I, MS. MADHURI DATTA TRAYA BEDEKAR, Age: 54yrs,

Occupation: Service, R/at: Madhuri Bedekar ,2021, Hanna Tower, Gaur
Saundaryam, Tech Zone 4, Gaur Chowk, Opp. Gaur City Mall, Greater
Noida West, Bishrakh, Gautam Buddha Nagar, Uttar Pradesh 201306 for
myself and Applicant No. 2 as her Power of Attorney do hereby state on
solemn affirmation as under:

1. I state that, Applicant No. 1 &2 are full blood sisters who live at
above mentioned addresses. The Applicant No. 1 is currently
working as contract basis teacher at Magic Billion at Naida.
Applicant No. 2 is working in Canada and working as Vice
President of 08763 Citi Canada Technology Services ULC,
Canada. The Applicant No. 2 is residing in Canada and cannot
attend hearing continuously so she has executed Power of
Attorney and given powers to Applicant No. 1 to appear and try
this application. The said power of Attorney is executed at
Consulate office of Toronto, Canada on 21/08/2023 having
reference no. 4643 and the same is attested with signature and seal
of Ministry of Government Services.

3. I state that, with reference to above mentioned family tree, Kirti

Dattatraya Bedekar, Apama Dattatraya Bedekar and Madhuri
Dattatraya Bedekar are full blood sisters. Their father Dattatraya
Sadashiv Bedekar died in 200 I in Pune and their mother named
Shubhangi Dattatraya Bedekar died in Delhi in 2012 and were
residents of India of ·which we are filing respective death
certificates. Applicants are filing the Central Government Health
Scheme card of Late Dattatraya Sadashiv Bedekar, which shows
that Late Kirti Dattatraya Bedekar and the applicants are sisters.

4. 1 state that, the above named sister Late Kirti Dattat.raya Bedekar
died on 19/12/2022 at Sahyadri Hospital, Shastri Nagar at Pune
and the san1e is registered and death certificate by Pune Municipal
Corporation has been issued. At the time of death she was 55 years
old and was residing at 8-5/30 I, Fortunate East Society, Thite
Nagar, Kharadi, Pune 411014. She was unmarried and she didn't
have any child.

5. I state that, deceased Kirti Dattatraya Bedekar have bank account

in State bank of India, at Kharadi branch of Pune having following
details:

Closing Balance Amount: Rs. 3,82,282/- (Rupees Three Lakh
Eighty Two Thousand Two Hundred Eighty Two Only)

6. I further state that the above mentioned bank account didn't have
any nominee.

7. I further state that as the Late Kirti Dattatraya Bedekar was not
ma1Tied and didn't have any children and a there was no nominee
at bank, for the transmission of the amount she had in the bank
account, the State Bank of India, branch Kharadi requested a ro .
succession certificate from the applicants. The Applicants are

class-II heirs of Late Kirti Dattatraya Bedekar according to Hindu

Succession Act, 1956 so Applicants being legal heirs can be
transmitted the amount in the bank account under the right of
succession under this act.

8. I state that, before the death of Late Kirti Dattatraya Bedekar, the
deceased had not executed any Will or Gift Deed regarding her
property.

9. I further state that, at the time of death didn't have any Class- I heir
according to Hindu Succession Act, 1956.

l 0. I state that, at the time of death, Late Kirti Dattatraya Bedekar was
unmarried and did not have any children so leaving behind the
Applicants as the Class- II legal heirs of the deceased as per
provision of Hindu Succession Act, 1956 which are as following :

11 . I state that this application for obtaining succession certificate

won't face any obstruction under Section 370 of Indian
Succession Act, 1925 or under any other law.

12.I state that there is no application pending for obtaining Succession

Certificate in any court or any Letter of Administration for
obtaining above mentioned amount.

13.I state that above mentioned amount m State Bank of India,

Kharadi Branch is self-earned/acquired property of Late Kirti
Dattatraya Bedekar.

14. Cause of action- arose when the Late Kirti Dattatraya Bedekar
died in Pune. The cause of action arose when State Bank Oflndia,

Kharadi Branch refused to transmit the amount from deceased

sister's bank account and requested the Applicants to obtain
succession certificate.

15. I further state that Late Kirti Dattatraya Bedekar was permanent
resident of Pune, also her place of death comes within local limits
of Pune Municipal Corporation and her property being money in
bank account is located at Kharadi, Pune within the jurisdiction of
this Hon'ble Court, so this court has every right to try and dispose
this application.

16. I state that there are no other legal heirs than the Applicants of the
Late Kirti Dattatraya Bedekar.

I 7. I state that, Late Kirti Dattatraya Bedekar was Hindu so the

Applicants being Class-II heirs of the deceased, they have right to
obtain the above mentioned amount in State Bank of India,
Kharadi Branch and Succession Certificate.

18.Court Fee- This application being miscellaneous type, we have

paid appropriate court stamp fee. Also Applicants are ready to pay
necessary court fee for obtaining succession certificate under
Maharashtra Court Fees Act, 1959.

15 . Application sent by applicant to the bank manager of State Bank of

India, Kharadi to get full amount disclosure of the deceased Late Kirti
Dattatraya Bedekar.

16. Reply by the chief manager of State Bank of India, Kharadi to the
Applicant with seal of the Bank.

17. Original copy of Central Government Health Scheme Card-

The Applicant visited the said bank at Kharadi, Magarpatta Branch to get
the statement of amount in bank account of late Kirti Dattatraya Bedekar.
But on asking, she was told to get this official informatio12 through e-mail.
So she complied with it by sending e-mail to the branch manager and got
response for the same.
I state that according to exhibit 6 I have published paper notice in the
newspaper and by exhibit 7, citation notice is affixed at the last known
address of the deceased and the same is written in the bailiff report, all of
which are presented with the documents produced for this application
before the Hon'ble court. Till today no one has approached/objected
toward the said application and property. So it is confirmed by the process
that the said Applicant No. l and 2 i.e. myself and my sister Aparna
Dattatraya Bedekar are sole legal heirs of the Late Kirti Dattatraya
Bedekar.

20. It is therefore prayed that,

along with that the amount present in the State Bank of

India, Kharadi Branch having Acc. No. 11901163904 or
the amount at the time of final order of this Hon'ble Court
be transmitted to the Applicants.
• To allow the amendment of this application at any stage
of this application.
• Any other just and equitable order be made in the interest of
justice.

Whatever stated above is true and correct to the best of my knowledge

and belief Also documents filed in support of this Application are also
true and correct to my knowledge and it is requested to read all the
