中兴通讯出口管制合规一页纸
--以下内容适用于所有参与到中兴通讯项目的外包商人员
一、外包商人员接触物项须知：所有接触到中兴通讯物项的外包商人员，需按照如下要求落实：

1. 严格按照中兴通讯项目组的要求把物料从库房运送到指定地点，不得擅自转移到其他地点；

2. 在工程现场或运输途中，外包商人员必须妥善保管中兴通讯的物项，不得出借给第三方或交由未经授权
的人保管；

3. 项目实施过程中若发现物项丢失或损毁需要立即报告中兴通讯。

二、危险信号：如果遇到如下危险信号请暂停业务并立即报告中兴通讯：

1. 客户请求电话来源于“受制裁国家/地区”；

2. 设备包装上或相关物流单据上有在“受制裁国家/地区”运输的信息；

三、记录保存：所有涉及到中兴项目文档的外包商人员，需按如下要求进行记录保存：

1. 按照中兴业务规范要求，及时将业务中相关记录（包括纸质和电子记录）传递给中兴人员或保存在中兴系
统；

2. 不得弄虚作假、伪造或编撰与实际业务不符的文档记录，需完整、清晰、准确的提供相应文档记录。

四、出口管制分类编码（“ECCN”）：

作为合规工作的一部分，中兴通讯向客户和业务合作伙伴提供物项所适用的出口管制分类编码
（“ECCN”）、含有美国原产受控成分的物品的最小占比计算、以及受《出口管理条例》管辖的产品的其他出

五、中兴通讯出口管制合规红线：

1. 中兴通讯禁止进行任何涉及受制裁国家/地区和受制裁国家/地区主体的业务,即使业务发生地不在受制
裁国家/地区(伊朗，古巴，叙利亚，朝鲜，克里米亚地区)。

2. 中兴通讯禁止任何涉及受限制主体的业务，除非业务是合法的且获得首席出口管制合规官或其指定人员
批准。

3. 中兴通讯禁止开展任何涉及军事用途的业务，在获取出口管制合规部审批之前禁止开展涉及军事主体、
武装警察、核工业的业务。

4. 中兴通讯禁止参与涉及侵犯人权或非法侦听/监控的业务。

六、举报：如果有合理理由怀疑任何违规行为，可以向中兴通讯进行举报，举报方式如下：

ZTE Export Control Compliance Highlights

I. Instructions for Subcontractors that Have Access to ZTE's Items:

The subcontractors who have access to ZTE's items during the project
implementation process shall comply with the following requirements:
Transport materials from the warehouse to the specified places in strict accordance
with the requirements of the ZTE project team, and do not transfer the materials to
other places without authorization.
Keep ZTE's items properly and do not lend them to any third party or leave them
to any unauthorized person in the process of the engineering construction or
transportation.
Report the situation to ZTE immediately if any material is damaged or missing in
the project implementation process.
II. Red Flags:
If any of the red flags below arises, put the business activity on hold and report it
to ZTE immediately:
A call is from a customer in a "sanctioned country/region".
Packages or related shipping documents of materials contain information about
shipment in "sanctioned countries/regions".
III.Recordkeeping:
All subcontractor personnel who involved in documents submission of ZTE project
should keep records in accordance with the following requirements:
1. In accordance with ZTE service specifications, deliver the related records
(including printed and electronic records) to ZTE personnel or save them in the ZTE
system in a timely manner.
2. It is not allowed to falsify, forge, or compile a record that is inconsistent with the
actual business. The corresponding record shall be provided completely, clearly, and
accurately.
IV. Export Control Classification Number ("ECCN"):
As part of the compliance work, ZTE provides the customer and business partner
with the Export Control Classification Number ("ECCN") applicable to the items, the de

minimis calculation of items containing U.S.-origin controlled components and other

export control information of the products subject to Export Administration
Regulations. Please refer to ZTE website for ECCN details:

V. ZTE Export Control Compliance Red Lines:
ZTE is prohibited from conducting any business involving sanctioned
countries/regions and parties in sanctioned countries/regions, even if the business is
not in the sanctioned countries/regions (Iran, Cuba, Syria, North Korea, and the Crimea
Region).
ZTE is prohibited from any business involving restricted parties unless the business
is lawful and approved by the Chief Export Compliance Officer or his designee.
ZTE is prohibited from any business involving military end-uses, and prohibited
from any business involving military entities, armed police, or nuclear industry unless
the business is approved by the Export Control Compliance Department.
ZTE is prohibited from engaging in any business involving human rights violations
or unlawful interceptions/surveillance.

KEPATUHAN EKSPORT KONTROL ZTE

I. Instruksi untuk subcontractor yang memiliki akses ke Item ZTE:

Subcontraktor yang memiliki akses ke item ZTE selama proses implementasi proyek harus
mematuhi persyaratan berikut:

Mengangkut material dari gudang ke tempat-tempat yang ditentukan secara ketat sesuai
dengan persyaratan tim proyek ZTE dan tidak memindahkan material ke tempat lain tanpa izin.

Menyimpan barang-barang ZTE dengan benar dan jangan pinjamkan kepada pihak ketiga
manapun atau serahkan kepada orang yang tidak berwenang dalam proses konstruksi teknik
atau transportasi.

Laporkan situasi ini segera ke ZTE jika ada material yang rusak atau hilang dalam proses
implementasi proyek.

II. Bendera Merah:

Jika salah satu tanda bahaya di bawah muncul, tunda aktivitas bisnis dan segera laporkan ke
ZTE:

Panggilan telepon berasa; dari pelanggan di “negara/wilayah yang di kenai sanksi”.

Paket atau dokumen pengiriman material terkait berisi informasi tentang pengiriman di
“negara/kawasan yang terkena sanksi”.

III. Pencatatan:

Semua personel subcontraktor yang terlibat dalam penyerahan dokumen proyek ZTE harus
menyimpan catatan sesuai dengan persyaratan berikut:

1. Sesuai dengan spesifikasi layanan ZTE, kirimkan catatan terkait (Termasuk catatan cetak
dan elektronik) ke personel ZTE atau simpan di sistem ZTE tepat waktu.

2. Tidak diperbolehkan memalsukan atau menyusun catatan yang tidak sesuai dengan bisnis
yang sebenarnya. Catatan yang sesuai harus diberikan secara lengkap, jelas dan akurat.

IV. Nomor klasifikasi Kontrol Ekspor (ECCN)

Sebagai bagian dari pekerjaan kepatuhan, ZTE memberi pelanggan dan mitra bisnis Nomor
Klasifikasi Kontrol Ekspor (ECCN) yang berlaku untuk item, penghitungan deminimis untuk ite,
yang mengandung komponen yang dikendalikan asal AS dan informasi kontrol ekspor lainnya
dari produk tunduk pada Peraturan Administrasi Ekspor. Silahkan merujuk ke situs web ZTE untuk

V. Garis Merah Kepatuhan Kontrol Ekspor ZTE:

ZTE dilarang menjalankan bisnis apapun yang melibatkan negara/wilayah yang terkena
sanksi dan pihak-pihak di negara/wilayah yang terkena sanksi, meskipun bisnis tersebut tidak
berada di negara/wilayah yang terkena sanksi (Iran, kuba, Suriah, Korea utara, dan wilayah
krimea)

ZTE dilarang melakukan bisnis apapun yang melibatkan pihak terlarang kecuali jika bisnis
tersebut sah atau di setujui oleh Kepala Pejabat Kepatuhan Ekspor atau orang yang ditunjuk.

ZTE dilarang melakukan bisnis apapun yang melibatkan penggunaan akhir militer dan
dilarang dari bisnis apa pun yang melibatkan entitas militer, polisi bersenjata atau industri nuklir
kecuali jika bisnis tersebut disetujui oleh Departmen Kepatuhan Kontrol Ekspor.

ZTe dilarang terlibat dalam bisnis apapun yang melibatkan pelanggaran hak asasi manusia
atau intersepsi/pengawasan yang melanggar hukum.
