Surinder Gupta J. (Oral) In the complaint under Section 138 of Negotiable Instruments Act, the
petitioner was summoned and was declared as proclaimed offender.

It has been submitted that the petitioner never jumped bail in the case. He was never served personally
or evaded to appear in Court. He has been wrongly declared proclaimed offender. The offence under
Section 138 of Negotiable Instruments Act is bailable offence.

Keeping in view the fact that the petitioner has never misused the concession of bail; the offence under
Section 138 Negotiable Instruments Act is bailable; the petitioner has surrendered before the trial Court
and has been allowed bail; the order dated 21.11.2013 allowing him Mohan Brij 2014.02.07 10:39 I
attest to the accuracy and integrity of this document Chandigarh interim bail is made absolute.
