You (as defined in the AT&T Installment Plan) agree to the terms and conditions below that outline Your rights and
obligations under this limited agreement (“Agreement”) with AT&T permitting a Device (as defined in your AT&T
Installment Plan) return with the possibility of waiver of some or all the remaining AT&T Installment Plan balance
(“Return”). This Agreement permits Returns for the following: 1) early trade-in/turn-in program (as permitted under the
terms of your AT&T Installment Plan); 2) estate settlement (deceased account holder or authorized user); and 3) price
plan, feature or other material terms and condition change driving cancellation of wireless service associated with the
Device on an AT&T Installment Plan; all of the foregoing Return options may be modified or canceled at any time in
AT&T’s (or its assignee/designee’s) sole discretion. With a Return, You agree, represent, warrant, accept, and
acknowledge the following:

1. The Device is not lost or stolen, and you are the sole and rightful owner of or otherwise expressly
authorized to return the Device which is free of third-party liens or claims.
2. The unique numeric identifier for the Device being returned and account number may be provided to law
enforcement.
3. If Return is unsuccessful, You must pay the remaining installment charge/balance under the AT&T
Installment Plan for the Device.
4. Returned Devices (and any other items) are non-returnable to You. AT&T, its subsidiaries, affiliates, designee(s),
vendors and suppliers are not able and will not return any Device back to You. You are transferring Device
ownership rights to AT&T, its subsidiaries, affiliates, designee(s), vendors, and suppliers without
ability for Device or information return to You.
5. You have: 1) ERASED ALL PERSONAL, CONFIDENTIAL OR SENSITIVE INFORMATION (“INFORMATION”) FROM AND
DEACTIVATED APPLICATIONS AND SERVICES ON THE DEVICE; 2) REMOVED THE SIM CARD AND MEMORY CARD; AND
3) PERFORMED A FACTORY RESET. AT&T, ITS AFFILIATES, ITS DESIGNEES, VENDORS AND SUPPLIERS DO NOT
GUARANTEE AND ARE NOT RESPONSIBLE FOR REMOVAL OF INFORMATION ON THE DEVICE. After Device Return, all
Device information is unrecoverable.
6. The condition, specifications, and other representations You have provided regarding the Device are accurate. The
final appraised value of the Device may be adjusted if AT&T, its affiliates, its designees, vendors and/or suppliers
determine the Device Returned and received does not accurately match the condition, specifications, and other
representations You provided.
7. You are responsible for previous or subsequent charges incurred before, during, or after Return of the Device.
8. If participating in early trade-in/turn-in program, you must be at least 18 to participate.
9. AT&T, ITS AFFILIATES, ITS DESIGNEE(S), VENDORS AND SUPPLIERS SHALL NOT BE LIABLE UNDER ANY
CIRCUMSTANCE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, INCIDENTAL, OR
EXEMPLARY DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, EVEN IF ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES, ARISING OUT OF ANY DEVICE RETURN OR WITH RESPECT TO THE DEVICE, INCLUDING
DAMAGES RELATED TO INFORMATION LEFT ON DEVICE.
10. TO THE EXTENT PERMITTED BY LAW, AT&T, ITS SUBSIDIARIES, AFFILIATES, VENDORS AND SUPPLIERS WILL
NOT BE LIABLE FOR MORE THAN THE AT&T APPRAISED VALUE OF THE RETURNED DEVICE.
11. The Device is associated with a wireless service under a separate Consumer Service Agreement, Wireless
Service Terms or an AT&T business or government agreement (collectively, the “Service Agreement”).
Except as prohibited by applicable law, the Dispute Resolution By Binding Arbitration and Arbitration
Agreement provisions or other dispute resolution provisions of Your Service Agreement are incorporated by
reference in this Agreement and will survive termination of your Service Agreement and your AT&T
Installment Plan. Accordingly, ALL disputes under this Agreement shall be resolved by the dispute
resolution provisions in Your Service Agreement.
12. DISPUTE RESOLUTION BY BINDING ARBITRATION. Most customer concerns can be quickly resolved by
calling customer service (1-800-331-0500). If customer service cannot resolve the issue and if Your
Service Agreement includes an arbitration provision, You and we agree to resolve disputes in binding
arbitration or small claims court in accordance with that arbitration provision. See att.com/
disputeresolution for details. Arbitration is more informal than a lawsuit in court. Arbitration uses a
neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject
to very limited review by courts. Arbitrators can award the same individual damages and individual relief
that a court can award. Any arbitration under this Agreement will take place on an individual basis, without
class, representative, or private attorney general proceedings.
