EMPLOYED AS ENTERTAINERS, GUEST RELATION OFFICERS (GROs), HOSPITALITY WORKERS/DANCERS, DANCE INSTRUCTORS (DIs), CLUB WAITERS AND WAITRESSES AND WORKERS IN THE COMMERCIAL ENTERTAINMENT INDUSTRY TO THE BUSINESS PERMITS OF EMPLOYING ESTABLISHMENTS IN ORDER TO FURTHER PROTECT THE RIGHTS OF CHILDREN FROM ABUSE, EXPLOITATION AND FOR OTHER PURPOSES Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled: SECTION 1. TITLE. - This Ordinance shall be known as "An Ordinance Requiring the Compulsory Attachment of Authenticated/True Copy of Birth Certificates of all Employees and/or Workers be they Permanent, Temporary, Provisional, Seasonal, Regular and Contractual, Etc. Employed as Entertainers, Guest Relation Officers (GROs), Hospitality Workers/Dancers, Dance Instructors (DIs), Club Waiters and Waitresses and Other Workers in the Commercial Entertainment Industry, to the Business Permits of Employing Establishments in Order to Further Protect the Rights of Children from Abuse, Exploitation and for Other Purposes". SECTION 2. DECLARATION OF POLICY. - It is the policy ef the. City Government of Davao to protect the rights. of children and provide them ample support to ensure their survival, protection, participation and development as embodied in RA 7610, an act providing for the Special Protection of the Filipino Children. SECTION 3. COMPULSORY ATTAl IT OF BIRTH CERTIFICAT! TO _BUSINESS PERMITS. — All owners/proprietors of commercial entertainment establishments, as defined in the Revised Local Tax Code of Davao City, shall attach to their business permits the authenticated/true copy of birth certificates with 2 x 2 ID picture of all their workers employed as entertainers, guest relation officers (GR0s), dance instructors (DIs), club waiters and waitresses.Page 2 of 3 In the absence of a birth certificate, the applicants must get a certification from the place where they were born to the effect that they were not registered together with « Zpint affidavit of two disinterested persons attesting. to their dates of birth; SECTION 4. COMPULSORY PRESENTATION AND AVAILABILIT: BIRTH CERTIFICATES. - The aforesaid attachments mentioned ~in the preceding section shall be readily available at all times during the entire duration of the employment of the aforementioned workers. Such attachments must be readily made available and accessible for inspection and verification anytime during business hours or business days or nights by authorized representatives of government agencies and offices. SECTION 5. APPLICABILITY OF THIS ORDINANCE TO ARDITIONAL OR NEWLY-HIRED REGULAR/CONTRACTUAL WORKERS. — ~The Provisions of this ordinance shall be applicable to additional or newly-hired regular/contractual employees of the establishments covered by this ordinance. SECTION 6. PENAL PROVISIONS. - Gwners/proprietors of establishment found violating the provisions of this ordinance shall be penalized as follows: @) First violation - Fine of ONE THOUSAND PESOS. (1,000.00) b) Second violation - Fine of THREE THOUSAND PESOS 7 {P3,000.00) and a WARNING that similar violation in the future shall warrant closure of the establishment; ©) Subsequent Violation - Fine of FIVE THOUSAND PESOS (75,000.00) and closure of the establishment. SECTION 7. EFFECTIVITY. ~ This ordinance shall take effect immediately after its publication in two (2) local newspapers of general circulation in Davao City.
