Paper 2.1: Law of Contracts-I
Time: 2.00 Hours Total Marks: 20

3. Bare Act of Indian Contract Act 1872 will be provided.

(Attempt all questions; all questions carry equal marks)

Q1. Decide the following giving reasons: (11 marks)


(a) An estate agent explained to his customers, the effect of the printed form of contract by saying that the
commission would be payable only in case the sale went through, but the printed form of contract contained
different terms contrary to his statement, that in each transaction certain commission would be payable. Discuss.
(2 Marks)
(b) A gift of his entire property was made by Akhil, a person of weak intelligence in favour of his brother ‘Baali’.
Can undue influence be presumed? (3 Marks)
(c) Arun wrote to Dinesh offering to sell Dinesh his house for Rs. Ten lacs. On receiving Arun's offer, Dinesh
telephoned him, on 10th March, 2019, in order to accept. Arun, said that he wanted written confirmation from
Dinesh. Arun said that if Dinesh got his letter of acceptance to him by 11:00 am on 11th March, 2019, he would
finalise the contract with Dinesh. Dinesh at once wrote and posted a letter of acceptance, which Arun received at
9:00 am on 11th March 2019. In the meantime, however, Arun had received a better offer for his house from
Tarun and withdrew his offer to Dinesh by posting a letter at 3 pm on 10th March 2019, which was received by
Lalit at 8.00 am on 11th March. Discuss. (3 Marks)
(d) 'M' was an old lady. Just before dying she called for her daughter 'D' and her sister 'MS'. 'M' asked 'D' to grant
an annuity of Rs. 50,000 per year to 'MS' for her life after 'M' is no more. 'D' in the presence of 'MS' agrees to do
the same and afterwards enters into a written agreement to this effect with 'M'. 'M' dies thereafter and 'D' refused
to pay her aunt 'MS' the promised sum. 'MS' sues 'D' for breach of contract. You are required to decide the case
giving reasons. (3 Marks)

Q2. Attempt ANY THREE of the following giving reasons: (3x3=9 Marks)
a) M/S Global Fashion (Pvt.) Ltd. (hereinafter referred as the company) advertised in several newspapers of their
latest invention for colouring white hair to black through a medicinal preparation to be taken orally thrice a day
for a continuous period of forty days. To show their sincerity and effectiveness of their dye, the company also
stated in the advertisement that a reward of Rs.50,000 would be paid to anyone who would not get the result
after using the said magic drug. Miss Anita purchased the drug and despite using the same as per the printed
directions, found that the so-called magic drug was not at all effective. Decide whether Anita can claim the
reward?
b) The management committee of 'Lord Ganesh Temple' Jammu decided to construct one 'Yatri Niwas' for the
devotees. It approached Dharmendra for subscription who promised to pay a sum of Rs. Ten lakh for
construction of the said building. Later on, Dharmendra declined to pay the promised amount as his supporters
had not been inducted in the management committee. The committee tried their best to persuade Dharmendra
that it did not make any such promise that the said contribution is subject to his supporters being inducted in the
Committee, But Dharmendra is adamant not to pay the amount. Whether Dharmendra can be legally compelled
to pay the above said promised amount?
c) MB, a moneylender, lends Rs.50,000 to Kid, a minor on the basis of a representation that he was of full age. Out
of this amount Rs.31,000 are spent by “Kid” the minor for purchasing a two-wheeler scooter and Rs.19,000 are
spent on entertaining his friends in a Five-star Hotel. On Kid's failure to pay back the borrowed amount, MB
files a suit for recovery of Rs.55,000 (inclusive of interest). The defendant pleads that the contract was
absolutely void because of his minority. Discuss what relief, if any, can be available to MB.
d) 'N' was in the business of selling horses. His uncle 'U' visited his stud farm on a pleasure trip. 'N' gladly took
him around and showed him the horses. 'U' returned to his place and after three days sent an e-mail to 'N' which
said, "If I hear no more from you about that black horse, I shall consider it as mine for Rs.15,000.00" Thereafter,
'N' did not reply back but instructed his manager not to put that black horse up for auction as it had already been
sold to his uncle 'U'. The manager followed the instructions diligently and as a result all the horses except that
black horse were sold. But 'U' never came forward to make payment for that black horse. 'N' sues 'U' to enforce
the contact. Would he succeed? Give reasons for your answer.

1. What role VCOs can play for protection of consumers’ interest under the provisions of Consumer
Protection Act, 1986? Discuss.

‘X’ a company engaged in manufacture of a popular car brand, invited applications from persons
interested in purchase of cars with the stipulation that at the time of booking and registration, an
advance deposit of Rs.10,000/- was to be made by each customer which was later to be adjusted
against the total price payable at the time of delivery. Due to long delay in delivery of cars, 500
customers cancelled their bookings and applied for refund of registration fee. However, ‘X’ did not
refund the amount to the customers. Two hundred (200) out of the total 500 consumers approached
'Voice of Consumers’ (‘VOC’) - a Voluntary Consumer Organization (VCO) - to file a consumer
complaint on their behalf.

‘VOC’ files a Consumer Complaintbefore the NationalConsumer Disputes RedressalCommission


(NC)claiming compensation on behalf of all the affected consumers (including the rest of 300 affected
consumers,the details of which were not available with ‘VOC’).

Discuss about the maintainability of the complaint role VCOs, with help of relevant law and decided
cases. (2+10=12 Marks) (Max 2.5 sides of page)

2.a) Discuss the powers and jurisdictions of Consumer Fora. Will it be appropriate to call these fora as
Courts and the proceedings in consumer fora as judicial proceedings? Give reasons. (4 Marks)
b) What reliefs can be granted by these authorities? (2 Marks)
c) Keeping in mind the composition of different authorities and councils dealing with consumers interest,
how the common consumers get represented at these authorities? (2Marks)

Paper 2.3: Criminal Law-I
Time: 2.00 Hours Total Marks: 20

Instructions:

Q.1. The accused at the dead of night went to his mother-in-law’s house taking a torch. He found her
sleeping and killed her by severing her head with a knife. He then put the head and knife in a cloth bag
and hid it in an underground cell. The accused pleaded unsoundness of mind in his defence. In support
of his plea, two doctors were examined. One doctor deposed that he had examined the accused two
years ago and found that he had epileptic type of insanity at that time. The other doctor deposed that he
found the accused two months after the incident suffering from epileptic insanity. The father of the
accused stated that he found the accused in a disturbed mental state of mind for two days and that in
the morning after the crime, he found the accused unconscious with his hands and feet stiffened.
Decide give reasons, whether the accused can be given exemption from criminal liability on the
grounds of unsoundness of mind as provided under Section 84 of I.P.C.? (5 Marks)

Q.2. The accused was ordered by the landlord to the bar. He refused and hit the landlord in the face and
punched a customer. When he was tried to be ejected from the bar, he started swinging a broken glass
towards the landlord and other customers, resulting in a cut on the landlord’s arm. When police arrived
he also kicked three police officers who were taking him into the police car. Accused’s defence was
that he was acting under the influence of a combination of drugs (not medically prescribed) and
alcohol, to such an extent that he did not know what he was doing.
In the light of these facts, decide his criminal liability as per the law on defence of intoxication under
the Indian Penal Code. (5 Marks)

Q3. ‘A’ with an intention to cause miscarriage gave poison to ‘B’ which she resisted to take. Seeing such
resistance, ‘A’ then held ‘B’ and put the poison in her mouth. ‘B’ shouted for help and before ‘A’
could escape, he was caught. ‘A’ then charged with attempt to cause miscarriage under the relevant
provisions of IPC. Decide the culpability of ‘A’ if-
a. Poison was sufficient to cause miscarriage but ‘B’ was not pregnant.
b. Poison was insufficient to cause miscarriage though ‘B’ was pregnant. (2*2= 4 marks)

Q4. A, B, D and E planned to murder ‘Z’. A and B did recce for this purpose and found that ‘Z’ is always
accompanied with two security personnels carrying automatic weapons and the only time he is alone
when he goes for morning walk. To accomplish their mission they armed themselves with pistols and
other deadly weapons. ‘A’ remained at a distance in a car and monitored the actions of the group by
using an audio visual device. ‘E’ positioned himself outside the entrance of the park. B and D entered
the park carrying guns. Seeing ‘Z’ entering the park ‘B’ opened the fire at ‘Z’ which proved fatal and
hence ‘Z’ succumbs to the injury. After hearing the gun shots the police patrolling party rushed to the
spot and managed to catch ‘B’. Subsequently others were also arrested. All four were charged with the
murder of ‘Z’ under section 302 read with section 34 IPC.
A contented that he was not physically present at the place of commission of crime, therefore, the
charge does not sustain against him.
E contented that he did not actually participate in the crime; hence the charge under section 302 should
be dropped.
D submitted that it was B who fired at ‘Z’ and took his life hence the liability under section 302 should
be restricted to B only.
Decide the culpability of A, B, D and E in respect of the charge framed against them. (6 marks)
