DECLARATION
This declaration is made regarding the internship report which
has been prepared and drafted by Shahnoor Ali under the supervision
of Adv. N.A. Gattoo, on record at Gattoo and Associates, practicing
at Jammu Wing of Jammu and Kashmir High Court and District and
Sessions Court Jammu. It contains the work accomplished during the
internship which was assigned to Shahnoor Ali during the internship.
The work was done in respect of the partial fulfillment of the
requirement for the award of Degree of B.A. LLB.

This internship report has not been submitted either in whole or


in part to any other law university or affiliated institute under Jammu
University, recognized by the Bar Council of India for the award of

Brief about chamber visit:
INTRODUCTION
First of all, I would like to express my sincere thanks to Mr.
N.A. Gattoo, Advocate, Jammu and Kashmir High Court. He helped
me to go into the subject matter within a limited time without whose
help it would not have been a successful one.

Internship fulfills an important component of both academic and


practical education in law. The integration of professional experience
into the learning process is highly effective in developing the
understanding of the law in action, as I am able to observe and
perceive the relevance and application of theory to practice
consequently, the program is not simply “work experience” but a
significant educational experience.

In a workspace setting I will be exposed to the reality of the law


in all its dimensions – the integration of different are of law, policy
issues, the application and development of skills to analyze and
resolution of client’s concerns, ethical responses to situations which
arise unexpectedly and spontaneously, issues of professional
responsibility including responsibility of clients and case
managements and the operation of the government and court system
in the legal process.

The legal internship program is not designed to teach students how to


be good lawyers (or how to be lawyers at all), the objectives are to:
1. Get exposed to the law in operation in contexts where one
comes to perceive aspects of law which cannot be learned from
reading or hearing about it;
2. Allow to perceive ways in which the formal learning you
acquire at college may be applied in practice and thereof to
develop an appreciation of the practical dimensions of legal
principles.
3. Enable to relate the different areas of legal practice to the
importance of developing the skills of legal research,
communication, drafting, practice, management and problem-
solving.
4. Enable to observe and reflect upon the values, ethical standards
and conduct of the legal profession in practice and to develop
own attitudes of professional responsibility.

The classroom study and practical training in the shape of legal


internship in the field of law are considered to be two sides of a
coin. The legal profession is one the professions which is
considered incomplete without the practical training. An additional
benefit of the internship program is that it provides you the
opportunity to observe the way in which law operates in a
practical world.
CHAMBER VISIT EXPERIENCE
I attended Advocate N.A. Gattoo’s Chamber on 1 st April, 20123
and he very pleasingly explained how to maintain an office chamber
and maintain attire and decorum in the Court.

Advocate N.A. Gattoo explained that an advocate must have a


fixed client set that is know the type of cases one is comfortable to
fight and defend their client in the court and provide comfort outside
the Court.

Sir also said that an advocate must, at all times be well versed
with the issue/s of their client and own a laptop and Bare Acts and
Reference Books and record the dates of your clients and cases for co-
ordination point and maintain a to-do list in your Diary.

It was taught to me on how to do research work for particular


problems, Indian Kanoon is a free website which is very useful for
searching for case laws.

I came across different books like AIRs, Journals,


Commentaries, Bare Acts and many more, which help advocate in
gaining knowledge about the never ending law and help in doing
research for particular problems of the client.

The advocate said that the counsel must at all time keep their
clients satisfied and must listen to their grievances with utmost
attention. The counsel must examine all the proofs and evidences
provided to them and shall collect all the information possible to
defend their client.

Basic Requirements for the Internship:

1. A diary along with pen.


2. A laptop.
3. Eager for research and gaining knowledge.
4. Must complete the daily tasks with diligence.
5. Basic knowledge of MS word, PowerPoint etc.

There were a lot of good things during this internship which are as
follows:

1. Internship certificate.
2. Exposure to the litigation world.
3. Learned about Criminal, Civil and Writ Laws.
4. Learned about manner of Documentation.
5. Did huge amount of research on Civil laws.
6. Understanding of practical aspect of legal field.
CLIENT INTERVIEW

 Introduction:

Interviewing means initial consolation between a prospective


client and the advocate (empathy, genuineness, listening and
probing).

Counseling means identifying client’s alternatives and priorities


help in choosing constructive options (creativity, foresight,
analysis, explanation, co-operation and advice).

Negotiation means implementation of goals set during


counseling, without litigation (strategy, persuasion and
conciliation skills).

 Characteristic of Interviewing the Client:


a) Interviewing the client is the starting point for establishment
of Advocate – Client relationship.
b) Interviewing techniques promote inter-personal
communicative skills which are critical for lawyering
process.
c) Helps in effective presentation of client’s case through
proper documentation.
d) Highly useful for lawyering outside the Court or to
undertake alternate dispute resolution.
e) It is useful projective technique.
f) The behavior of the client and the accuracy of his statements
can be meaningfully assessed by the advocate.

Interviewing the client may be defined as an effective informal verbal


or non-verbal conservation, initiated either by the client or advocate in
order to ascertain the legal problem of the client for which the
solution is to be found.

It involves gestures, facial expressions, glances, inflections in the


voice that are often found to be the sources to establish the truth. Even
silence can speak volumes during these interviews.

 Goals of interviewing clients:


a) Get a sense of the client’s situation and legal questions/needs.
b) Build trust.
c) Assess client’s goals.
d) Assess credibility.
e) Be sensitive to possible disabilities.
 Basics of legal interviewing:
a) Motivate the client’s participation (develop rapport through
active listening).
b) Meet and greet.
c) Formalities like asking for names, personal details,
confidentiality.
d) Use questioning techniques appropriate to the subject matter
(open-ended, narrow, yes/no leading questions).
e) Allow the client to tell the story initially.
f) Structure the interview.
g) Verify all the gathered information with the client.
h) Conclude the interview on a good note.
OBSERVATION OF DOCUMENTS AT
LAWYER’S OFFICE

During my internship period in the chamber of Gattoo and


Associates, my senior advised me to maintain my own diary for all
the court visits, observations and the case briefs. I was advised to
keep factual accounting of my experience of what I had done, seen
and heard.

During my internship period I had asked my senior to provide


me important court documents for observation and learning purposes.
During my internship I came across different pleadings, judgements
and different legal documents like notices, applications, affidavits etc.

I was asked to proof read the case files and once I got a hold
over different documents, I was even asked to draft different like
application for certified copies, application for condonation of delay,
legal notices etc.

I learned that it is very important to be always reading cases and


new enactments and keep myself up-to-date while dealing with a case
read the facts of the case file very carefully and try to find all the
loopholes and then use them against the opposite party.
Experience during the internship:

CLIENT INTERVIEWING

From the very beginning of my BA.LLB course I have had a


curiosity to know about the client interviewing, by this internship I
have learned how to communicate with the clients in the future days,
in this regard I have to thank my senior Advocate N.A. Gattoo, he
was so friendly towards me and he explained everything about client
interviewing to me. In the course of my internship, I attended a few
client interviews in person and got to learn a lot from them. I have
learned how to deal with the client to collect proper information in
context to the case.
I was told that it is vital to gain the trust of the client and to
assure them that the justice would be served. The most important
aspect of client interviewing is collection of all necessary documents
related to the case from the client and to raise further questions after
going through each and every document. After going through all the
information and the documents, advocate has to explain to the client
what would be the remedy of the case.
Through the course of my internship I have learned the basics of
how client interviewing is done and how statutory provisions of
different Acts are applied in relation to the problems of the client.
EXPERIENCE AND LEARNING

The objective of a legal internship is to better understand


what being a lawyer involves, and the best way to do that is to
be around lawyers. I observed the partners and associates of
the chamber, in the court and bar rooms I observed the
colleagues of my senior and all the other lawyers and how
everybody addressed the court and learned a thing or two
from all of them.

While attending the court hearings I observed the other


court hearings too and used to not down every useful thing in
my diary which helped me in learning a lot of new things.
During the break time I used to spend most of my time in the
court library, as I feel like libraries and books are the best
friends of a lawyer.

Although I learned a lot of things throughout my


internship a few of them are:

1. How to manage time.


2. How I have to manage clients.
3. How I have to structure my diary and weekly
schedules.
4. What are the processes involved in managing a
case.
5. What is involved in the research process for a case
and which resources are to be used for the same.

Acting as a court room assistant will definitely be one of the


highlights to my internship. Debates in the moot court at the
college cannot even hold a candle to being in the thick of
things in a real courtroom.

It was perfect for me to have much exposure to the working of


the legal system in the society and it gave one a fair idea of the
working of the country’s legal system. I was able to fulfil the
objectives which I planned for obtaining during my internship. Later
on, sir gave me the internship certificate and letter of appreciation. He
enlightened me with his words of knowledge and blessings.

Dear Sir,

With modest regard I would like to draw your kind attention towards following few lines:

1. That I am the permanent resident of village Birshalla, Tehsil and Dist. Doda.

2. That in the year 2018 I was challaned by the police officials under Section 279, 336 of
RPC and 66/192 of MV Act and later than on 3/05/2019 I confessed the offence and the
honorable court fined Rs. 2,000 as a penalty.

3. That the above said offence is not covered under the ambit of moral turpitude.

4. That despite various oral as well as written requests to Station House Officer (SHO) Doda
for issuance of Character Certificate on my name but all the time, the said officer rejected my
request merely saying that you are convicted under above said sections.

5. That at last I have no other option left except to approach your good office for my
grievance.

6. That I am the sole bread earner of my family doing the work of a Contractor and my card
has expired on March, 2022 and could not be renewed due to non-issuance of character
certificate by the concerned police officials and due to which I was debarred from taking part
in the bidding process of any contract. Further I posses a Gun License vide no.
LM15291A7B60F19/67/DM/DODA which was expired on 29th of May, 2022 and which is
still pending for renewal before the Dist. Magistrate Doda due to non issuance of character
certificate.

In the backdrop of above mentioned submissions it is as such requested to your good office to
kindly issue me the Character Certificate so that I can avail the benefits from the above said
documents at an earliest. I shall remain highly thankful to you.
