and scope to the installation specified herein during the last five (5)
years.

Prospective SUPLIERs not listed above may submit bids, but must include with

experience requirements by completing the Supplier Experience Form will be
grounds for rejection of bid.

Products that contact the water being treated shall conform to applicable
AWWA standards and be certified to meet ANSI/NSF 61 for drinking water
systems components

SUPPLIER shall submit information electronically in PDF format and also in
hard copy format. PDF documents will be submitted by email, ftp site or on a
CD or other storage device accompanying the hardcopies. At least five (5)
hardcopies of all submittals shall be provided to the OWNER. Three (3)
copies of all submittals will be kept by the OWNER. If the SUPPLIER
requests that more than two (2) copies be returned, then the SUPPLIER shall
submit the appropriate quantity of submittals.
Within thirty (30) days after award of the contract, the SUPPLIER shall
submit to the OWNER for review a Technical Submittal including shop
drawings, electrical diagrams and catalog information for the equipment and
instruments required for fabrication of the package plant, Submitted data shall
be sufficient in detail for determination of compliance with the Contract
Document
‘The OWNER will review the Technical Submittal to determine compliance
with the design concept of the project and return them to the SUPPLIER
within twenty-one (21) days, ‘The OWNER will make notations thereon
indicating "No Exception Taken", "Make Corrections Noted’, "Rejected",
"Revise and Resubmit’, or "Submit Specified Item", The OWNER will then
return copies of the submitted data and shop drawings to the SUPPLIER.
The OWNER’s review of submittals and shop drawings is not a check of any
dimension or quantity, and will not relieve the SUPPLIER from responsibility
for errors of any sort in the submittals and shop drawings. Regardless of
corrections made in or review given to the drawings by the OWNER, the
CONTRACTOR shall be responsible for the accuracy of such drawings and
for their conformity to the drawings and specifications.
‘The OWNER may hold shop drawings in cases where partial submission
cannot be reviewed until the complete submission has been received or where
shop drawings cannot be reviewed until correlated items affected by them

have been received. When such shop drawings are held, the OWNER will
advise the SUPPLIER in writing that the shop drawing submitted will not be
reviewed until shop drawings for all related items have been received.
When shop drawings and/or submittals are required to be revised or corrected
and resubmitted, the CONTRACTOR shall make such revisions and/or
corrections and resubmit those items or other materials in the same manner as
specified above,
The Technical Submittal shall, as a minimum, include the following data,
drawings and other descriptive materials necessary to describe and show the
package surface water treatment plant construction and materials:
1, Flow Schematic indicating all equipment, valves, instrumentation, pipe
sizes and connections.
2. Manufacturer's product data for all water treatment equipment
specified in this section, including model, dimensions, weights,
materials of construction, capacity and head Joss characteristics.
3. Fabrication drawings showing the equipment layout in the trailer,
including sizes and material type for filter housings, pipes and hoses.
4, Details for the methods proposed for securely anchoring and supporting
all equipment within the trailer to ensure the entire system remains in
good working order when transported on state highways or rural gravel
roads at posted speed limits.
5. Pump performance curves showing the head, capacity, NSPH, and
brake horsepower required when operating at specified conditions.
6 Complete motor nameplate data.
7. List of recommended spare parts.
8. List of any special tools required.
Certifications
1. Certification from SUPPLIER that the surface water treatment plant is,
fully in conformance with the requirements described and depicted in
these Contract documents.
Certification from the Oregon Health Authority, or other agency with
authority to regulate drinking water within another State, that the final

11206- 4filtration stage provides for a minimum of 2-log removal of
Cryptosporidium and Giardia when tested in accordance with
challenge testing requirements of the Long Term 2 Enhanced Surface
Water Treatment Rule. If the performance of the final stage filters
during challenge testing was dependent upon specific equipment for
prior filtration stages, then all the equipment used in the challenge
testing shall be included in the package treatment system.
it Calculations for Anchors and Restraint: After the complete Technical Submittal
has been reviewed and retumed with neither “Rejected” nor “Revise and
Resubmit” notations, SUPPLIER shall furnish calculations demonstrating
compliance with Design Requirements for Anchors and Restraints as detailed
under Quality Assurance.
J. Operation and maintenance manual. Prior to delivery of the package surface
water treatment plant, SUPLIER shall submit a draft Operation and
Maintenance manual for review and comment by OWNER. O&M manual
shall include at a minimum information for the following items:

the design and manufacture of water treatment equipment specified
herein,
‘The SUPPLIER shall coordinate design such that all equipment is
compatible and capable of achieving the performance requirements
specified herein.
Design Requirements: All necessary calculations and drawings for any related
design shall be submitted to the OWNER for approval prior to beginning the
work,
Design Requirements for Anchors and Restraints
‘The SUPPLIER shall design, furnish and install anchors and restraints
for the equipment to produce a complete package.
Restraints shall include lateral restraint on all tanks and floor mounted
filter housings to protect the package treatment plant from damage due
to vibration during transportation and from a seismic event.
Calculations demonstrating compliance with this requirement shall be
submitted after successful review of the Technical Submittal.
Calculations shall substantiate the design of the sizes, thicknesses, and
types of seismic-restraint connections, gravity support connections,
fabrication, and attachment to the walls and floor of the trailer.
Calculations shall clearly indicate the loads imposed on the trailer
structure, including magnitude, direction and location and compare
these loads to the strength of the trailer component to which the load is
transferred.
Design restraints to meet the requirements of ASCE 7-10 based on the
actual component operating weight including the assumption that the
component is full of water during the event.
Calculate vertical seismic force by the following equation:

The design force shall be applied vertically at the center of gravity of
the component or distributed according to the mass distribution of the
component or system. The vertical seismic force shall be combined
with the horizontal seismic force as well as the Dead Load gravity force
to determine the maximum force for component or anchorage design.

State of Oregon.
17 Warranty

PART 2
‘The SUPPLIER shall warranty the package treatment plant to be of quality
construction, free from defects in material and factory workmanship. The
equipment, pumps, motors, tanks, filters, and appurtenances shall be warranted
for a period of two (2) year, excepting only those items normally consumed in
service, such as light bulbs, oil, grease, gaskets, O-rings or filter elements.
‘The SUPPLIER shall be solely responsible for the surface water treatment
plant and all related components
Major components which fail to perform as specified or prove defective in
service during the warranty period shall be replaced, repaired, or satisfactorily
modified by the SUPPLIER without cost of parts or labor to the OWNER.
After start-up service has been performed, labor to replace accessory items
such as light bulbs, or other accessible and easily serviced parts, shall be the
responsibility of the OWNER.
PRODUCTS
2.1 General

‘The surface water treatment plant shall include a cargo trailer, diesel generator,
diesel driven raw water pumps, electrically driven finished water pumps,
filters, valves, piping, water quality instruments and other equipment specified
in this Section,
‘The package surface water treatment plant shall be delivered to the OWNER
requiring no additional fabrication or similar work.
All piping and valves shall be designed for a minimum working pressure of 150
psi. All strainers, filter housings, and instruments directly exposed to system
pressure shall be designed for a minimum pressure that exceeds the shutoff head
for the raw water pumps.
‘All materials and coatings coming in contact with potable water shall be
ANSIINSF Standard 61 approved. Any item in contact with potable water for
which there are no ANSI/NSF 61 listed make and model, will be reviewed and
approved for use in the system on a case by case basis. SUPPLIER shall submit
documentation demonstrating that there is no ANSI/NSF 61 listed make and
model for any items that are not compliant. SUPPLIER shall provide adequate

standard indicating that use of the product for contact with potable is safe
In the event the SUPPLIER obtains approval for equipment other than that
which is specified herein, SUPPLIER shall, at his own expense, make any
changes necessary to accommodate the alternative equipment.
2.2 Cargo Trailer

Provide a fully enclosed dual axle trailer with a minimum interior width of 7-6"
and a minimum interior height of 6'-6”. Trailer length shall be sufficient to
house all specified equipment and include space for future addition of granular
activated carbon filters, as shown on the process flow diagram, Maximum
overall trailer length shall be 287-6”,
Trailer exterior shall be prefinished aluminum, minimum .040-inch thick.
Walls and ceiling shall be insulated,
Trailer shall have 3/8-inch marine grade plywood interior walls with either vinyl
siding or painted with a water resistant coating, Trailer shall have %-inch marine
grade plywood interior decking with a protective, non-skid coating.
‘Trailer shall have 15-inch radial tires mounted on torsion trailer axles for
additional trailer rigidity,
Trailer shall have @ lockable side door, minimum 30-inch width, with folding
step and a 92 inch wide rear lockable ramp door with spring assist and stabilizer
jacks.
Trailer shall include a passive roof vent.
Interior of trailer shall include tie downs to hold in place during transport all
equipment that will be transported within the trailer but installed outside the
trailer during normal operation, including: the generator, raw and finished water
Pumps, pillow tanks, hoses and distribution header.
Trailer shall meet all Department of Transportation requirements for use on
Federal, State, County, and City roadways.
Maximum load rating for the trailer shall exceed the weight of all the equipment
to be permanently installed within the trailer, including the weight of water when
all filter housings and pipes are completely filled with water, plus the weight of
all equipment that shall be transported in the trailer but installed outside the
trailer during operation,

Electrical System
Trailer shall have a 120/240-volt single phase electrical panel sized to
power all equipment requiring electric power. Panel shall be capable of
being supplied from the standby generator or from utility power via a
120/240 VAC 2-pole 3-wire IP67 watertight connection located on the
exterior of the trailer.
Provide a minimum of one spare 15 amp duplex ground fault circuit
interrupt (GFCI) outlet near middle of trailer in a location readily
accessible at least 30-inches above finished floor
‘Trailer shall include interior fluorescent lighting with three-way switches
located inside the trailer near the side man door and the rear door.
A duplex GFCI outlet with circuit breaker rating and voltage sized to
power one finished water pump shall be provided at the rear of the trailer
‘with adequate lengths of an extension cord sized to power the pump up to
30 feet from the trailer.
GFCI Outlets shall be provided at the sodium hypochlorite injection
system, the turbidity meter, the flow meter, and the chlorine analyzer to
power each device.
‘Trailer shall have exterior halogen lights, one located near the side man
door and one near the rear door of the trailer, both controlled by three-
way switches located inside the trailer near the man door and the rear
door.

Provide a portable, diesel fuel generator to power the entire package water
treatment plant trailer.
Size generator to accommodate simultaneous operation of interior and exterior
lights, turbidimeter, chlorine analyzer, flow meter and the starting current of one
finished water pump.
Generator shall have at a minimum of two (2) 120 VAC 20 Amp GFCI duplex
outlets, and one (1) 240 VAC Twist-Lock outlet to power the trailer panel,

11206- 9D. Generator shall be mounted within a heavy-duty frame that shall include a
minimum of two wheels for mobility.
E. Generator shall have electric start and shall include a glow plug for cold weather
starting.
Generator shall have automatic low-oil shutdown, a voltage meter, a runtime
meter, and a steel fuel tank that provides a minimum of 10 hours operation at full
load, 14 hours operation at 50 percent load.
G. Generator shall be Voltmaster XDR Series, or approved equal.
H. Provide a 25-ft power cord to connect the 240 VAC Twist-Lock outlet on the
generator to the 120/240 VAC 2-pole 3-wire IP67 watertight connection located
‘on the exterior of the trailer that feeds the distribution panel inside the trailer.
24 Pumps
A. General Requirements: ‘The package surface water treatment plant shall include
four (4) centrifugal pumps: two (2) for raw water and two (2) for finished water.
Pumps must have continuously rising performance curves to shut-off and be
designed for continuous running duty. The SUPPLIER shall calculate the
required total dynamic head (TDH) based on approved trailer and system layout.
B. Raw Water Pumps, Self Priming
1. Design Requirements
Point A on Pump Curve 40 gpm at TDH required, based on
treatment equipment proposed.

Pump Construction
a. The raw water pumps shall be end suction, horizontal, cast
aluminum, centrifugal pumps. The pumps shall be capable of
self-priming up to a vertical height of 25 feet. The complete pump
unit shall be supported by the power frame. Pump casings shall be
capable of withstanding a hydrostatic test pressure of 150% of
maximum discharge pressure. Suction and discharge connections
shall be NPT with female cam and groove type adapters.

July 2015 11206- 10b. Impeller: Pump impellers shall be enclosed for optimum
hydraulic efficiency. ‘The impellers shall be constructed of,
aluminum, fully machined on all exterior surfaces, and statically
balanced at time of pump assembly. The impellers shall be keyed
to the shafis and securely fastened.
c. Diesel Motors: Motor shall be air cooled single-cylinder, 4-stroke
diesel engine. Diesel fuel tank shall be sized to provide a minimum
of 2.7 hours of run time.
4. Heavy Duty Roll Frame: A rigid, channel type carbon steel roll
frame shall be provided which maintains support and alignment
of the complete pump and drive motor assembly. The unit shall
include a wheel kit for ease of moving entire unit.
3. Provide a male cam and grove style quick connection fitting on the
discharge of the pumps, compatible with the raw water discharge hoses.
Provide a female cam and grove style quick connection fitting on the
suction of the pumps, compatible with the raw water suction hoses.
4. Pump Manufacturer and model: Pumps shall be Gorman-Rupp IPT,
series 2P5X, or approved equal
C. Finished Water Pumps
1. Design Requirements
Duty Point 40 gpm at 50 Feet TDH.

2. Pump Construction
a. The end suction pumps shall be horizontal, close coupled, cast
iron, bronze fitted, end suction centrifugal pumps. The complete
pump unit shall be supported by the power frame. Pump casings
shall be constructed of fine grain ASTM A48 Class 20 cast iron
capable of withstanding a hydrostatic test pressure of 150% of
‘maximum discharge pressure. The casings shall be provided with
replaceable hubs and suction wear rings constructed of bronze.

b. Pump Shafts: Shafts shall be fitted with a stainless steel shaft
sleeve and carbon/ceramic mechanical seal.
c. Impeller: Pump impellers shall be enclosed for optimum hydraulic
efficiency. The impellers shall be constructed of bronze, fully
‘machined on all exterior surfaces, and statically balanced at time
of pump assembly. ‘The impellers shall be keyed to the shafts and
securely fastened with vibration resistant lockscrews.
Electric Motors: Motors shall be standard close coupled, totally
‘enclosed fan cooled. Motors shall be of NEMA standard design
‘T-frame suitable for horizontal mounting, with normal starting
torque and low starting current, rated for continuous duty, with a
1.15 service factor, Motors shall be suitable for 115 volts, 60
Hertz, | phase power. Motors shall be designed to accept the
total, unbalanced thrusts imposed by the pump.
e. Motors and pumps shall be supported by means of a foot mounted
ASTM A48 Class 20 cast iron power frame. Ample access shall
be provided for ease of adjustment or replacement of mechanical
seals.
f _ Bedplate: A rigid, channel type carbon steel bedplate shalll be
provided which maintains support and alignment of the
‘complete pump and drive motor assembly. The unit shall be
suitable for anchor bolt floor mounting.
3. Provide a female cam and grove style quick connection fitting on the
discharge of the pumps, compatible with the finished water discharge
hoses. Provide a male cam and grove style quick connection fitting on the
suction of the pumps, compatible with the finished water suction hoses.
4, Pump Manufacturer and model: Pumps shall be Goulds 3656/3756,
22BF 1x2-7, or approved equal
2.5 Filtration Equipment
A. Pre-Filtration Strainers
1. Provide two (2) in line strainers with a transparent housing for direct,
observation of filter element status, Strainer housing shall be glass-filled

July 2015 11206- 12polypropylene/acrylic with 1-¥2 inch inlet and outlet threaded pipe
connections.
Strainer shall provide for flushing the filter element without disassembly
of the unit. Strainer housing shall have a 34-inch purge fitting at bottom
of housing. The purge fitting shall be connected to a drain pipe that
drains to the purge water to the exterior of the trailer.
Filter elements installed in units shall be stainless steel wire, 140 mesh
(105 micron, nominal). Provide two (2) spare filter elements, 100 mesh
size, loose, for use by OWNER as needed.
‘The filter housing shall be sealed with an EPDM seal at the top where the
unit is screwed into the filter body and a viton seal at the bottom of the
filter element
‘The strainer shall be TwistIIClean, T2C-150 as manufactured by
LAKOS, or approved equal.
B. First Stage Filters

Provide two (2) first stage filters. Filter housing shall be 304SS,
electropolished, with a pressure rating of 150 psi. Filter shall be designed
to remove larger suspended particles, with a built in cyclone separator to
separate dense solids prior to cartridge element. Inlet & Outlet
connections shall 2-inch threaded. Housing shall include a ¥4-inch lid
vent and a I-inch threaded drain connection. Drains shall be equipped
with manual valves and piped to the exterior of the trailer,
Filter element shall have a nominal 5 micron filter rating that is 90
percent efficient. Filter element shall have 170 square feet of pleated
polyester media providing exceptional surface area and high loading
capacity for long filter life. End cap, center tube and media shall be
thermaily bonded as one integral component for added strength. End caps,
shall be pliable PVC with sealing surface built in. Center tubes shall be
rigid perforated PVC or molded polypropylene. Filter element length
shall be 30-3/4-inches, outside diameter shall be 7-3/4-inches and inside
diameter shall be 3-inches.
Filter housing shall be model HUR-170-HP with an HC/170-5 Hurricane
filter cartridge as manufactured by Harmsco, or approved equal.

Provide two (2) second stage filters. Filter housing shall be 3048S
construction, clectropolished, with a pressure rating of 150 psi. Inlet &
Outlet connections shall be 2-inches, threaded. Housing shall include a
Minch lid vent and a I-inch threaded drain connection, Drains shall be
equipped with manual valves and piped to the exterior of the trailer.
Filter element shall have a nominal 0.35 micron filter rating. Filter
element shall have 170 square feet of pleated polyester media providing
high loading capacity for long filter life. End cap, center tube and media

1785, unless otherwise shown. Elbows and tees shall be of the same material as
the pipe. Joint design shall be for solvent-welded construction to the pipe

2.8 Valves
A. PVC Ball Valves
1. Plastic ball valves shall have union ends or flanged ends to mate with
ANSI B 16.5, class 150 flanges, for easy removal. The balls shall have full
size ports and Teflon seats, Body seals, union O-ring seals, and stem seals,
shall be in accordance with the corrosion resistance requirements of
respective valve manufacturer, External (without entering into the wetted
area) seat packing adjustment is required. Metal reinforced stems to
prevent accidental breakage are preferred. The valves shall be suitable for a
maximum working non-shock pressure of 150 psi at 73 degrees F for PVC,
with decreasing ratings for higher temperatures and other plastics.
2. Ball valves for chemical solutions that produce off-gas, such as sodium
hypochlorite, shall be provided with vented balls by the ball valve
manufacturer.
3. Manufacturers: ASAHI-America, George Fischer, Inc., Plast-O-Matic

B. Combination Air/Vacuum Valves:
1. Air/vacuum valves shall be installed at all high point in the piping
system located within the trailer.
2. The air/vacuum valve shall be two (2) independent valves, an
air/vacuum valve and an air release valve, combined in a dual housing
designed to withstand 150 psi.
3. ‘The valve shall be designed to exhaust large volumes of air when
filling the pipeline, to release small quantities of air during operation,
and to admit large volumes of air upon impending vacuum during
draining.
4. Combination air/vacuum valves shall be as manufactured by A.R.I
Series D-040, or approved equal.

Pressure relief valves shall be direct-acting, spring loaded, diaphragm
type relief valve. Valve shall have a cast bronze body and cover, brass
and stainless steel trim, and Buna-N sealing mechanism.
Pressure relief valve shall be Cla-Val Series CRL-60, or approved
equal.
Furnish and install a raw water pressure relief valve inside the trailer,
located upstream of the pre-filtration strainers, as shown on the process
diagram, Valve shall be set by SUPPLIER at the factory to maintain
system pressure within the treatment system below the pressure rating
of the lowest rated component of the system. Discharge water from the
raw water pressure relief valve shall be piped to the exterior of the
trailer with a camlock quick connection fitting to allow for connection
of a raw water drain hose to convey the water away from the trailer.
Furnish and install a distribution pressure relief valve on one end of the
distribution header, as shown on the process diagram. Valve shall be
adjustable, set by SUPPLIER at the factory to maintain a recycle flow
from the distribution header to the pillow tank to prevent deadheading
of the finished water pump when total flow from the distribution header
taps is low to zero,

sensor, a temperature sensor, cables for connecting the sensors to the
analyzer and the flow cells for housing the three sensors. Sensors shall
plug into the cables using quick disconnect fittings.
3. The flow cell module shall be clear plastic to allow the sensors to be
easily inspected for fouling. The inlet shall be fitted with a check valve
to ensure the sensors remain wet in the event sample flow is lost. Flow
cell shall include a sample valve for obtaining grab samples from the
inlet of the first cell, a manual outlet valve and a manual inlet valve for
controlling the flow rate into the cells. The flow cell module and
sensors shall be able to handle pressures up to 88 psig.

Instruction of the OWNER’s Personnel
1. Anemployee or authorized training representative of the SUPPLIER
shall visit the project site to provide a minimum of eight (8) hours,
instruction to the OWNER’s personnel in the operation and maintenance
of the equipment, including step-by-step troubleshooting with necessary
test equipment. Instruction shall be specific to the models of equipment
provided.
2. Training shall include at a minimum: draining and flushing of all
equipment including filter housings and chemical feed system; operation,
calibration and maintenance of instruments and sensors; removal and
replacement of all strainer screens and filter cartridges; filling, draining
and purging of pillow tanks.
3, The representative shall have at least two years’ experience in training.
4, Training shall be scheduled a minimum of three weeks in advance of the
first session,
5. Proposed training material and a detailed outline of each lesson shall be
submitted for review. Comments shall be incorporated into the material.

‘The trailer must travel a minimum of 100 miles over interstate highway after
completion of the factory tests and prior to field testing.
When the system is delivered, the entire system — including strainers, filters,
valves, pumps, fittings, and all connections that make up the entire system ~
shall be hydrostatically tested at a pressure of 150 psi or a pressure equal to the
lowest test pressure rating of the equipment within the tested system,
whichever pressure is lower.
‘The test pressure shall be applied for a minimum of 20 minutes, during which
time all joints, connections and seams shall be checked for leaking. Any
deficiencies found shall be repaired and the system shall be retested.
Once hydrostatic testing has been successfully completed and any defects
encountered have been repaired, the package surface water treatment system
will be operated using raw water from the Rogue River taken from the river at
‘a location selected by the OWNER near the OWNER’S municipal water

Package treatment system shall be operated for a minimum of eight (8) hours,
uninterrupted and with no disturbance to the operation of the treatment
package as a result of equipment or instrument failures. If equipment or
instrument failures are encountered, the plant will be stopped, the defects
repaired and the eight (8) hour testing period shall resume, Contractor shall
provide fuel and sodium hypochlorite for the duration of the texting.

PARTIES: The CITY OF GRANTS PASS, hereinafter referred to
as City, and hereinafter referred to as
Contractor.

Based on the terms and conditions contained herein, the Parties agree as follows:
4. LABOR AND MATERIALS: Contractor shall provide all labor, materials of
whatever kind and character for completion of the Project. Because this is a
professional services contract, City is relying on the expertise and reputation of
the Contractor. Therefore, no part of this Project may be contracted out to other
persons or firms without the express written consent of the City, except as
previously stated in the Contractors proposal.
2. | SCOPE OF WORK: Provide a package emergency water treatment trailer as
described in Exhibit A; “TECHNICAL SPECIFICATION PACKAGE SURFACE
WATER TREATMENT PLANT FOR CITY OF GRANTS PASS, OREGON JULY
2015"
3. PROJECT COST: The City shall pay Contractor an amount not to exceed
for services listed in Section 2 above.
4. ADDITIONAL WORK: All additional work shall be approved by the City of
Grants Pass prior to commencement of said work,
5. ORAL MODIFICATIONS AND WAIVERS: The City's rights and benefits under
this Agreement and any parts thereof may not be orally modified or waived,
6. WRITTEN MODIFICATIONS AND WAIVERS: The rights and benefits of the
Gity, under this Agreement, may be modified or waived so long as said
modification or waiver is in writing and signed by the City Manager or the Public
Works Department Director.
7. PAYMENTS: Contractor may submit progress billings once every 30 days.
Upon satisfactory completion of services listed in Section 2 above, the Contractor
shall make a written request for final payment. The City shall make final payment
to the Contractor within 30 days of written acceptance by the City

provide workers’ compensation coverage for all their subject workers. Contractor
shall provide proof of coverage at the time of the execution of this agreement and
continuing proof of coverage during the period of this Agreement.
LIABILITY INSURANCE: Contractor shall maintain a policy of liability insurance
in the form, and from an insurance company, approved by the City, which
company is admitted or otherwise licensed to do business in the State of Oregon
Said insurance shall insure Contractor for the benefit of the City of Grants Pass
in not less than the amount of $1,000,000 single limit liability for each
occurrence, and aggregate coverage of not less than $2,000,000. The insurance
shall cover any occurrences, resulting from any conduct, act, or failure to act, by
Contractor, or by an employee, representative, or agent of Contractor, and which
occurrence or occurrences result in damages of any kind, including, but not
limited to, personal injury or death to any person or persons, damage to any
property (personal or real), or damage to any contractual or other commercial
Tight or interest. Contractor shall require its insurance carrier to provide to the
City a certificate of insurance evidencing said coverage. Said policy shall provide
that such coverage cannot be modified, terminated or canceled by the carrier
without 30 days written notice sent by certified mail by the insurance carrier to
the City. It is agreed that no person shall perform any acts on behalf of
Contractor without having said insurance in full force and effect.
COMPLIANCE WITH ALL LAWS: Contractor shall
‘A. Make payment promptly, as due, to all persons supplying to such
Contractor labor or material for the prosecution of the work provided for in
this contract.
B. Pay alll contributions or amounts due the Industrial Accident Fund from
Contractor or a subcontractor incurred in the performance of the contract,
C. Not permit any lien or claim to be filed or prosecuted against the state,
county, school district, municipality, municipal corporation or subdivision
thereof, on account of any labor or material
D. Pay to the Department of Revenue all sums withheld from employees
pursuant to ORS 316.167.
E. Promptly, as due, make payment to any person, copartnership,
association or corporation, furnishing medical, surgical and hospital care
or other needed care and attention, incident to sickness or injury, to the
employees of Contractor, of all sums which Contractor agrees to pay for
such services and all moneys and sums which Contractor collected or
deducted from the wages of employees pursuant to any law, contract or
agreement for the purpose of providing or paying for such service.
F. Comply with all laws and administrative rules of the United States, the
State of Oregon (including specifically ORS Chapter 279C), and the City.

G. Not fail, neglect or refuse to make prompt payment of any claim for labor
or services furnished to Contractor or a subcontractor by any person in
connection with this contract as such claim becomes due. If failure,
neglect, or refusal occur, the proper officer or officers representing the City
may pay such claim to the person furnishing the labor or services and
charge the amount of the payment against funds due or to become due
Contractor by reason of this agreement. The payment of a claim in the
manner authorized in this section shall not relieve the Contractor or
Contractor's surety from obligation with respect to any unpaid claims.
H. Not employ any person for more than eight hours in any one day, or 40
hours in any one week, except in case of necessity, emergency, or where
the public policy absolutely requires it, and in such cases the laborer shall
be paid at least time and a half pay for all overtime in excess of eight
hours a day and for work performed on Saturday and on any legal holiday
specified in ORS 279C.540.
ATTORNEY FEES: If suit or action is brought by either Party to enforce any
Tight created by this Agreement, the prevailing Party shall be entitled to recover
in any trial court, and appellate courts, reasonable attorney fees, including costs
and disbursements therein,
SEVERABILITY: In the event any court of competent jurisdiction shall hold any
provision of this Agreement invalid or unenforceable, such holding shall not
invalidate or render unenforceable any other provision hereof.
NO REMEDY EXCLUSIVE: The remedies specified in this Agreement are
cumulative to one another and to other remedies in law and equity, and no
remedy is exclusive. No delay or omission to exercise any right or power
accruing upon any default shall impair any such right or power or shall be
construed to be a waiver thereof, but any such right or power may be exercised
from time to time and as often as may be deemed expedient. To exercise any
remedy specified in this agreement it shall not be necessary to give any notice,
other than such notice as set forth herein,
HOLD HARMLESS: Contractor shall indemnify, defend, and hold harmless the
City, its officers, agents, and employees, from and against all claims, losses,
damages, and liabilities that may arise from the performance or the failure to
perform services under this agreement.
ENTIRE AGREEMENT: ‘This document represents the entire agreement
between the Parties. Prior conversations or writings between the Parties which
are not specifically incorporated by reference into this Agreement may not be
used by the Parties or by a Court of law to interpret the terms and conditions
stated herein. Except as specifically set forth herein, prior courses of dealing and
performance between the Parties, and trade usage and practices which may or
may not be acceptable in the industry, also may not be used by the Parties or by
a Court of law to interpret the terms and conditions stated herein. (Madison
Indus. Inc. v. Eastman Kodak Co., 243 N.J. Super. 578,581 A.2nd 85 (1990).
