Description of this Agreement: This is a guarantee agreement between Hudson Dorms LLC and the Guaranteed student(s) named above that guarantees the student(s) will be provided a group of peers(s) to live with by Hudson Dorms for the 2021-2022 academic semesters at Stevens Institute of Technology. Hudson Dorms will provide a group of peers for the student(s) to meet and live with for the 2021-2022 Academic year ‘The student(s) will then choose whether or not to live with the presented group of peers. They will elect to live with the group by signing a Hudson Dorms Guarantee or a Hudson Dorms Lease, noted in section 3 and 4. The $. advance fee, ‘when paid, will be applied to the installment fee of the Hudson Dorms Lease or the Hudson Dorms Housing Guarantee. If the student(s) do not elect to join the group of peers(s), the student(s) will follow the steps outlined in the Cancellation of Guarantee Contract section of this agreement. 1. Eligibility ‘Student must be a regularly enrolled full-time registered undergraduate student of Stevens Institute of Technology. If one of the students named above do not meet these requirements, this agreement shall be deemed void. Students under 18 years of age when signing this agreement must have their parent or guardians agree to the Terms and Conditions of this agreement. 2. Group of Peers Hudson Dorms will make every effort to ensure that a provided group of peers will be presented to the student(s). Hudson Dorms’ goal is to pair up the student(s) with a group of peers that have similar interests, are compatible roommates, and/or appear to be a good fit to live together. 3. Hudson Dorms Housing Guarantee ‘The Hudson Dorms Housing Guarantee is the legal binding agreement that outlines the terms under which the student(s) are guaranteed ‘a housing option by Hudson Dorms. By signing this individual guarantee agreement, the student(s) acknowledge that they have reviewed the Hudson Dorms Housing Guarantee, understand and agree to all of its rules, and have read the terms and conditions in that agreement. 4. Hudson Dorms Lease ‘The Hudson Dorms Lease is the legal binding agreement that outlines the terms under which the student(s) are provided a housing option by Hudson Dorms. By signing this guarantee agreement, the student(s) acknowledge that they have reviewed the Hudson Dorms Sublet Agreement (Lease), understand and agree to all of its rules, and have read the terms and conditions in that lease. 5. Advance Fee AS. advance fee is required in order to execute this agreement. Ifthe student(s) are provided a group of peers and accept to fe with them, the advance payment(s), when paid, will be applied to the student(s) Hudson Dorms Housing Guarantee noted in Section 4 or a Hudson Dorms Lease noted in section 3. a ee7. Cancellation of Guarantee Contract The Student(s) will hve 10 calendar days to decide whether to accept or deny the group of peers once it has been offered. If student(s) elect not to live with a provided group of peers, and instead choose to not live with Hudson Dorms, Hudson Dorms, according to the Schedule and circumstances st forth below, shall retain the entire advance fee. Students) agree that the actual damages for student(s) decision not to or failure to take occupancy are extremely difficult or impractical to determine, and thatthe amount withheld constitutes liquidated damages A. Notification of cancellation: Student(s) must send an email to hudsondorms@ gmail.com with the subject header as “Cancel Hudson Dorms Individual Guarantec” and ce (Carbon Copy) all other Student(s) 3s named in this agreement inthe email Offer Expires: The provided group of peers expires ten days after the option has been provided tothe Student(s) Individual Guarantee: If Student(s) elect not to live withthe group of peers when offered and instead cancels, any existing individual guarantee will ordinarily be voided Altemative Housing Void: Inthe event thatthe Student(s) obtain alternative housing options (Stevens Leased Housing, Off- ‘Campus Apartments, Greek Housing et...), any existing housing/individual guarantee will ordinarily be voided. Group of Peers Preferences Hudson Dorms will make every effort to honor the preferences of the student(s). The student(s) signing this agreement will be ‘guaranteed a group of peers to live with by Hudson Dorms as outlined in section 2, however, specific group of peers requirements may. not be met. 9. Non-Diserimination Hudson Dorms does not discriminate on the basis of race, color, national origin, religion, sex, gender (gender identity and gender expression), disability, medical condition (cancer-related or genetic characteristics), ancestry, marital status, age, sexval orientation, citizenship, or service in the uniformed services. 10. Non-Transferable Agreement ‘This contract and the right of occupancy conferred are not transferable or assignable. 11, No Modification Clause ‘Any oral representations made outside of this contract do not modify the agreement. Any modifications to the agreement need to be ‘made in writing and signed by both parties 12, Merger Clause Effective as of the Date of Agreement, this Agreement contains the complete, full, and exclusive understanding of the Individual Guarantee Agreement as to its subject matter and shall, on such date, and supersede any prior agreement between Hudson Dorms LLC and the student(s) regarding the individual guarantee. Any amendments to this Agreement shall be effective and binding on Hudson Dorms LLC and the student(s) only if any such amendments are in writing and signed by both Parties. 13. No Waiver Any waiver ot non-enforcement by Hudson Dorms LLC of any term or condition of this agreement shall not constitute a waiver of any subsequent breach of the same or any other term or condition of this agreement.
