Under instructions from our client Mrs.K.Shajathi Begam, residing at


No.136/108, Rangarajapuram Main Road, Kodambakkam, Chennai – 600 024,
we issue this Contempt Notice to you as follows :-

1. That our client state that our clients are the absolute owners in
respect of the property situated at Block No.44, Chennai – 600 024,
Puliyur Village, Egmore Talukm Survey Nos.113/10, 113/5 and 13/9,
Paimas No.995 and 996.

2. That our client is in continuous possession and enjoyment of the said


property eversince. Our clients have submitted an application for
transfer of patta in their name in and by a representation dated
19.6.2019 to you to issue the Patta in favour of our clients.
3. That our client state that the DRO, Chennai has already passed a
detailed order on 12.02.2014 and had given certain directions to the

4. Tahsildar to carry out necessary changes in the records and to issue


patta based on the document submitted by our client after
ascertaining the ownership. That our client state that even though
this order was passed in the year 2014, till date you has not acted
upon the same inspite of the representation made to you. Therefore,
our client constrained to file writ petition W.P.No.10299 of 2020
before the Hon’ble High Court seeking for appropriate directions,
namely
“for issuance of a Writ of Mandamus, to direct the respondent to
implement the order of the District Revenue Officer, Chennai dated
12.02.2014 and to issue a patta in favour of the petitioner's name
without delay in respect of the property which is situated at Block
No.44, Chennai – 600 024, Puliyur Village, Egmore Talukm Survey
Nos.113/10, 113/5 and 13/9, Paimas No.995 and 996”

5. That our client state that His Lordship MR. JUSTICE N. ANAND
VENKATESH by an order dated 07.08.2020 directed you by
following order,
4. Taking into consideration the facts and circumstances of
the case and limited relief that has been sought for in the
present writ petition, there shall be a direction to the
respondent to consider the representation made by the
petitioner on 19.06.2019 and 12.02.2020 and deal with the
same strictly in accordance with law and in line with the
order passed by the

DRO, Chennai dated 12.02.2014 and pass final orders within


a period of eight weeks from the date of receipt of a copy of
this order. The petitioner is directed to make a fresh
representation to the respondent along with a copy of the
proceeding of the DRO, Chennai dated 12.02.2014 and also
all the other relevant documents and a copy of this order.

5. This writ petition is disposed of with the above directions.


No costs.

6. Our client submit that even though our client giving continues
representation to you to comply the above direction, you are avoiding and not
taking any steps to issue patta to my client. Our client submit that in view of
the long delay in issuing patta in favour of our clients, our clients are put to
untold hardship and suffering and is not in a position to enjoy the above said
property. Our client submit that you have miserably failed to pass an order in
respect of issuance of patta as directed by His Lordship MR. JUSTICE N.
ANAND VENKATESH within 8 weeks from the date of passing the order dated
07.08.2020 and thereby committed disobedience of the order passed by the
Hon’ble High Court.

Under these circumstances, we hereby call upon you to pass appropriate


orders as directed by the Hon’ble High Court by an order dated 07.08.2020

forthwith, failing which, our client will be constrained to initiate appropriate


contempt proceedings against you without any further reference, making you
liable for the all the costs and consequences incurred by our clients thereof.

For your ready reference, we enclose herewith the copy of the orders made in
W.P.No.10299 of 2020
