Sir,
It is most respectfully showeth: -
1. That the applicant is peace loving citizen resident of Delhi.
2. That the father of the complainant filed the Mandamus Writ
petition against the accused vide no. 3656/2021 before the
Hon’ble High Court of Delhi.
3. That the in the Writ petition Hon’ble High Court of Delhi Order
Dated 15/09/2022 directed to MCD to take requisite action
expeditiously preferably with in a period of 3 months from the
date of order, further the Hon’ble High Court of Delhi ordered
SHO P.S. Tilak Nagar to provide police assistance as and when
sought by M.C.D.
4. That it is pertinent to mention that Hon’ble High Court of Delhi
also ordered M.C.D. and SHO P.S. Tilak Nagar to also ensure that
no construction activity is carried out at the subject property
unless in accordance with Law.
5. That today complainant got information that the accused person
against the order of Hon’ble High Court of Delhi has carried out
construction in the property in question.
6. That the complainant went personally to the said property and
found that the construction work is going on.
7. That complainant dialed 100 no. and police at around 11:30 AM
and police stopped the on-going construction work.
8. That police instructed the accused to stop ongoing construction
and to remove the repaired area which was punctured by MCD.
9. That on behalf of the police officer accused agreed on the terms
but out side police post accused threatened the complainant that
tonight accused will finish the construction work and will sell the
said property in question within 2 days.
10. That the complainant went to PS tilak nagar and police official
refused to accept the the complaint and guided the complainant
to meet the officer incharge of police post Tila vihar.
Please take necessary action against the accused person.
