CHAPTER I

LEGAL AND TAXATION ASPECTS

This chapter contains the main legal forms of business and how they are managed

and set up and the taxes of the business entity.

1.1Legal Requirements

A business to be set up must have compliance to every legal requirements

mandated by the corresponding government agencies. It allows the business to avoid

legal issues regarding the business structure in the future.

The registrations with different agencies are presented as well as the necessary

requirements needed. Articles of incorporation, by-laws and other documentary

requirements are likewise shown.

1.1.1 Securities and Exchange Commission (SEC)

Investors who wish to set up corporations. Associations or partnerships in the

Philippines, must first register their business with the Securities and Exchange

Commission (SEC). The SEC also approves amendment of Articles of Incorporation and

by-laws (for stock and non-stock domestic corporations) and other applications (i.e

Increase/Decrease of authorized capital stock, increase of foreign equity, dissolution).

As stated in the Securities Regulation Code, Presidential Decree No.902-A, the

SEC has jurisdiction and supervision over all corporations, partnerships or associations.

The SEC has the right to approve, reject, suspend or revoke registration license

applications, investigate, and impose sanctions for the violation of laws and rules under

the Security Regulation Code.

To be able to register a business, submitting the proposed business name with the

SEC is the first step. SEC will then verify if the proposed name is still available. To make

the process faster, it is always encouraged for clients to have 3 proposed business names

ready in case the desired name is unavailable. Other documents such as registration data

sheet, articles of Incorporation and its By-Laws/articles of partnership and certificate of

deposit of the required paid in capital are among the many requirements needed by the

SEC. Documentary requirements vary depending on the type of company formation.

Process of registration of Business in Security and Exchange Commission:

1. Check if the desired business name is available in the SEC online website or

at SEC office in Mandaluyong

2. If available, register or reserve the business name via SEC online website or at

SEC Name Verification Unit – SEC office in Mandaluyong

3. Preparation, signing, and notarization the following:

1. Articles of Incorporation

2. By-laws

3. Treasurer’s Affidavit; and

4. Joint affidavit of two incorporators undertaking to change corporate name

immediately upon receipt of notice or directive from the Securities and

Exchange Commission that another corporation, partnership, or person has

acquired a prior right to the use of that name or that name has been

declared misleading, deceptive, confusingly similar to a registered name,

or contrary to public morals, good customs or public policy. (Not required

if the Articles of Incorporation have a provision on this Commitment)

1.1.2 Bureau of Internal Revenue (BIR)

Every corporation Philippines is required to pay taxes to contribute to the

economic growth of the country. Thus it is very important to have a Philippines business

registration with the Bureau of Internal Revenue or BIR before the business goes into the

full operation. For the agency, it is important to pay taxes so they won’t be filed with tax

evasion and, at the same time, they are helping in making the country better. While there

are some who don’t like it, paying taxes and applying for a Taxpayer Identification

Number (TIN) is part of the business registration in Philippines.

BIR is a meticulous Philippines business registration because it involves paying

taxes that will help support the country’s economic growth. Unless otherwise provided by

law, no corporation Philippines is exempted from paying taxes and registration is

necessary to track those who are not paying. Once Philippines incorporation is done with

registering in BIR and other government agencies, they can start the operation with ease.

Process of Registration to BIR:

 Go to the Regional District Office (RDO) where the business is located

 Fill-up registration form (Regional District Office) as follows:

o BIR Form 1903 – Application for registration (For

Partnership/Corporation)

 Submit completed registration form together with the following:

o Certificate of Registration from SEC

o Barangay Clearance

o Business Permit from the Mayor’s Office

o Proof of address such as Contract of Lease (if rented) or Certificate of

Land Title if (owned)

o Valid IDs, if applicable

 Payment of registration form (BIR Form 0605) and Documentary Stamp Tax

(BIR Form 200), if applicable

 Registration of books of accounts and receipts/invoices

 Claiming of certificate of Registration (BIR Form 2303)

1.1.3 Local Government Units

The Local Government Code authorizes barangays to levy taxes, fees, and

charges on certain businesses in their territory that shall exclusively accrue to them.

Corollary to this authority, the law provides that “no city or municipality may

issue any license or permit for any business activity unless a clearance is first obtained

from the barangay where such business or activity is located or conducted. For such

clearance, the sangguniang barangay may impose a reasonable fee.”

The barangay is obliged to act on the license or permit application within seven working

days from its filing. In case the license or permit is not issued within that period, the city

or municipality may issue the said license or permit.

Process of acquiring Barangay Clearance and Mayor’s Permit:

1.1.3.1 Barangay Clearance

o Go to the barangay where the business is located to secure and fill-up

application form

o Submit the completed application form together with the following:

 Certificate of Business Registration from SEC

 Two (2) valid IDs

 Proof of address such as Contract of Lease (if rented) or Certificate

of Land Title (if owned)

1.1.3.2 Mayor’s permit

o Go to the municipal office where the business is located to secure and fill-up

application form

o Submit the completed application form together with the following

 Certificate of Business Registration from SEC

 Barangay Clearance Certificate

 Two (2) valid IDs

 Proof of address such as Contract of Lease (if rented) or Certificate

of Land Title (if owned)

 SEC Registration (for incorporation)

 Copy of public liability insurance issued by an accredited insurer

 Occupancy Permit of the building where the business will be

located

1.1.3.3 Occupancy Permit

o Go to the municipal office where the business is located to secure and

fill-up application form

o As-Built Plan

o Fire Safety Inspection Certificate

o Certification from civil, electrical engineers and master plumber as to

conformity with the approved project plan

o Certificate of Final Inspection

Steps to Secure Occupancy Permit

o Request for issuance of Sanitary Permit

o Interview and site visit by the sanitary inspector

o Submit specimen for laboratory examination and wait for results within

24 hours

o Pay the prescribed fees

o Proceed to the municipal health office for physical examination. Results

of the laboratory examination should also be presented

o Health Certificate will be issued. This will be presented to the Sanitary

Basic Requirements

Steps of Secure a Sanitary Permit

1. Request for issuance of Sanitary Permit.

2. Interview and site visit by the sanitary inspector.

3. Submit specimen for laboratory examination and wait for results within 24

hours.

4. Pay the prescribed fees.

5. Proceed to the municipal health office for physical examination. Results of the

laboratory examination should also be presented.

6. Health Certificate will be issued. This will be presented to the Sanitary

Inspector for approval.

7. Release of Sanitary Permit.

1.1.3.6 Community Tax Certificate

Community Tax Certificate is usually used for documentation purposes. It

is required to be presented every time an individual acknowledges any document

before a notary public; take the oath of office upon election or appointment to any

position in the government service; receives any license, certificate or permit

from any public authority; pays any tax or fees; receives any money from any

public fund; transacts other official business; or receives any money from any

public fund.

1.1.4 Others

1.1.4.1 Social Security System

Social Security Services is an insurance program mandated by the Philippine

government to cover all income earners or workers in the private sector, in contrast,

government workers are covered by the GSIS or Government Service Insurance System.

The SSS basically derives its funds from member’s contribution and investment earnings.

Such portion of the contributions that are not needed for benefit disbursements goes to a

Reserve Fund, which is intended to cover future liabilities in benefit payments of the SSS

to its over 29 million members to date.

The corporation most accomplish SSS Form R-1 (Employer SSS Registration)

and R-1A (Employment Report) signed by its President or any of the corporate officers

and submit these together with a photocopy of the Articles of Incorporation. The original

copy of the Articles of Incorporation must be presented to the SSS for authentication

purposes.

1.1.4.2 PhilHealth

All government and private sector employers are required to register with

PhilHealth to enable them to provide social health insurance coverage to their employees.

Private sector employers (including those of household helps) who have registered with

the SSS prior to July 1, 1999 are automatically registered but are required to update their

records with PhilHealth.

Procedures in registration for PhilHealth

 The corporation must submit their certificate of registration from the SEC and to

register their employees, the corporation must submit: Employer Data Record

(ER1) Form and PhilHealth Membership Registration Form (PMRF) for each

employee.

 After processing, the employer will be issued the following:

o PhilHealth Employer Number (PEN) and the Certificate of Registration

o PhilHealth Identification Number (PIN) and Member Data Record (MDR)

of registered employees

 Employers are required to display the Certificate of Registration in conspicuous

area of their offices.

1.1.4.3 Pag-IBIG

The Home Development Mutual Fund (HDMF), commonly known in the

Philippines as ‘Pag-IBIG Fund” is a government agency that caters to the shelter

financing of Filipino workers. This employee benefit includes loan, access to housing

programs and savings. Employees with SSS and GSIS (for government employees)

benefits are also mandated to be members of the Pag-IBIG Fund. Like the SSS and

PhilHealth, this benefit requires monthly contribution from both the employer and

employee. The monthly contribution is of minimal amount

1.2 Taxation Aspects

1.2.1 Corporation Tax

In the Philippines, all companies – domestic or foreign – are able to pay corporate

income tax (CIT). The tax liability for a corporation is determined by its residency status

and is based on the net income it obtains while carrying out its business activity,

normally during one business year.

The Corporate Tax Rate in Philippines stands at 30 percent. Corporate Tax Rate in

Philippines average 31.77 percent from 1997 until 2018, reaching an all-time high or 35

percent in 1997 and a record low of 30 percent in 2009.

1.2.2 Withholding Tax

Withholding tax is a government requirement for the payer of an item of income

to withhold or deduct tax from the payment, and pay that tax to the government.

1.2.2.1 Withholding Tax on Compensation

It is the tax withheld from and a method of collecting the income tax at source

upon receipt which applies to all employed individuals whether citizens or aliens,

deriving income from compensation for services rendered in the Philippines. The

employer is regarded as the withholding agent.

The normal working time of eight (8) hours a day shall be the basis of the computation of

the minimum wages and this computation shall be in accordance with Collective

Bargaining Agreement (CBA), or provisions of the Labor Code as implemented. As a

general rule, every employer making payment of wages shall deduct and withhold upon

such wages shall deduct and withhold upon such wages a tax determined in accordance

with the rules and regulations to be prescribed by the Secretary of Finance, upon

recommendation of the Commissioner, and the prescribed Revised Withholding Tax

Tables (Annex “C”) which shall be used starting January 1, 2009. In connection with this,

Revenue Regulations No.1 2006 calls for the exemption from withholding tax of

compensation of individuals that do not exceed the statutory minimum wage or Five

Thousand Pesos (Php 5,000.00) per month, whichever is higher.

1.2.3 Documentary Stamp Tax

The Documentary Stamp Tax is an excise tax levied on documents, instruments,

loan agreements and papers evidencing the acceptance, assignment, sale or transfer of an

obligation, rights, or property incident thereto. The amount of tax is either fixed or based

on the par or face value of the document or instrument.

Failure to stamp a taxable document shall not invalidate the same. However, it shall not

be recorded in the Registry of Deeds or admitted or used as evidence in any court until

the requisite stamp is affixed thereto and cancelled. Furthermore, no notary or other

officer authorized to administer oaths shall add his acknowledgement to the document

unless the proper documentary stamp is affixed thereto and cancelled.

Documentary Requirements

o Photocopy of document(s) to which the documentary stamp shall be, affixed,

in case of constructive affixture of Documentary Stamp Tax

o For metering machine users, a schedule of the details of usage or consumption

of documentary stamp

o Proof of exemption under special law, if applicable

o Duly approved Tax Debit Memo, if applicable

1.2.4 Regular/ Normal Tax

As stated in Republic Act no. 9337, Section 27 of the first section of the National

Revenue Code of 1997, as amended, is hereby further amended to read as “Except as

otherwise provided in this Code, an income tax of thirty percent (30%) is hereby imposed

upon the taxable income derived during each taxable year from all sources with and

without the Philippines by every corporation, as defined in Section 22(B) of this Code

and taxable under this Title as a corporation, organized in, or existing under the laws of

the Philippines: Provided, That effective January 1, 2009, the rate of income tax shall be

thirty percent (30%).

In the case of corporations adopting the fiscal-year accounting period, the taxable

income shall be computed without regard to the specific date when specific sales,

purchases and other transactions occur. Their income and expenses for the fiscal year

shall be deemed to have been earned and spent equally for each month of the period.

The corporate income tax rate shall be applied on the amount computed by multiplying

the number of months covered by the new rate within fiscal year by the taxable income of

the corporation for the period, divided by twelve.

1.2.5 Minimum Corporate Income Tax (MCIT)

Minimum Corporate Income Tax is not a new tax imposition as it merely

approximates the amount of the income tax which is payable by a corporation. The MCIT

is a means to ensure that businesses earning positive returns do not avoid paying income

tax. MCIT equivalent to two-percent (2%) of gross income is imposed beginning the

fourth (4th) taxable year immediately following the taxable year in which such

corporation started its business operations. It is imposed whenever such corporation has

zero or negative taxable income or whenever the amount of the MCIT is greater than the

regular corporate income tax due from such corporation. MCIT is equivalent to two

percent (2%) of the gross income derived from sources within the Philippines is also

imposed on resident foreign corporations. Furthermore, under the tax scheme, any excess

of the MCIT over the regular corporate income tax is carried forward on an annual basis

and can be credited against the regular income tax for three years.

The Secretary of Finance, upon recommendation of the Bureau of Internal

Revenue Commissioner, may suspend the imposition of MCIT upon submission of proof

that the corporation sustained substantial losses on account of a prolonged labor dispute,

“force majeure”, or legitimate business reverses.

1.2.6 Value Added Tax

According to section 106 of the National Internal Revenue Code of the

Philippines, there shall be levied, assessed and collected on every sale, barter or exchange

of good or properties, a value-added tax requirement to ten percent (10%) of the gross

selling price or gross value in money of the goods or properties sold, bartered or

exchanged, such tax to be paid by the seller or transfer or: Provided, That the president,

upon the recommendation of the Secretary of Finance, shall, effective January 1, 2006,

raise the rate of value-added tax to twelve percent(12%).

1.2.7 Community Tax

Community tax is a tax imposed on all the inhabitants of the community who

stayed in the Philippines for more than three months. These inhabitants are classified into

individuals, who must be of legal age, and juridical persons, like corporations, who are

doing business in the community or whose office or establishment is located in the

community.

Every corporation, no matter how created or organized, whether domestic or

foreign resident, engaged in or doing business in the Philippines shall pay an annual

community tax of five hundred pesos(Php 500.00) and an additional of two pesos (Php

2.00) for every five thousand pesos (Php5000.00) worth of real property in the

Philippines owned by the inhabitants during the preceding year situated in the

municipality or of gross receipts or earnings derived from the business including

dividends received by a corporation from another corporation which, in no case, shall

exceed then thousand pesos(Php 10,000.00).

1.2.8 Income Tax

Income tax is a tax on all yearly profits among from property, profession, trades

or offices or as a tax on person’s income, profits and like in the Philippines.

For Domestic Corporation in the Philippines, the corporate tax rate is 30% of the Net

taxable income from all sources starting January 1, 2009.

MANAGEMENT ASPECT

The objective of the management aspect of a feasibility study is to determine the

option effectiveness of the organizational setup and the qualifications of the individuals

who will make up the organization.

2.1 Business Profile

2.1.1 Business Name

Laundry Palace is new drop off point laundry service in various yet to be named

points which will surely attract customer attention. The business offer dry cleaning,

ironing and folding of clothes as well as free delivery service for the convenience of the

customers. We will be a registered laundry and cleaning facility that is built to serve the

people who busy like corporate executives and students. We also, offer the whole of the

community as well as visitors and travellers alike.

Laundry Palace is providing the standard of Hygienic operation. Hygiene is one

important thing that must be practiced with seriousness; as a matter of fact, it has to be a

frequent practice but academics and work sometimes make it difficult for people get to

time to wash their clothes and clean their homes and properties.

2.1.2 Business Logo

The logo serves as a symbol of our company. Flower stands for the fragrance of

our services and the leaves stands for environmental friendliness. Each color represents

our business, the White color is for the cleanliness, Gold is for the high standard

operation, Orange is for the Affordability of our customers, Blue is for trustworthy and

loyalty and Brown is for the stability and denotes of employee.

2.1.3 Type of Business Organization

Incorporated is a corporation. According to the Corporation Code of the

Philippines, Section 2, corporation is defined as an artificial being created by operation

of law, having the right of succession and the powers, attributes and properties expressly

authorized by law or incident to its existence. According to Section 11 of the

Corporation Code of the Philippines, A corporation shall exist for a period not exceeding

fifty (50) years from the date of incorporation unless sooner dissolved or unless said

period is extended. A private corporation may extend or shorten its term as stated in the

articles of incorporation when approved by a majority vote of the board of directors or

trustees and ratified at a meeting by the stockholders representing at least two-thirds

(2/3) of the outstanding capital stock or by at least two-thirds (2/3) of the members in

case of non-stock corporations. This is supported by Section 37 of the Corporation Code

of the Philippines, the Power to extend or shorten corporate term.

A corporation is created when it is incorporated by a group of shareholders who

have ownership of the corporation, represented by their holding of common stock, to

pursue a common goal. A corporation's goals can be for profit or not, as with charities.

However, the vast majority of corporations aim to provide a return for its shareholders.

Shareholders, as owners of a percentage of the corporation, are only responsible for the

payment of their shares to the company's treasury upon issuance. Unlike a partnership,

shareholders in a corporation have limited liability for corporation’s obligations. Limited

liability allows the shareholders to raise large amounts of investments for the company

by combining their own corporation a continuous existence. This is supported by

Section 37 of the Corporation Code of the Philippines which gives the corporation the

power to extend or shorten its corporate term.

2.1.4 The Incorporators

An Incorporator is a person who creates the corporate existence by signing and

filing the Articles of Incorporation. She may be one of the shareholders, directors,

officers of the corporation, or any other person.

2.1.5 Management Style

The company is going to initiate a democratic form of management wherein

managers and employees take part in the decision making in the workplace. The

democratic management style involves managers reaching decisions with the input of

the employees but being responsible for making the final decision. There are many

variations of this style of management including consultative, participative, and

collaborative styles.

Employee ideas and contributions are encouraged, but not necessary.

Communication is both top-down and bottom-up and makes for a cohesive team. This

2.4 Business Policies and Regulations

Business policy and regulations are set of broad guidelines which are formulated

to be followed by all employees for the benefit of the whole company.

2.4.1 Hiring Policy

The hiring policy encompasses the recruitment process and the selection process

in which the applicants must accomplish before becoming an employee of the company.

A. Initial Interview

Initial Interview is done to assess how qualified the applicants are. In this

stage, the HR staff will also introduce all the applicants to the job they are

applying. It is for the applicants to assess themselves if they are best fit with the

B. Selection Test

The employment test is a written examination specifically prepared for all

assessed during the first interview. Only those who passed the initial interview

will be allowed to take the test. There will be three kinds of tests namely the

personality, English proficiency and cognitive tests which all applicants should

take. The HR department will be the one to measure if the results will be pass or

fail.

C. Final Interview

The results of the employment test will be the basis in choosing the

applicants who will be allowed to go through the final interview. Unlike in the

initial interview, the questions in this stage will be more specific and will be

conducted by the Department Head. It will be generally related to the position

the applicant wishes to have.

D. Physical Examination

To be able to be a part of the company, the selected applicants must

undergo the physical and medical examination with the hospital authorized by

based on the established criteria and objectives of the company. This is the process

termination and the like. Department heads are the ones responsible for performing the

evaluation of each employee. It would be done twice a year or every six months.

Work Schedule

Laundry Palace regular office days are from Mondays to Saturdays and

its regular working hours are from 8 A.M to 5 P.M. All employees will be given

one-hour lunch break. It is 12 N.N to 1 P.M. For the employees under the

laundry employees, it will depend on their schedule, which is provided by the

company and all Sundays.

2.4.3 Promotion Policy

Performance evaluation for those under the rank and file is done primarily for

promotion purposes. This will be the basis in determining who the deserving employees

for promotion are. The criteria used in the evaluation will be based on the efficiency and

effectiveness of their work, service records especially the attendance record, skills,

loyalty, trustworthiness and excellent performance of their work.

2.4.4 Attendance Policy

Reliable, consistent attendance is a requirement and essential function of all staff

positions. Attendance and reliability are important factors in evaluating individual

performance and continued employment. Time Card will be used to record the

employee’s attendance and punctuality.

2.4.4.1 Perfect Attendance

Employees who have perfect attendance will receive an additional paid

day off for next year.

2.4.4.2 Absent

Failure to report on the scheduled working hours of one employee and

reporting for work beyond one hour of the work time are considered as absence

without notifying the Department Head by the employee. Absences may charge

to the employee’s vacation or sick leave if filed appropriately.

2.4.4.3 Tardiness

Tardiness is the quality of being late. When people don't show up on

time, they're guilty of tardiness. This can cause a certain amount of deduction to

the employee’s regular daily rate. A 15-minute grace period will be allowed by

the company. In excess of the given grace period, the deduction in the salary will

be applied. If it is more than one hour, it would be equivalent to an absent.

2.4.4.4 Failure to Time in and out

Employees are required to follow established guidelines for recording

their actual hours worked. If there is any problem recording a time in and out, the

employees should inform a manager immediately. Employees who consistently

fail to time in and out may receive disciplinary action and including termination.

2.4.6 Drug, Alcohol, and Smoking Policy

Laundry Palace has a commitment of health and safety of all employees and

customers. The Company contains drug and alcohol free. No using illegal drugs and

drinking any types of alcohol, selling it on the work place in working hours also, going

to work under the influence of drugs and alcohol which may cause adverse effect on

employees work performance, safety of co-employees and customers, is not permitted.

Smoking in work area is also not allowed nor allows employees to smoke during their

break in designated smoking area. This policy applies for all employees of the company

while doing services for the customer. Laundry Palace provides a safe workplace by

eliminating the hazards to health and job safety created by alcohol and other drug abuse.

2.4.7 Telephone and Computer Use Policy

When making phone call in line with their duties, employees must answer them

in a courteous and efficient manner. Employees must keep in mind to get the important

details and relay the message promptly. Ask for clarifications if necessary. If the

employees cannot supply the needed information, direct and transfer the call to the right

person before a problem arises.

Incoming personal telephone calls are not prohibited; their frequency and

duration though should not interfere with ongoing work duties nor distract fellow

employees. Taking advantage of this privilege, on the other hand, may lead to

disciplinary action. It should be kept as short as possible in the interests of minimizing

disruption to work. Making personal outgoing or long-distance calls are discouraged

2.4.8 Dress Code

All employees of Laundry Palace must be clean and well groomed. Employees

expected to wear smart casual it would be a pair of slacks with a white polo for top and

safety shoes. The white uniform signifies the clean work of the employees in Laundry

Palace. The safety shoes are to prevent workers from accident. Employees required

wearing their uniform during work hours in Laundry Palace.

2.4.9 Personal Hygiene

In this time of pandemic, the company will implement measures to achieve the

minimum standards and also document these measures. The company will develop

COVID-19 response plan and share it to the employee, such as:

 Surfaces and objects need to be wiped with disinfectant regularly

 Employees will put sanitizing hand rub dispensers in prominent places around

the workplace

2.4.10 Company Property Policy

The company uses biometrics in monitoring the attendance of the employees the

workers will let the machine to scan their fingerprint to record their attendance. Failure

to record shall mean absence.

An employee who is absent from work and does not notify his supervisor for

three consecutive days may be considered to be absent without official leave (AWOL).

Employees who violate company’s attendance policy for three or more times within a

30- day period may be subject to a Human Resource Manager’s disciplinary probation

or dismissal.

Employees will be given an identification card and must be worn at all times

during office and factory hours.

Absences shall mean any failure to report for work for at least one (1) whole

working day for any cause whatsoever. It may be excused or unexcused. However, it

shall be always being avoided to avoid disruption of business operation.

In case of absence without permission because of unexpected, urgent and valid

reason, an employee must inform his immediate supervisor before the start of working

hours and relay reasons for said absent without leave.

An employee who wishes to be absent must submit the official leave from one

(1) day before the intended date of absence in order to get the approval of immediate

supervisor.

An employee shall submit an official leave report to his immediate supervisor on

the first working day after his absence. Failure to submit shall mean absence subject to

intolerable. Lying to the public or falsifying reports can even put the organization’s

health and safety at risk. Any form of harassment is strictly prohibited. An orientation

about harassment is implemented by the organization.

2.4.12 Voluntary Termination of Employment

When an employee decides voluntarily to terminate employment with the

Foundation, the termination is for one of the following four reasons: retirement,

resignation, job abandonment, or failure to return to work upon leave expiration. The

following describes each one of the reasons for voluntary severance of employment.

Resignation

Resignation is the voluntary decision by an employee to terminate

employment.

Retirement

Retirement is the relinquishment of a job by an employee after he or she

reaches the specific age and attains the service requirements necessary to collect

retirement benefits. Central Office must be notified of an employee's retirement.

Job Abandonment

Job abandonment occurs when an employee is absent from work for three

or more consecutive work days and has failed to call his or her supervisor or

notify the supervisor of the reason for the absence. When this situation occurs, it

is treated as a voluntary resignation effective on the last day the employee

worked. Job abandonment cases must be reviewed.

Failure to Return to Work Upon Leave Expiration

When an employee is unpaid while on an approved leave of absence,

(such an absence) is considered an inactive pay status. For such a period of

approved absence, a date must be specified for the return of the employee to

active pay status. Failure of an employee to return from an approved leave on the

specified date is treated as a voluntary resignation effective on the date scheduled

for return.

2.5 Forms of Violations

2.5.1 Disciplinary Actions

It is a method of dealing with employees who caused problems or do not follow

company rules and policies. The said action is depending on the severity of the case.

A disciplinary action can take into different forms such as:

2.5.1.1 Verbal Warning

It is letting someone know that if their work, behaviour or actions do not

improve there may be further action. It's usually the first stage of a formal

disciplinary procedure.

It is to correct a performance problem by discussing it with the employee

and providing a written record of that conversation.

2.5.1.3 Suspension

Losing of work together with the wages for a specific number of hours or

days but not for more than a week depends on the severity the offense made.

Notice of suspension is given to the employee through a written document.

 Interfering with another employee’s performance of duties.

 Failing to report loss of property or damage of products.

 Loss of ID due to the negligence of the employee.

 Refusal to carry out lawful instruction

 Abusive or insulting language

 Smoking in a non-smoking area.

 Gross disobedience or insolence.

2.5.2.3 Third Offense

 Gross or habitual neglect of duties

 Leaving the workplace while on duty without any notice.

 Participating or tolerating the offense committed by subordinate.

 Spreading malicious rumours against other company employees,

officials or customers concerning personal affair.

 Uttering negative remarks, doing acts or making gestures to a

superior, officer or manager in the performance of their duties.

2.5.2.4 Fourth Offense

 Excessive absenteeism. Absenteeism in itself is usually not

considered a fireable offense, but frequent and excessive absenteeism

is a cause for concern.

 Violence and harassments toward other employees. Harassment can

be defined as any behaviour that demeans, embarrasses, humiliates,

annoys, alarms or verbally abuses a person and that is known or

would be expected to be unwelcome. These behaviours include

words, gestures, intimidation, bullying, or other inappropriate

activities.

 Consuming alcoholic beverages while on duty, or the possession or

consumption of illegal drugs.

 Serious Insubordination. It is when an employee who is outright

disobedient or disrespectful to a manager or owner of a business. It’s

not always grounds for termination, but it becomes serious the

moment the employee displays a blatant disregard for company

procedures.

 Constant work negligence and violation of policies. Neglecting one’s

work duties and company policies are not usually subject to outright

termination. However, if an employee does not show signs of

improvement after several verbal and written warnings, termination

should be considered.

 Employee theft. Any stealing, use or misuse of their employer's assets

without permission to do so.

2.5.3 Prohibited conduct

Employees are prohibited from making threats or engaging in violent activities.

This list of behaviours, while not inclusive, provides examples of conduct that is

prohibited.

 Causing physical injury to another person such as subordinate(s), official(s),

customer(s) and etc.

 Making threats of any kind.

 Aggressive, hostile or violent behaviour, such as intimidation of others; attempts

to instill fear in others; or subjecting others to emotional distress.

 Other behaviour which suggests a propensity toward violence, which may

include belligerent speech, excessive arguing or swearing, sabotage or threats of

sabotage of business property, or a demonstrated pattern of refusing to follow

business policies and procedures.

 Intentionally damaging the business property or property of another employee,

officer or customers.

 Possession of a weapon while on University property or while on University

business, with the exceptions indicated in the weapons policy.

 Committing acts motivated by, or related to, sexual harassment or domestic

violence.

2.6 Projected Salary

Projected salaries are shown on the tables. The business’ operation will start next

year, 2021. During its 4th year, the business will give all the employees a 5% annual

salary increase up until on its 5th year.

Laundry Palace will offer a complete range of dry cleaning, laundry care and

Tagging The clothes are firstly tagged with a specific number, mentioned in the
invoice given to customers. This procedure is used for identification of
clothes once ready for collection for customers.
Sorting After tagging the clothes are arranged in different sets. Some people will
sort by color.
Pre- Soaking in hot water.

Washing The clothes are washed in washing machine using detergent washing
powder and or bleach on white.
Drying The clothes washed are transferred to dryers. (Note: one of the machine are

Packing Once pressed, the clothes are properly hanged and covered in the plastic

2. Check the item against the laundry list. Make sure the item received matched

the item listed on the laundry list.

3. Tag each laundry items.

4. Check for damage and lost and found items.

5. Fill out in the separate logbook for lost and found items. Record the time,

date, name, and description of the item

6. Place the item in a plastic bag and surrender it to the supervisor.

7. Record the laundry items according to company procedures. Record the date,

name of customer, time received, name of the attendant, signature and

remarks.

8. Sort each item according to weight and color (heavy, white, colored and

damaged). Put damaged item to separate basket

Removing Stain

1. Prepare the necessary materials. (gloves,cotton cloth, stain remover, laundry

basket)

2. Lay the cotton cloth on your work area - cotton cloth absorbs the stain while it

is being removed.

3. Turn the garments to its wrong side.

4. Lay the stained part of the garment on the cotton cloth.

5. Wear protective equipment - Gloves protect your hands from harsh effect of

chemicals.

6. Apply stain remover and gently scrub the area. Apply more stain remover as

necessary for stubborn stains; soak the garments for 5-15 mins.

7. Check if the stain has been removed.

8. Place the garment in a basket for laundry.

3.4.2. Waste Management

Industrial laundries are large water users and generate large volumes of waste

water so this is an obvious area where substantial cost and environmental savings can be

made. Industrial laundries also generate solid wastes such as damaged items, detergent

and other chemical containers, and packaging used to deliver soiled and cleaned items.

The nature of wastes depends on the source of the items to be cleaned. Hospital laundry

waste water may be hotter, have highly variable pH levels (alkaline detergents followed

by acidic sanitizers) and contain bleach and other disinfectants and contaminants such as

blood, excrement and mercury (from broken thermometers). Commercial laundries are

more likely to produce waste water with high levels of heavy metals and hydrocarbons.

Reducing waste and waste water can benefit your business and the environment by: n

reducing water and chemical purchase costs in reducing waste water treatment and

disposal costs in reducing environmental impacts associated with waste disposal and

consumption of water and resources. The layout above is strategically designed to take

into account hygiene/health as the receiving bay for dirty laundry is separate from the

collection point for clean laundry (collections dispatch zone). Most dry cleaning and

laundry service business combine the receiving bay for dirty laundry and collection point

for clean laundry. This will thus be an additional competitive advantage for our Company

that area in Manggahan General Trias we used the “slovins” formula in determining the

number of respondents for the online survey questionnaires. We use the actual number

of residents in apartments and boarding houses total 15,636 and the margin of error

would be 5%. Margin of error denotes the allowed probability of committing an error in

selecting a small representative of the population. It is used to calculate an appropriate

sample size from a population.

4.4 Marketing Plan

4.4.1 Market Analysis

There are some laundry shops in Cavite and some of them are expensive. The

Laundry Palace aims to offer affordable services to people in municipality of General

Trias and other near cities.

businesses categorized the needs of its consumers more accurately.

The business intends to offer its services whose age ranges from 18years old to

65years old. The geographical location covers the municipality of General Trias and

other near cities/municipalities around it. Laundry Palace aims to offer its services to

The municipality of General Trias officially the City of General Trias, is a

1st class city in the province of Cavite, Philippines. It is composed of 33

barangays and according to the 2010 census, it has a population of 243,322 people

flat to gently rolling with deeply incised river channels. The drainage pattern is

primarily parallel to sub-parallel while the river system flows northwards of

Manila Bay. Barangay Tejero and Bacao II is the lowest elevation of 8.0 meters

above mean sea level; while the Poblacion is at an elevation of 12.0 meters;

Barangay Manggahan junction of Governor’s Drive at elevation of 114.0 meters.

Southern portion of the municipality in particular to Brgy. Panungyanan has an

elevation of 250 meters and Brgy. Javalera at an elevation of 200 meters above

mean sea level.

Climate

There are two season in General Trias, Cavite, Philippines the rainy

season from the month of June to November and the dry season from the month

of December to May. The temperature in the city when rainy season range from

24 C to 27 C and when dry season the temperature range to 28 C to 21 C.

Slope

General Trias is known as having a flat terrain ranging from 0-3% in the

northern portion while the remaining portion of land in the southern part is hilly

and rolling, ranging from 3 to 40% slope and the rest comprises the steep portion

of the waterways.

The municipality of General Trias was converted into a component city of

Cavite on August 2015 during the term of President Benigno Aquino III. The

residents of the majority cites voted to cityhood and the bill came into full effect.

The General Trias became the seventh city in the province and the 145th in the

country.

This aspect includes the economic condition of the place where the business is

located at. It contains the SWOT Analysis, Corporate Social Responsibility and Social

Desirability.

5.1 Economic Condition

5.1.1 Business in the Philippines

A series of unforeseen events caused an abrupt halt to the Philippines' strong

growth momentum in early 2020. The Philippine economy carried its strong growth

momentum from the second half of 2019 into early 2020 thanks to positive consumer

confidence, robust macroeconomic fundamentals, and an improvement in the external

sector. However, the eruption of Taal Volcano in early January, the spread of the

Coronavirus Disease 2019 (COVID-19) outbreak in the region, and the rise of COVID-19

infection cases in the Philippines in March, forced the economy to a near halt in the latter

part of March due to severe disruptions in manufacturing, agriculture, tourism and

hospitality, construction, and trade. The economy contracted by 0.2 percent year-on-year

in the first quarter of 2020, the first contraction in over two decades, and was a sharp

reversal from the 5.7 percent growth over the same period in 2019. Leading indicators

that track economic activity in real time suggest that the contraction would be even more

severe in the second quarter as most regions of the country entered an enhanced

community quarantine (ECQ) in mid-March.

5.1.2 General Trias Cavite Economic Condition

General Trias has a total land area of 8,700 hectares, where 5,162 hectares or

59.34 % is devoted to agriculture. The total area is comprised by agricultural, forest park,

agro-industrial and idle or vacant lands. Rice farming is the predominant farming system

followed by fruit trees and vegetable farming consisting of 2,134.35, 90.50 and 82.50

hectares of the land area, respectively. The total agricultural production reached

17,840.83 metric tons. About 79% of this was contributed by rice with a production of

14, 103.61 metric tons, contributing the highest amount of Php 133 million in 2005.

General Trias has a total of 30 cooperatives which are considered vital partners in

development. At present, cooperative strengthening and enhancement is continuously

being carried out in the municipality covering pre-membership education, directorship

training, financial management training and business opportunities training, as part of the

Cooperative Strengthening and Enhancement Program of the Provincial Government.

There is also an Agrarian Reform Community (ARC’s) covering barangays Pasong

Kawayan II and Buenavista established in General Trias in June 1994. Buenavista ARBA

MDC was established as part of DAR’s institutional building, having a total asset of Php

565,360.98. The cooperative is engaged in providing credit to its members as well as in

renting out solar dryers and power tillers. As part of Agrarian Reforrn Infrastructure

Support Project II (ARISP II), the improvement of the Ipilan-Gaerlan farm to market

road in Buenavista – Pasong Kawayan II ARC having a total length of 4,227.98 meters

has been programmed and is currently being implemented.

The municipality has been experiencing its full share of rapid land use conversion

and idle lands held for speculative purposes. The conversion of agricultural land to non-

agricultural uses has contributed to the town’s decreasing agricultural production and

threatened the town’s food sufficiency. The high incidence of land banking or the

purchase of large tracts of cheap agricultural lands for the sole purpose of reclassifying

them and developing them into other land uses has further worsen the situation.

The total number of registered commercial establishments in 2005 was 2,579,

posing an 11.79% increase from 2,307 in 2004. Of these, 4.30 percent (111) were

wholesale establishments, 3.96 percent or 102 were real estate while 60 or 2.33 percent

were banking and finance. Retail establishments and service firms are concentrated

mainly in the Poblacion and public market as well as in Barangay Manggahan, San

Francisco and Tejero comprising about 62.27 percent (1,606) and 25.67 percent or 662,

respectively. There were also fifteen (15) registered commercial subdivisions operating

within the subdivision as part of the subdivision amenities that cater the needs of the

homeowners and residents.

The development of industrial parks in the municipality brought about a shift

from an economy focused on agriculture to one focused on industry and real estate

development. This shift gave way to the rise of the financial status of General Trias.

From the four (4) factories operating in the town in 1991, a total of 130 firms came about

in 2005. Eighty five percent (85%) of these are located in five (5) major industrial estates

with a land area of 421 hectares. Among the 130 industrial firms, 20 are found outside

the industrial zone, five (5) outside the special zone at the Gateway Business Park, 32 in

the New Cavite Industrial City, 18 in side the special zone at the Gateway Business Park

and 55 in the Cavite Export Processing Zone , Phase 4 along Barangays Bacao and

Tejero. However, due to the economic crisis experienced all over the country, 22

factories have closed or were temporarily shut down, hence a total of 109 factories are

still operating in full blast within the municipality.

Data gathered reveal that there is a total of about 136.33 kilometers of road in the

municipality, 29.11 kms. of which are national, 15.85 kms provincial, 4.59 kms.

municipal and 65.96 kms barangay roads. All national, provincial and municipal roads

are of the all-weather type as these are paved with either concrete or asphalt. However,

more than 43 kilometers or 33 % of barangay roads remained unpaved. Moreover,

General Trias is one of the municipalities composing the CALA area and is one of those

to be benefited by the CALA road projects. The proposed East-West roads namely the

Tanza-Muntinlupa-and Calibuyo-San Pedro roads will greatly augment the present

transport network of the town. The construction of the laterals will improve intra-

municipal accessibility as well as provide alternative linkages to other areas particularly

Metro Manila.

The industrial estates are served by independent level III systems operated and

maintained by the industrial estates operators. Deep wells are tapped to supply the water

requirements of the industries. The total allowed extraction rate is around 174.60 liters

per second or about 15.083 cubic meters per day.

With the increasing population and the considerable growth of commercial and

industrial establishments in the municipality, solid waste management would continue to

pose serious problems if no appropriate action is taken. The local government should

identify and develop a sufficient landfill that would cater to the bulging wastes generated

by the municipality.

General Trias has visibly showed its endeavor in implementing an efficient and

effective governance and public service as well as in providing basic services and

facilities to its constituents. Besides, it turned out to be an effective counterpart of the

national government in achieving sustainable growth and development through the

consolidated efforts of the local government officials, barangay officials, department

heads, and other non-government agencies. Despite economic crisis, it is noted that RPT

collection has more than doubled from a mere P 39.1 million in 2004 to P 83.5 million in

2005. Likewise, business tax collections have even increased by 34.34 %. It is hoped that

this trend will continue and business conditions will improve in order for the municipality

to be able to increase its tax collections efforts to expand its revenue base.

5.2 Social Desirability

The primary objective of this study is to determine the feasibility and viability of

a proposed plan to establish Laundry shop in General Trias, Cavite that will cater

customers from the municipality. This study will be benefits for the community.

mandated by the law of our country. Tax will help the government generate funds for the

improvement and betterment of our country.

The proposed laundry business, “Laundry Hub” will bring satisfaction to the

customers who are looking for a laundry shop that will provide and cater goods and

services of cleaning their clothes at a reasonable price. The business will help the

customers to maximize their time for other work and serve comfort to them. It will also

benefit the economy through providing jobs to every individual especially within the

resident of the covered area.

5.2.6 Environmental Accountability

Environmental impact of cleaning agents is the aftermath of chemicals contained

in the products. We can’t refuse the fact that our environment is the first distressed by

what we are doing especially when it associate upgrading our works through the help of

technology. Simple things like using a vehicle can contribute or rather give impact to our

environment.

Our laundry business “Laundry Hub” is aware of its harm to the environment like

lots of fillers used in powder detergents are poured in drains causing wastage of useful

products like common salt / washing soda and choking of drain / sewerage system.

Ingredients of detergents like sodium sulphate can wreak havoc on septic system.

Synthetic detergents and our laundry practices are adding to our ground level water

pollution.

the humans and environment as well, it has to make sure to treat every water it throws.
