Re: Complaint in respect to CBC ATIP request A-2023-00070/JC
Dear Madame,
I am writing you in respect to an ATIP request dated 25 July, 2023, submitted on behalf of my
organization to the Canadian Broadcasting Corporation (the “CBC”). At that time we sought
“Any documents within its possession or control relating to the Trusted News Initiative (“TNI”). For
greater certainty this includes documents related to pre-contractual negotiations, draft agreements,
executed agreements, indemnification, benefits received, memoranda, correspondence, minutes,
and related.”
After a substantial period of time on 15 March, 2024, the CBC’s Senior Director for Access to
Information and Privacy produced the enclosed cover letter and responsive records. Their file
is identified as A-2023-00070 / JC.
As you can see the responsive records are virtually illegible in that redactions have been
generously applied so as to render the documents mostly useless. They were applied under
ss 16(2)(c), 17, 19(1), 20(1)(b), and 21(1)(b) of the Access to Information Act (the “Act”). As you
are aware:
1. Redactions under s 16(2)(c) are normally applied where disclosure might facilitate a crime,
like exploiting the vulnerability of a physical building or system;
2. Redactions under s 17 are normally applied where the safety of individuals might be
threatened;
3. Redactions under s 19(1) are normally applied when disclosure would reveal personal
information;
4. Redactions under s 20(1)(b) are normally applied where disclosure might result in material
financial loss or gain or might prejudice the competitive position of a third party; and
5. Redactions under s 68.1 are normally applied to any information that is under the control
of the CBC that relates to its journalistic, creative or programming activities, other than
information that relates to its general administration.
I am skeptical of the applicability of most, if not all, of the aforementioned. No justification

was provided by the CBC. We are not brigands, assassins, thiefs, or merchants. Nor are we
seeking CBC/Radio-Canada’s playlists.
I would like to draw your attention to Canadian Broadcasting Corporation v. Canada (Information
Commissioner), 2011 FCA 326. As you may be aware the Federal Court of Appeal has
confirmed that you have the power to examine records witheld by the CBC in order to assess
whether the information in the records was properly witheld under the exclusion in s 68.1 of
the Act.
I note on your website that you have said that access to information is a right of everyone,
that access is the rule, secrecy the exception, that requests should be speedy, refusals must
be justified, and the public interest takes precedence over secrecy.
I would like to request that you make inquiries to obtain the full applicable records, review
those records, and confirm to the parties whether the redactions or exclusions applied were
reasonable. And if not, to provide appropriate directions to the CBC to facilitate production of
the requested records expeditiously.

to its journalistic, creative or programming activities, other than information that relates to its general administration.”
