Radhika, resident of Malleshwaram, came to Jayanagar on 5/01/2020 to sec her mother in-Law
Kamalamma. who was ill. The next day i.c on 6/01/2020, at about 3 P.m, Radhika came to the
bus stop at Jayanagar to board a B.T.S bus in order lo return to Malleshwaram, Kamalamma, the
mother -in-law. also came to bus stop to see-oft Radlhika. At about 3:15 pm B.T.S bus bearing
NO-7695 came. Radhika boarded the bus & took her seat, Kamalamma, Who was having a
vegetable bag also got into the bus in order to hand over the said bag to her daughter-in -Law
After handing over the bag to Radhika, Kamalamma was alighting from the bus. At that point of
time the conductor Ramaiah blew the whistle & the Driver Giriyappa started the bus.
Kamalamma having lost her balance, fell from the bus the left side rear wheel of the bus ran over
her right thigh. The passengers eried out & the driver immediately stopped the bus. However,
Kamalamma. the mother -in-law of Radhika. died at the spot itself.

Issues:
. Whether the death of Kamalamma was due to act of the rash & negligence of B.T.S
driver?

3. Can the accused be tried before the court for the offence punishable under Sec 304A of

amount due to Ravi by sale of schedule
property.
