General Instructions

1. No clarifications can be sought on the question paper. In case of any ambiguity in the question paper
students are expected to rely on the question paper as it is and respond to it.
2. Notes, books, other written and printed matter, other examinations aids, and electronic devices, including
but not limited to mobile phones, laptops and digital diaries, are strictly prohibited in the examination
hall. Any candidate found in possession of any of the above during the examinations, either inside or
outside the Examination hall will be treated as unfair means.
3. Start a new page for each question and take care to identify each answer clearly with the
number of the question and, where appropriate, the part you are answering and write your
answers in sequence i.e. number wise.
Material allowed in the Examination hall: Index page of the Indian Contract act, 1872 singed by the
faculty.
CONTRACT LAW-1

1. Write short notes on any 3 of the following:

(a) Ambiguous and Uncertain Agreements


(b) Doctrine of frustration of contract
(c) Supply of necessaries to person incapable to contract
(d) Types of e- contract
(e) Discharge of contract by lapse of time

2. Sita, who is 90 years old, wants her daughter Isha to take care of her property. She enters into two
agreements with Isha. In the first agreement, Sita gifts 200 acres of land to Isha. In the second agreement,
Sita agrees to give her bungalow in Gurgaon on the condition that Isha would provide monthly maintenance
to her aunt Geeta. Isha accepted both the properties. However, she discontinues providing maintenance to
Geeta after six months. When objected by Geeta, Isha replied that she is not bound to provide maintenance
because Geeta is not doing anything in return. Geeta sues Isha arguing that it is Isha’s contractual
obligation against both the properties she received, to provide maintenance to Geeta.
Decide the suit in the light of relevant cases and provisions of the Indian Contract Act, 1872.

3. Sunrise, a factory located in Benares, manufactures and supplies polyester. On 20th March, 2022, one of the
main machineries of the factory broke down. Anand, who was a mechanic, was called to check the machine.

He informed that a part of the machine needed replacement. That very part was available only in Delhi.
Ravi,

the owner of Sunrise & Co. asked Anand to get the machinery part. Anand left the very same day and
agreed to return on 23rd March, 2022. However, he returned with the new machinery part on 28th March,
2022. Ravi contended that Anand had displayed professional negligence and claimed for the loss of profit
resultant from the unexpected week-long closure. Anand said that he had not known that the delayed return
of the machinery part would result in closure of the factory and thus the loss of profit is too remote a
damage. Ravi sues Anand for the loss of profits.

Decide the suit in the light of relevant cases and provisions of the Indian Contract Act, 1872.

4. Prakash is a moneylender in Cincinati village. Most of the population in Cincinati consists of daily wage
workers, trying to make ends meet every day. Shobha, a 75 years old woman with no one in her family,
approaches Prakash for a loan of Rs. 25,000. Prakash agrees to lend the loan at hundred percent rate of
interest, knowing that Shoba does not have a choice. Shobha agrees.
Raju, Shobha’s neighbor, is also in need of money for her daughter’s marriage. Raju approaches Prakash
for loan of Rs. 50,000 and is told that loan would be given only at hundred per cent rate of interest. Raju
returns back to his house. Next day, Raju takes a pistol and goes to Prakash and threatens him to make an
agreement to lend Rs. 50,000 to him with no interest. Prakash does the same.

Whether Prakash’s contracts with Shobha and Prakash are valid? Decide in the light of relevant provisions
of the Indian Contract Act, 1872.
