PROPOSED POLICY:

DENR ADMINISTRATIVE ORDER NO. 2023 -______

SUBJECT: STANDARD PROCESSING TIME OF LAND ADMINISTRATION AND


MANAGEMENT SYSTEM – INSPECTION, VERIFICATION AND
APPROVAL OF SURVEY PLANS (LAMS-IVAS)

Pursuant to the provisions of Republic Act No. 11032, otherwise known as the “Ease
of Doing Business and Efficient Government Service Delivery Act of 2018”, and in line with
the objectives of DENR Administrative Order (DAO) No. 2010-18 on improving the
management of land information through the adoption of the Land Administration and
Management System (LAMS) Philippines, the policy on the standard processing time of the
inspection, verification and approval of survey plans is hereby prescribed:

SECTION 1. Objective. This order aims to ease the burden to the transacting public by
realizing the delivery of quality and efficient land administration services, through the
standardization of the processing time of LAMS-IVAS in all Regions, and the adoption of the
following measures:

1.1. Laying-out the standard stages in the conduct of IVAS;

1.2. Identification of the critical stages that involve multiple tasks, which extend the
processing time of LAMS-IVAS transactions; and

1.3. Use of highly technical application, as defined by R.A. 11032, to classify LAMS-
IVAS transactions, and using this classification to prescribe the maximum processing
time, in order to balance the expectations of the transacting public with the
commitment of DENR in providing quality and efficient public service.

SECTION 2. Scope and Coverage. This order shall cover all kinds of surveys of public and
private lands submitted to the DENR Regional Offices for verification and approval. (As
prescribed in DMC 2010-13)

SECTION 3. Definition of Terms. The following terms as used in this order shall be
defined as follows:
a) Inspection, Verification and Approval of Surveys (IVAS) - is a system
designed for the tracking of the verification and approval process of land
surveys at the DENR Regional Offices. It has special GIS functionalities to
facilitate automated checks which aid in the automated verification process;
b) Highly Technical Application – an application which requires the use of
technical knowledge, specialized skills and/or training in the processing
and/or evaluation thereof (as defined in R.A. 11032);

c) Simple Transactions – applications or requests submitted by applicants or


requesting parties of a government office or agency which only require
ministerial actions on the part of the public officer or employee, or that which
present only inconsequential issues for the resolution by an officer or
employee of said government (as defined in R.A. 11032);

d) Complex Transactions – applications or requests submitted by applicants or


requesting parties of a government office which necessitate evaluation in the
resolution of complicated issues by an officer or employee of said
government office, such transactions to be determined by the office concerned
(as defined in R.A. 11032);

e) Simple Subdivision – subdivision survey of titled property into nine(9) or


less parcels of land;

f) Complex Subdivision - subdivision survey of titled property into ten (10) or


more parcels of land;

g) Survey Returns – refers to the complete survey documents required for the
approval of survey plans, such as, but not limited to, survey plan, transmittal
of survey returns, field notes cover and inside, traverse computation, Lot Data
Computation (LDC), Digital Land Survey Data (DLSD), boundary
computation, title and reference plans;

h) Agency Action – refers to the corresponding actions of an assigned officer or


employee, relative to the applications and/or requests submitted by the client;
and

i) Transaction Pipeline – includes all on-going and pending LAMS-IVAS


transactions;

SECTION 4. Standard Stages in the Conduct of IVAS.

4.1. Preliminary Verification of the Survey Returns – at this stage, the completeness of
the application is evaluated. A pro-forma checklist of minimum requirements shall
be used to check if the survey returns submitted is complete. Incomplete Survey
Returns upon initial evaluation shall be disqualified for acceptance and shall be
returned with attached pro-forma “X-FORM” indicating the lacking documents for
compliance.

A No-To-Follow rule will be strictly imposed. All digital, supplementary and


documentary requirements should be complete upon submission, otherwise,
applications with lacking requirements shall not be accepted.
As prescribed in R.A. 11032, the processing time will commence from the date that
the complete application was received.
4.2. Acceptance of Survey Returns in LAMS-IVAS – after passing the preliminary
evaluation and upon payment of fees, the DLSD file shall be uploaded in the LAMS
kiosk and a unique LAMS-IVAS transaction number to the application. Afterwards,
the survey returns are endorsed for technical verification.

Acceptance shall mean that the application will be acted upon by the agency. The
First-In-First-Out (FIFO) rule shall be followed, except during special instances,
when over-riding is allowed.

4.3. Technical Verification – at this stage, the technical correctness of the submitted
survey, as well as, the compliance to the technical standards, is ensured. This stage
includes the following sub-stages:

(1) Records Unit - Researching, encoding and verifying the subject/mother lot
against approved DENR reference records.
(2) Projection Unit - Projection of the submitted survey plan against the DCDB,
Cadastral Maps (CM) and Projection Maps.
(3) Verification Unit - Verification of the submitted LDC against the uploaded
DLSD and reference title/plan.

4.4. Final Verification – final evaluation of plans and documents. If all are in order, the
head final verifier shall countersign the verified survey plan.

4.5. Approval - the Asst. Chief SMD shall recommend and countersign the survey plans,
for final approval of the Chie SMD, as prescribed in DAO-2022-13. After final
approval, a survey number will be assigned and inscribed on the approved survey
plan.
The Narrative Technical Description will be prepared by the front desk and certified
by the Chief SMD.
Study the possibility of delegating the final approval to the Asst. Chief SMD on
special occasion/s whenever the Chief SMD is on Official Duty preventing him/her in
approving the verified plans submitted.

SECTION 5. Archiving of Approved Survey Returns. The approved survey returns shall
be scanned and transmitted to the Land Records Section. This is to ensure that LAMS
database is kept up-to-date.

SECTION 6. Rejection, Withdrawal and Cancellation of Survey Returns.


6.1. Rejection - Survey plans accepted for verification and approval, with pending
adverse
findings during the verification shall be automatically rejected forty (40) days after the
issuance of the pending letter, if the reason for the required corrections or documents, as
the case may be, is not complied with.
All SRs found to have no compliance within the specified grace period shall be rejected
by the LAMS, with the corresponding Rejection Order signed by the Chief SMD. All
records whether digital or paper based are to be dropped from the records.

Issuance of the pending letter shall toll/interrupt the running period of the transaction.
Should the Geodetic Engineer wish to comply with the lacking requirements, the survey
returns together with the attachments shall be resubmitted and shall treated as new
transaction.

6.2. Withdrawal - Survey returns shall only be allowed to be withdrawn when a written
request from the concerned Geodetic Engineer, who executed the survey, is submitted and
received by the Office.

SECTION 7. Standard LAMS-IVAS Processing Time. Verification and approval of


survey plans are highly technical application, categorized further as simple or complex
subdivisions.

This order shall prescribe twenty (20) working days as the maximum processing time for
simple subdivision surveys. The maximum time prescribed above may be extended for
twenty (20) working days for complex subdivisions surveys.

SECTION 8. Monitoring and Reporting. All activities from submittal up to approval shall
be monitored using LAMS On-line Transaction Portal module. The module shall have the
capability to prepare statistical report to determine the current efficiency of the LAMS-IVAS
Transactions.

In the course of monitoring the accomplishments under LAMS-IVAS, all SRs inspected,
verified and approved, withdrawn and rejected from verification are to be considered as
completed transactions under the system.

SECTION 9. Land Administration and Management System – Inspection, Verification


and Approval of Surveys (LAMS-IVAS). Corresponding adjustment relative to the system
of LAMS-IVAS shall be undertaken to conform to this Order.

SECTION 10. Separability Clause. If any provision of this Order shall be declared
invalid or unconstitutional, such declaration shall not affect the validity of the remaining
provisions of this Order.

SECTION 11.Repealing Clause. All orders, circulars, memoranda, and other issuances
inconsistent herewith are hereby repealed and/or amended accordingly.

SECTION 12. Effectivity. This order shall take effect fifteen (15) days after the
publication thereof in a newspaper of general circulation and upon acknowledgement of the
receipt of a copy thereof by the Office of the National Administrative Register (ONAR).
