CHAPTER I

INTRODUCTION

I.1. Issue Background

The protection of fundamental human rights was a foundation stone in the establishment of the
United States over 200 years ago. Since then, a central goal of U.S. foreign policy has been the
promotion of respect for human rights, as embodied in the Universal Declaration of Human Rights.
Supporting democracy not only promotes such fundamental American values as religious
freedom and worker rights, but also helps create a more secure, stable, and prosperous global arena in
which the United States can advance its national interests.

1.2. Formulate the Problem

1. Did the application of the US has implemented the principle of human rights and
democracy?
2. What are the example of the application that implemented the principle of human rights
and democracy in US?

1. Know the application of the US that implemented the principle of human rights and
democracy.
2. Know the example of the application that implemented the principle of human rights and

CHAPTER II

DISCUSSION

2.1. The Application of the US that Implemented the Principle of Human Rights and
Democracy

The United States uses a wide range of tools to advance a freedom agenda, including bilateral
diplomacy, multilateral engagement, foreign assistance, reporting and public outreach, and economic
sanctions. The Department of State works with democratic partners, international and regional
organizations, nongovernmental organizations, and engaged citizens to support those seeking
freedom.
Although the application of this principle is filled with some controversy and violation
especially in human rights. In our opinion, the application of the US already implemented the
principle of human rights and democracy. This is shown by the action of the government in some
cases. The cases will be mentioned below consist of the analysis.

2.2. Example and Analysis


1. Freedom of expression
The freedom of expression (including speech, media, and public assembly) is an
important right and is given special protection, as declared by the First Amendment of the
constitution. According to Supreme Court precedent, the federal and lower governments
may not apply prior restraint to expression, with certain exceptions, such as national
security and obscenity. Legal limits on expression include:
- Solicitation, fraud, specific threats of violence, or disclosure of classified
information
- Advocating the overthrow of the U.S. government through speech or
publication, or organizing political parties that advocate the overthrow of the
U.S. government (the Smith Act)[103]
- Civil offenses involving defamation, fraud, or workplace harassment
- Copyright violations
- Federal Communications Commission rules governing the use of broadcast
media
2. Prohibits any investment for China (November, 14, 2020)
The president of US, Donald Trump, has signed the executive order of citizens
investment prohibition for China. He claimed this is only being a supply or support for
China’s military and security. This is for protecting the democracy and China’s military
expansion since China is a communist nation. Trump said that China is the biggest threat
for US and global democracy.in addition, the new president of US, Joe Biden, also has a
plan to put more pressure on China’s trade and security. This order will take effect on
January 11, 2021.

3. Supporting the 3 pro-democracy Hong Kong activists (December, 6, 2020)


The US Minister of Foreign Affair, Mike Pompeo, opposed the decision of Hong Kong
government for imprisoned the 3 pro-democracy Hong Kong activist and forbid them to
join the election for 5 years. He said, "Courts are used to silence dissent. That is a
hallmark of an authoritarian regime that fears free speech and the freedom of thought of
its own people." He add, "Hong Kong people should be free to exercise their rights
guaranteed under the Constitution, the Sino-British Joint Declaration, United Nations-
registered treaties, and the Universal Declaration of Human Rights."

Those two examples shows that US really against the communist authoritarian system.
They prevent the spread of communism from the China, not only China they also against the
political system of North Korea, Russia, etc. They uphold the democracy principle by support the
pro-democracy activist and oppose the limitation of speech. Furthermore, this is implemented the
human rights to speech and freedom of thought.

CONCLUSSION

3.1. Conclusion
The application of the US that implemented the principle of human rights and democracy
can be seen in how the government response to some cases and the policy that they made for the
state.
