COMMUNIQUÉ ON UNDESIRABLE SUBSTANCES IN FEED

(COMMUNIQUÉ NO: 2014/11)

Objective

ARTICLE 1 - (1) The purpose of this Communiqué is to determine the issues related to undesirable substances
in animal feed.

Scope

ARTICLE 2 - (1) This Communiqué is a Communiqué on feed additives, supply and use of feeds to the market,
pesticide residues in cereals, fruits, vegetables, herbal products and animal foods, public health and animal health.
It covers the issues related to undesirable substances in feeds, without prejudice to the provisions of the legislation
on veterinary products.

Basis

ARTICLE 3 - (1) This Communiqué,

a) Based on the third paragraph of Article 21 of the Veterinary Services, Plant Health, Food and Feed
Law No. 5996 dated 11/6/2010 and the Regulation on the Placing on the Market and Use of Feeds,

Definitions

ARTICLE 4 - (1) In the implementation of this Communiqué;

a) Ministry Ministry of Food, Agriculture and Livestock,

b) Daily ration: The total amount of feed per day, calculated at 12% moisture content, required by an
animal of a given species, age and yield to meet all nutrient requirements,

c) Animal: Vertebrates and invertebrates, including aquatic animals, reptiles and amphibians,

ç) Products used as animal feed: Feed ingredients, premixes, feed additives and other products used as animal
feed,

d) Compound feed A mixture of at least two feed ingredients, with or without feed additives,
in the form of complete or complementary feed for oral feeding of animals,

e) Intervention threshold value: The amounts determined by the Ministry that should
be intervened for undesirable substances in feeds or whose source should be identified and
monitored,

f) Placing on the market: The placing of feeds on the market with or without charge,
g) Premix: A mixture of feed additives not fed directly to animals, or a mixture of one or more feed
additives with a feedstuff or water used as a carrier,

ğ) Complementary feed: Compound feed that is rich in certain substances in terms of its composition and is
sufficient for the daily ration when used with another feed,

h) Complete feed: A feed mixture that is sufficient in composition for the daily ration,

ı) Overrun: The level of an active ingredient or product that passes through the previous batch in the batch
immediately following the production of one batch in a particular section of the production line,

i) Feed: Any substance or product, including processed, partially processed or unprocessed feed
additives, used for oral feeding of animals,

j) Feed additive: Substances, microorganisms or preparations, other than feedstuffs and premixes, added to
feed or water, having one or more of the functions defined for feed additives,

k) Unwanted substances in feeds: Substances, other than pathogenic agents, present in feeds that pose a
potential hazard to animal or human health or the environment or adversely affect animal production,

l) Feedstuffs: Organic or inorganic substances, with or without feed additives, which meet the nutrient
needs of animals, which are natural, fresh, preserved products of plant or animal origin and products obtained
from them as a result of industrial processing, and organic or inorganic substances used directly or processed for
oral feeding of animals, as carriers in premixes or in the preparation of compound feeds,

Feed safety

ARTICLE 5 - (1) Feed shall only be placed on the market if it is of reliable and commercially appropriate
quality and, when used for its intended purpose, does not pose a danger to human health, animal health and the
environment and does not adversely affect animal production.

(2) Feeds containing undesirable substances above the maximum limits specified in Annex-1 of this
Communiqué are considered as unreliable feed according to the first paragraph.

Limits for undesirable substances

ARTICLE 6 - (1) The undesirable substances listed in Annex 1 are only allowed in feeds that comply with the
specified conditions.

(2) When undesirable substances in feeds are detected at high levels or the maximum level

Constraint in practice

ARTICLE 7 - (1) Feeds containing undesirable substances in amounts exceeding the maximum level cannot
be mixed with the same or different feeds for dilution purposes.
(2) Supplementary feeds may not contain undesirable substances above the levels specified for complete feeds
in the daily ration, unless there are special provisions, taking into account the recommended amounts of use.

Detoxification process

ARTICLE 8 - (1) When detoxification is requested by the feed operator, the Ministry examines the relevant
implementation procedure. It decides whether this procedure is applicable or not.
Products detoxified according to this procedure must comply with the requirements set out in Annex 1. The
implementation of this procedure is carried out under the supervision of Ministry control officers.

Administrative sanction

ARTICLE 9 - (1) In the event that feeds that are suitable according to this Communiqué contain undesirable
substances not included in the Communiqué, action shall be taken within the scope of the Veterinary Services, Plant
Health, Food and Feed Law No. 5996.

Repealed legislation

ARTICLE 10 - (1) The Communiqué on Undesirable Substances in Feed (Communiqué No: 2005/3)
published in the Official Gazette dated 5/2/2005 and numbered 25718 has been repealed.

Enforcement

ARTICLE 11 - (1) This Communiqué shall enter into force on the date of its publication.

Execution

ARTICLE 12 - (1) The provisions of this Communiqué shall be executed by the Minister of Food, Agriculture
and Livestock.
