The most basic needs of the children are referred to as rights.Violations of children’s rights remain
tragically common across the world. Children are right holders and all adults can play a role in achieving
children's rights. As justice Bhagwati has rightly quoted “the child is a soul with a being, a nature and
capacities of its own, who must be helped to find them, to grow into the maturity, into fullness on physical
and vital energy and most breadth, depth and height of its emotional, intellectual and spiritual being” so,
here I'm India we've a lot of laws and rights for ensuring the security of children. Legal protection to make
them able to thrive. But there are a lot of crimes happening against children each and everyday. Here is
one of them . I happened to see it in The Hindu.
The world is in the middle of covid-19 pandemic. Majority of people's mental well-being is affected. At
that time a minor girl is sexually assaulted by another patient at the covid care centre in South Delhi.
There are a lot of child rights violated in this case. They're
1) Right to life and personal liberty (under article 21) this is a vast right.
The girl has her own life. She has the right to live her life with personal liberty. So, she has the full
right of her body parts and mind too. Here the another patient violated these aspects of the
fundamental right.
Article 21 (life and liberty)of the Constitution of India states underlies the primary importance of
early childhood developments and the right to food, nutrition and health are part and parcel of this
right.
Right of Women to be Treated with Decency, and Dignity and Right to live with dignity are denied
here. He girl is a female by birth. So she must be treated with respect.
2) Right to be protected from physical and mental violence, sexual abuse and exploitation ( under
article 19)
3) Right Against Exploitation (Articles 23, 24 and 39e)
Article 39 (e) of the Directive Principles of State Policy provides that children of
tender age should not be abused etc.
In her tender age, she is sexually assaulted. It may affect her mental health for the whole life.
4) Right to equal opportunities and facilities to develop in a healthy manner and in conditions of
freedom and dignity (Article 39 (f))
5) Right to health as mentioned in DPSP.
Clause (e) of Article 39 has provisions relating to the health and well-being of the children.
This includes the mental health of the child too. If she loses her mental well-being because of the
incident that had happened, it's severe. If she finds her health is not good because of the assault, it again
denies the fundamental right. In certain cases the child who has passed through the tough times like this
often end up their married life because these incidents are not letting them to live.
6) The man's associate captured the sexual assault. It's again a serious offense. He violated the
rule. The girl's body is her personal liberty. Another person doesn't have the power to shoot it.
Based on her complaint, a case was registered against the two men under section 376 (punishment for
sexual assault) of the Indian Penal Code (IPC) and the relevant provisions of the Protection Of Children
from Sexual Offences (POCSO) act.
