SUBJECT: DRAFTING, PLEADINGS AND CONVEYANCE
PAPER CODE: LB-502

TIME: 3 HOURS MAXIMUM MARKS: 100

 All questions carry equal marks (25 marks)
 This question paper contains a total of 6 questions.
 Attempt any 4 questions out of 6 questions.
 Answers may be written either in English or in Hindi but the same medium should be
used throughout the paper.

Q1. Lajpat Rai aged 70 years, is a resident of 12 Kashmiri Gate, New Delhi. He is not
keeping well for the past few months after his heart surgery. He is the absolute owner of
his self-acquired properties comprising of two houses in Delhi, Fixed Deposits,
Jewellery, Mutual Funds and Shares. He is anxious to make necessary arrangements
regarding his above-mentioned properties for avoiding unnecessary misunderstandings
and future litigation among his family members after his death. Finally, on 15.07.2021,
the will was drafted under which Lajpat Rai distributed his properties among his wife
and sons (S1 and S2) equally. He appointed his brother-in-law Mohan as the executor
under the will. Lajpat Rai expired on 12.02.2022.
Draft a will for Lajpat Rai and file a petition for a grant of probate on behalf of Mohan.

Q2. Draft a comprehensive lease deed between Rajiv (Lessor)and Bhaskar (Lessee) for the
flat situated in New Friends Colony consisting of two Bedrooms with parking having an
area of 1800 square feet with the security deposit of Rs. 40,000 and the monthly rent of
Rs. 20,000. The lease will be initially for 11 months and the lease deed must contain
essential terms and conditions and other general clauses.

Q3. On 01.02.2017, Digvijay got appointed as a Senior Technical Officer with M/s AB & Co.
Ltd, a company wholly owned by the Government of India and having its registered
office in the CGO Complex, New Delhi. He continued to work with the company till
January 2020. During this, he received his usual increments and promotions. However,
on 30.03.2021 he was terminated from his services with immediate effects. The order
issued by the Managing Director of the company charges him with misconduct and
dereliction of duty on his part. He was relieved of his duties the same day without
holding any enquiry under the rules applicable to the company employees.
Draft an appropriate Writ petition for Digvijay along with an Affidavit.

Q4. On 14.02.2021, Janardhan and Sundar entered into a partnership in the business of
Export. The business was agreed to be operated from Jagriti Enclave, Delhi, under the
name and style “Fashion Collection”. Also, Janardhan will do the selling and purchasing
work, and Sundar will take care of the accounts belonging to the partnership. Further,
both of them agreed to equally contribute to the capital of the partnership firm and share
equally the profits and losses thereof. Gradually several disputes and differences have
arisen between them whereby it has become impossible to carry on the business in
partnership with advantage to the parties. Both the partners decided to dissolve the
partnership on 03.02.2022.
Draft a partnership deed and a deed of dissolution of partnership for both parties.

Q5. On 1st January 2022, Shyamlal drew a cheque for Rs. 4 lakhs on the State Bank of India,
C.P. Branch of New Delhi, payable to one Ram. When Ram presented the said cheque,
the same got dishonoured and came with a noting stating "insufficiency of the funds".
Within the prescribed statutory time of sending the notice, Ram gave notice of the said
dishonour to Shyamlal and called upon him to make the payment of the amount
mentioned in the dishonoured cheque that he failed to pay. Subsequently, Ram filed a
complaint against Shyamlal under section 138 of the Negotiable Instruments Act.
Draft a Notice together with a Complaint under section 138 of the Negotiable
Instruments Act for Ram.

Q6. Soma was lawfully married to Sudhir as per Hindu rites on 08.11.2018. Both parties
lived together and cohabited at Civil Lines, New Delhi. On 01.03.2021, Soma separated
from her husband, who habitually treated her with great harshness and cruelty, frequently
abusing her and beating her and treating her in the coarsest and most insulting language.
He is a drunkard and often criticises her for bringing insufficient dowry. She was not
allowed to visit her parents. On the fateful night of 01.03.2021, he assaulted her and
dragged her out of the matrimonial home. Soma and her son, born from this wedlock,
came to her father’s house. Since then, she made repeated attempts to join Sudhir who
refused to take her back. Now she has a reasonable apprehension that it will be harmful
to her to live with her husband and has filed for divorce under the Hindu Marriage Act
(1955).

Sudhir is employed in the government sector and has sufficient means to maintain Soma
and their son. Soma is unemployed and unable to maintain herself and her son. She is
dependent on her retired father for her day-to-day expenses. Her streedhan, dowry and
other belongings are still lying in the custody of her husband. She also files a petition for
maintenance under section 125 of the Code of Criminal Procedure (1973) for directing
Sudhir to pay them monthly maintenance allowances.

Draft a Petition for dissolution of marriage by a decree of divorce under the Hindu
Marriage Act, 1955 and a Maintenance Application under section 125 of the Code of
Criminal Procedure, 1973 for Soma.
