Dear Sir,

I the undersigned, XXXXXXX residing at Flat No. XXX, Xst Floor, XX Building,
Ramayan Nagar, Near Radhabai Chowk, Ulhasnagar – 421003, Dist. – Thane have to address
you as follows:

1. I had Purchased Xguard Booster (Water Filter cum Purifier - Machine) (XXXXXXX)
bearing Item Code No. XXXXXXXX, DC No. XXXXX, Order No. XXXXXXX dated 23-06-
2013, Customer ID No. XXXXXX, from you for Rs. 9190/- (Nine Thousand and Ninety
only) which amount I duly paid vide cheque No. XXXX dated 21-06-2013 drawn in
favour of Ureka Forbes Ltd., on Punjab National Bank, Ulhasnagar – 4 Branch.

2. The said Machine was duly delivered on 23-06-2013 at my residence on the above
mentioned address through courier for which I have accepted the delivery.

3. A person from your company came to install the said Machine in my flat on 24-06-2013.
After installation he started the said machine, but unfortunately the said apparatus did
not functioned. He advised me to refer the matter to the company and contact the sales
agent Mr. XXXXXXX, who had explained the benefit of sales Machine which induced me
to buy the Machine.

4. Accordingly I have contacted your sales agent XXXXXXX on 25-06-2013 and apprised
him of the non-functioning of the said Machine supplied by your company. Mr.
XXXXXX advised me to lodge the complaint with the company.

5. Accordingly on 26-06-2013 I have lodged a complaint with your company vides

complaint No. 7XXXXXX3 & got the assurance that the representative of the company
will visit my residence and replace the machine.

6. After few days Engineer of your company came to my home & inspected the said
Machine and opined that the Machine is defected. I was assured that the Machine shall
be replaced.

7. I have contacted your sales representative informing both of you that, the said engineer
could not make the said Machine (filter-cum-purifier) operative as the same is defective
and required to be replaced.

8. The said defective Machine is not replaced till date, despite my various reminders &
request e.g.:
i) On 01-07-2013 to Cutomer Care Center & a new complaint was registered on 01-
07-2013 with complaint No. 88621142.
ii) On 03-07-2013 to Mr.XXXXXXX.
iii) On 05-07-2013 to Mr. XXXXXXX.
iv) On 06-07-2013 to Mr. XXXXXXX – The service person (Mr. XXXXX) from your
company visited my residence & said that the machine is not working & tried to

 solve the problem but the problem was not solved by him & he has asked me to
write the problem on the job card & assured that the machine will be replaced.
v) On 11-07-2013 to Customer Care Center & got the assurance from MrXXXX that
the complaint will be addressed.
vi) On 15-07-2013 to Customer Care Center & got assurance that by evening the
problem will be addressed & the same will be reported to the Head of
Department – Miss XXXXXXXXXXXX.
vii) On 16-07-2013 or On 17-07-2013 at Cutomer Care Center spoken with XXXXX
and got the new complaint No. 8XXXXXX5 and he said within 2 hours the person
from his company will call back, but nothing happened.

9. I was induced by your sales agent to buy the said filter on promises that the product will
be fine, useful and best quality. But your Machine is defective and non-operative right
from the date it was installed. Inspite of my several complaints, reminders to replace the
said defective Machine supplied to me by you, is not replaced.

10. I request & demand to replace the said Machine with the new and functioning Machine
(filter-cum-purifier); OR-Else refund the cost of the said filter cum purifier amounting to
Rs. 9190/-.

11. In the circumstances if you fails to comply with my request within seven days of the
receipt hereof, I shall be constrained to take recourse to law and institute suitable legal
proceedings – Civil and Criminal, in the dispute at your cost & consequences.
